The judge&#8217;s decision relies on a recent Supreme Court ruling that narrowed the scope of nationwide injunctions but allowed for class-action lawsuits to proceed. The American Civil Liberties Union filed this lawsuit shortly after the Supreme court&#8217;s decision. The legal debate centers on the interpretation of the 14th Amendment, particularly the phrase &#8220;subject to the jurisdiction thereof,&#8221; which Trump&#8217;s administration argues excludes illegal immigrants from conferring citizenship to their children. The Supreme Court has not directly ruled on the birthright citizenship issue in recent cases. CASA, the Supreme Court voted to narrow nationwide injunctions that had previously hampered Trump on a number of issues, including birthright citizenship.<\/p>\n<p>However, in their opinion, the justices said that a remedy that plaintiffs may still seek on a nationwide basis is the class-action lawsuit.<\/p>\n<p>Judge Joseph Laplante, a George W. That would mean children of illegal immigrants are not U.S. citizens.<\/p>\n<p>The president pointed to the language in the <a href=\"https:\/\/www.westernjournal.com\/nbc-anchor-caught-deceptively-altering-14th-amendment-trump-interview\/\" target=\"_blank\" rel=\"noopener\">14th Amendment<\/a>, adopted shortly after the Civil War <a href=\"https:\/\/www.archives.gov\/milestone-documents\/14th-amendment\" target=\"_blank\" rel=\"noopener\">in 1868<\/a>, which states, &ldquo;All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.&rdquo;<\/p>\n<p>&ldquo;That provision rightly repudiated the Supreme Court of the United States&rsquo;s shameful decision in Dred Scott v. Sandford, 60 U.S. (19 How.) 393 (1857), which misinterpreted the Constitution as permanently excluding people of African descent from eligibility for United States citizenship solely based on their race,&rdquo; Trump&rsquo;s executive order said.<\/p>\n<p>Those who advocate that anyone born in the U.S. is automatically an American citizen point to the first clause of the 14th Amendment to make their case, while Trump&rsquo;s Department of Justice says the <a href=\"https:\/\/www.westernjournal.com\/trump-emergency-request-works-supreme-court-schedules-rare-hearing\/\" target=\"_blank\" rel=\"noopener\">phrase<\/a> &ldquo;subject to the jurisdiction thereof&rdquo; is pivotal.<\/p>\n<p>Illegal aliens are, by definition, citizens of other countries and therefore not subject to U.S. jurisdiction, the DOJ argues.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">&#129525;1. <a href=\"https:\/\/twitter.com\/MeetThePress?\">@MeetThePress<\/a> omits six words about birthright citizenship from the 14th Amendment<\/p>\n<p>The omitted text is set off by asterisks:<\/p>\n<p>&ldquo;All persons born &hellip; in the United States, *and subject to the jurisdiction thereof,* shall be citizens of the United States&rdquo;<\/p>\n<p>Those words matter <a href=\"https:\/\/t.co\/qVYld0O4og\">https:\/\/t.co\/qVYld0O4og<\/a><\/p>\n<p>&mdash; Mike Lee (@BasedMikeLee) <a href=\"https:\/\/twitter.com\/BasedMikeLee\/status\/1865817012334710961?\">December 8, 2024<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The Supreme Court has never ruled on the issue, including last month, when the justices <a href=\"https:\/\/www.westernjournal.com\/clarence-thomas-makes-point-day-supreme-court-hears-arguments-birthright-citizenship-case\/\" target=\"_blank\" rel=\"noopener\">only addressed<\/a> the issue of nationwide injunctions.<\/p>\n<p>The closest they have come to such a ruling was in 1895, when the Court <a href=\"https:\/\/www.scotusblog.com\/2025\/02\/a-history-of-birthright-citizenship-at-the-supreme-court\/\" target=\"_blank\" rel=\"noopener\">held<\/a> that children born to legal resident aliens are American citizens.<\/p>\n<p>The question of whether to issue an injunction was &ldquo;not a close call,&rdquo; LaPlante said, noting children could be deprived of U.S. citizenship if Trump&rsquo;s order took effect, according to The Hill.<\/p>\n<p>The judge has given Trump seven days to appeal his ruling.
