U.S. District Judge Waverly Crenshaw emphasized the importance of adhering to court rules designed to maintain the fairness of the legal proceedings. The DOJ previously described Garc\u00eda as a member of MS-13,a group designated as a foreign terrorist organization. He is currently in federal custody in Nashville, Tennessee, and facing a hearing on his charges.<\/p>\n<p>Garc\u00eda&#8217;s case is notable due to complications arising from his deportation to El Salvador in March,despite a federal judge&#8217;s order to prevent his removal over concerns for his safety. A judge in 2019 found there was sufficient evidence to support&nbsp;the claim that &Aacute;brego Garc&iacute;a was a member of MS-13, and a separate judge later upheld that finding.<\/p>\n<p>&Aacute;brego Garc&iacute;a remains in&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-justice\" target=\"_blank\" rel=\"noreferrer noopener\">federal custody<\/a>&nbsp;in Nashville, Tennessee, and is set to appear in court on July 16 for a hearing on his detention and case schedule.<\/p>\n<p>His prosecution has drawn national scrutiny after&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\" target=\"_blank\" rel=\"noreferrer noopener\">Immigration and Customs Enforcement<\/a>&nbsp;deported him to El Salvador from Maryland in March. This was despite a federal immigration judge&rsquo;s limited 2019 order blocking his removal specifically to his country of origin, citing the defendant&rsquo;s fears of rival gangs at the time.<\/p>\n<p>Crenshaw&rsquo;s notice comes one day after <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3461628\/abrego-garcia-details-beatings-psychological-torture-cecot-salvadoran-prison\/\" target=\"_blank\" rel=\"noopener\" title=\"\">new court filings revealed<\/a> &Aacute;brego Garc&iacute;a allegedly suffered physical and psychological abuse during his time in El Salvador&rsquo;s Centro de Confinamiento del Terrorismo prison following his March deportation, according to his defense lawyers. His counsel described him as being beaten, sleep-deprived, and confined to overcrowded, windowless cells in the CECOT facility. He said he lost over 30 pounds in two weeks and was told by guards he would be placed with gang members who would &ldquo;tear&rdquo; him apart.<\/p>\n<p>&Aacute;brego Garc&iacute;a was returned to the United States in June, weeks after a&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;order found that the government should make efforts to &ldquo;facilitate&rdquo; his return.
