\t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>If the state finds any merit to that claim, it could open the door for a retrial.<\/p>\n<p>Ibarra waived his right to go before a jury and opted for a bench trial.<\/p>\n<p>As <a href=\"https:\/\/abcnews.go.com\/US\/laken-riley-murder-trial-jury-waived\/story?id=115776271\" target=\"_blank\" rel=\"noopener\">ABC News<\/a> noted at the time, the now-convicted killer was asked by the judge if he understood the waiver was done &ldquo;freely, knowingly and intelligently signed and considered.&rdquo;<\/p>\n<p>Ibarra answered that he understood, and his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-both-republicans-and-democrats-are-wrong-about-bill-barr\/\" title=\"Why Both Republicans And Democrats Are Wrong About Bill Barr\">legal team raised<\/a> no objection.<\/p>\n<p>Haggard heard the case and found Ibarra guilty before handing him a sentence of life in prison.<\/p>\n<p>Ibarra was convicted in November 2024 of malice murder, felony murder, kidnapping, and aggravated assault with intent to rape.<\/p>\n<p>Despite that conviction, the new ruling means Ibarra&rsquo;s defense team now gets a second shot at the expense of taxpayers.<\/p>\n<p>Ibarra entered the U.S. illegally in 2022 and was released multiple times under sanctuary policies before eventually ending up in <a href=\"https:\/\/www.westernjournal.com\/georgia-trump-supporter-blows-baiting-cnn-reporter-walks-off-mid-interview-aint-talking-facts\/\" target=\"_blank\" rel=\"noopener\">Georgia<\/a>.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/breaking-house-oks-laken-riley-act-next-stop-trumps-desk\/\" target=\"_blank\" rel=\"noopener\">Riley<\/a> was just 22 when she was attacked while jogging last February near the campus of the University of Georgia in Athens &mdash; a sanctuary city.<\/p>\n<p>Authorities said Ibarra, a Tren de Aragua member, dragged her into a wooded area, beat her with a rock, and left her to die.<\/p>\n<p>As The Western Journal previously reported, Democrats have repeatedly downplayed Riley&rsquo;s death, even refusing to name her in public statements.<\/p>\n<p>Congressional Democrats <a href=\"https:\/\/www.westernjournal.com\/democrats-show-shocking-callousness-laken-riley-jocelyn-nungarays-mothers-new-low\/\" target=\"_blank\" rel=\"noopener\">refused to stand<\/a> for her in March when President Donald Trump cited her case while addressing a joint session.<\/p>\n<p>Riley&rsquo;s mother, Allyson Phillips, previously said of Ibarra, &ldquo;This monster took away our chances to see Laken graduate from nursing school.
