return false;\" title=\"Printer Friendly, PDF &amp; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>If you thought the <a href=\"https:\/\/thefederalist.com\/tag\/judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">judicial coup<\/a> against the Trump administration couldn&rsquo;t get any more egregious than it already is, think again. <\/p>\n<p>On Monday, District Judge Indira Talwani took it upon herself to try and <a href=\"https:\/\/www.foxnews.com\/politics\/federal-judge-pauses-trump-administrations-planned-parenthood-defunding-measure\" target=\"_blank\" rel=\"noreferrer noopener\">unilaterally block<\/a> a provision from legislation passed by Congress to defund Planned Parenthood. Through the use of a temporary restraining order, or TRO, the Obama appointee (and <a href=\"https:\/\/thefederalist.com\/2025\/04\/15\/judge-blocking-trumps-deportation-of-foreign-nationals-donated-to-barack-obama-elizabeth-warren\/\" target=\"_blank\" rel=\"noreferrer noopener\">Democrat donor<\/a>) declared that the Trump administration cannot enforce a provision of the recently passed reconciliation bill that prevents Medicaid funding from going to entities run by the nation&rsquo;s largest abortion provider. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-193292228\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>&ldquo;This Temporary Restraining Order shall remain in effect for fourteen days, unless vacated, modified or extended by the court,&rdquo; Talwani wrote. &ldquo;It is so ordered.&rdquo; <\/p>\n<p>As The Federalist&rsquo;s Margot Cleveland <a href=\"https:\/\/x.com\/ProfMJCleveland\/status\/1942359213457519045\" target=\"_blank\" rel=\"noreferrer noopener\">observed<\/a>, Talwani&rsquo;s order isn&rsquo;t a nationwide injunction, which the Supreme Court recently <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a884_new_g314.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">determined<\/a> in its <em>Trump v. CASA<\/em> case &ldquo;likely exceed the equitable authority that Congress has given to federal courts.&rdquo; Rather, Cleveland wrote, it &ldquo;allowed an organization, Planned Parenthood, to obtain relief on behalf of unnamed member organizations&rdquo; &mdash; an issue which &ldquo;SCOTUS did not address&rdquo; in <em>Trump v. CASA<\/em>. <\/p>\n<p><strong>[RELATED:[RELATED:<a href=\"https:\/\/thefederalist.com\/2025\/07\/03\/judge-blocks-another-trump-order-proving-alito-was-right-about-loopholes-in-scotus-injunction-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">SCOTUS Ruling Against <\/a><a href=\"https:\/\/thefederalist.com\/2025\/07\/07\/scotus-ruling-against-universal-injunctions-didnt-go-far-enough\/\" target=\"_blank\" rel=\"noreferrer noopener\">Universal <\/a><a href=\"https:\/\/thefederalist.com\/2025\/07\/03\/judge-blocks-another-trump-order-proving-alito-was-right-about-loopholes-in-scotus-injunction-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">Injunctions Didn&rsquo;t Go Far Enough<\/a>]<\/strong><\/p>\n<p>If you&rsquo;re looking for a coherent legal rationale behind Monday&rsquo;s decision, you won&rsquo;t find it in Talwani&rsquo;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.286600\/gov.uscourts.mad.286600.18.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">edict<\/a>. Nowhere in her two-page order does she bother to explain how the left-wing plaintiffs demonstrated &ldquo;good cause&rdquo; to justify the TRO, or what legal authority she possesses to unliterally force the executive to violate a provision of law passed by Congress and signed by the president. <\/p>\n<p>Then again, that&rsquo;s been the standard with most (<a href=\"https:\/\/thefederalist.com\/2025\/06\/18\/80-percent-of-anti-trump-lawsuits-are-filed-in-courts-ruled-by-democrat-appointees\/\" target=\"_blank\" rel=\"noreferrer noopener\">predominantly<\/a> Democrat-appointed) lower court judges greenlighting leftists&rsquo; lawfare against the administration. To them, their word and their word alone must be strictly adhered to &mdash; regardless of whether or not it is constitutionally sound.<\/p>\n<p>Like many of her <a href=\"https:\/\/amzn.to\/3YuVZYV\" >fellow rogue district judges<\/a>, Talwani is acting like the Constitution doesn&rsquo;t apply to her.
