South Sudan has been subject to a <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/state-department\" target=\"_blank\" rel=\"noreferrer noopener\">State Department<\/a>&nbsp;travel warning due to &ldquo;crime, kidnapping, and armed conflict.&rdquo;<\/p>\n<p>&ldquo;Even if we accepted respondents&rsquo; characterization of the May 21 order, such a remedy would serve to &lsquo;coerce&rsquo; the Government into &lsquo;compliance&rsquo; and would be unenforceable given our stay of the underlying injunction,&rdquo; the majority wrote.<\/p>\n<p>Justice Elena Kagan, who <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3451537\/supreme-court-trump-immigration-allowed-deport-third-countries\/\" target=\"_blank\" rel=\"noopener\" title=\"\">dissented from the original June 23 decision<\/a> to lift the injunction, nevertheless sided with the majority on Thursday. <\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">U.S. Supreme Court Justice Elena Kagan speaks during an event at the Library of Congress for the 2024 Supreme Court Fellows Program hosted by the Law Library of Congress, Thursday, Feb. 8, 2024, in Washington. (AP Photo\/Jess Rapfogel)<\/figcaption><\/figure>\n<p>&ldquo;I do not see how a district court can compel compliance with an order that this Court has stayed,&rdquo; Kagan wrote in a brief concurring opinion.<\/p>\n<p>But liberal Justices Sonia Sotomayor and Ketanji Brown Jackson dissented, accusing the majority of rubber-stamping deportations that could expose migrants to grave harm. <\/p>\n<p>&ldquo;Other litigants must follow the rules, but the administration has the Supreme Court on speed dial,&rdquo; Sotomayor wrote, arguing the high court&rsquo;s decision risks sending &ldquo;thousands to the risk of torture or death.&rdquo;<\/p>\n<p>The dispute stems from a class-action lawsuit filed by immigration advocates challenging Trump&rsquo;s fast-tracked third-country deportation policy. The&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/homeland-security\" target=\"_blank\" rel=\"noreferrer noopener\">Department of Homeland Security<\/a>&nbsp;<a href=\"https:\/\/amzn.to\/3YuVZYV\" >began expanding rapid removals earlier<\/a> this year, arguing that the policy is essential for deporting migrants convicted of crimes whose home countries refuse to take them back.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Trump administration<\/a>&nbsp;has maintained that it is acting lawfully, citing diplomatic assurances from South Sudan that deported individuals will not face torture. The Supreme Court previously permitted Trump to end temporary humanitarian protections that the Biden administration had extended for hundreds of thousands of migrants, and signaled its willingness to let contentious immigration policies proceed during ongoing legal battles.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3452103\/doj-supreme-court-south-sudan-deportation-case\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>DOJ ASKS SUPREME COURT TO RULE OVER JUDGE&rsquo;S &lsquo;LAWLESS ACT OF DEFIANCE&rsquo; IN SOUTH SUDAN DEPORTATION CASE<\/strong><\/a><\/p>\n<p>Murphy&rsquo;s original <a href=\"https:\/\/abcnews.go.com\/US\/judge-blocks-administration-deporting-noncitizens-3rd-countries-due\/story?id=120951918\" target=\"_blank\" rel=\"noopener\" title=\"\">April 18 order<\/a> had required the government to give migrants a chance to argue they would face torture if deported to a country to which they had no ties. After the high court stayed that injunction, Murphy attempted to continue blocking removals through a separate remedial order.
