In 2022, shortly before he became heavily involved in the Republican Party, Musk <a href=\"https:\/\/x.com\/elonmusk\/status\/1527317718931677186\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> he didn&rsquo;t fully agree with either the Republican or Democratic parties.<\/p>\n<p>&ldquo;A party more moderate on all issues than either Reps or Dems would be ideal,&rdquo; Musk&nbsp;said.<\/p>\n<p>Musk&rsquo;s citizenship in<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/south-africa\/\" target=\"_blank\" rel=\"noopener\" title=\" South Africa\"> South Africa<\/a> and <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/canada\/\" target=\"_blank\" rel=\"noopener\" title=\"Canada\">Canada<\/a>, along with the United States, does not affect his legal ability to form or lead a political party. However, Musk cannot run for president because he is not a natural-born U.S. citizen.<\/p>\n<p>Regardless, experts believe Musk would face an uphill battle creating one.<\/p>\n<p>So, if he did decide to proceed with his plan, how would it work? And could it?<\/p>\n<h2 class=\"wp-block-heading\">Does Musk have enough financial power to do it?<\/h2>\n<p>Brett Kappel, a veteran election lawyer, told <a href=\"https:\/\/www.cbsnews.com\/news\/elon-musk-new-america-political-party-trump-feud-harder-than-it-sounds\/\" target=\"_blank\" rel=\"noopener\" title=\"CBS News\">CBS News<\/a> that creating a new party &ldquo;can be done if you have endless amounts of money,&rdquo; but it would be an expensive, long project.<\/p>\n<p>As of July 1, Musk&rsquo;s net worth is estimated to be $406.5 billion, according to the <a href=\"https:\/\/www.bloomberg.com\/billionaires\/profiles\/elon-r-musk\/\" target=\"_blank\" rel=\"noopener\" title=\"Bloomberg Billionaire Index\">Bloomberg Billionaires Index<\/a>. He also has access to resources from his companies, <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/tesla\/\" target=\"_blank\" rel=\"noopener\" title=\"Tesla\">Tesla<\/a> and <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/spacex\/\" target=\"_blank\" rel=\"noopener\" title=\"SpaceX\">SpaceX<\/a>, and ownership of X.<\/p>\n<p>Musk&rsquo;s financial status can&rsquo;t necessarily save him. Before political parties are formally recognized, they are organized as not-for-profit groups and do not have a limit on how much money can be put into them, according to Kappel.<\/p>\n<p>But if the party attained national recognition, Musk would be subject to the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/fec\/\" target=\"_blank\" rel=\"noopener\" title=\"Federal Election Commission\">Federal Election Commission<\/a>&lsquo;s cap on political contributions, which <a href=\"https:\/\/www.fec.gov\/help-candidates-and-committees\/making-independent-expenditures\/\" target=\"_blank\" rel=\"noopener\" title=\"\">would only allow him<\/a> to give $10,000 a year to a state political party or $44,300 to a national committee.<\/p>\n<p>Musk could use his <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/presidential\/3162649\/elon-musk-super-pac-website-swing-states\/\" target=\"_blank\" rel=\"noopener\" title=\"America PAC\">America PAC<\/a>, the super PAC that allowed him to donate unlimited sums of money to the Trump campaign. The caveat, though, is that the PAC would need to remain <a href=\"https:\/\/www.fec.gov\/help-candidates-and-committees\/making-independent-expenditures\/\" target=\"_blank\" rel=\"noopener\" title=\"America PAC\">independent<\/a> from candidates or political parties, making it infeasible for Musk to donate to the party he founded.<\/p>\n<h2 class=\"wp-block-heading\">Would people vote for the &lsquo;America Party&rsquo;?<\/h2>\n<p>Luckily for Musk, the share of registered voters unaffiliated with either major party has grown 9% since 2000, according to <a href=\"https:\/\/ballotpedia.org\/Partisan_affiliations_of_registered_voters\" target=\"_blank\" rel=\"noopener\" title=\"Ballotpedia\">Ballotpedia<\/a>. Thirty-seven percent of voters recognize themselves as Democrats, while 31% identify as Republicans.<\/p>\n<p>Musk, who was heavily involved in the early stages of the Trump administration, as a<a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3310178\/elon-musk-shielded-by-ethics-loophole-special-government-employee\/\" target=\"_blank\" rel=\"noopener\" title=\" special government employee\"> special government employee<\/a> at the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3228342\/department-of-government-efficiency-what-to-know\/\" target=\"_blank\" rel=\"noopener\" title=\" special government employee\">Department of Government Efficiency<\/a> who aided Trump and other Republican candidates during the 2024 election, might have an &ldquo;in&rdquo; with adding a new third party to the ballots.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><figcaption class=\"wp-element-caption\">President Donald Trump speaks during a news conference with Elon Musk in the Oval Office of the White House, Friday, May 30, 2025, in Washington. (AP Photo\/Evan Vucci)<\/figcaption><\/figure>\n<\/div>\n<p>In Musk&rsquo;s posts from Monday, he <a href=\"https:\/\/x.com\/elonmusk\/status\/1939769910156304866?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1939769910156304866%7Ctwgr%5Ef82f659787563aaae93024d1dd04513a24f2b5e2%7Ctwcon%5Es1_c10&amp;ref_url=https%3A%2F%2Fwww.washingtonexaminer.com%2Fnews%2Fwhite-house%2F3460092%2Ftrump-musk-spacex-tesla-government-contracts-big-beautiful-bill%2F\" target=\"_blank\" rel=\"noopener\" title=\"claimed\">claimed<\/a> there needs to be a political party that &ldquo;cares about the people.&rdquo; A new <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3458113\/national-pride-poll-gallup-increasingly-split-party-lines\/\" target=\"_blank\" rel=\"noopener\" title=\"Gallup Poll\">Gallup poll<\/a> revealed that national pride has decreased in younger generations, coinciding with the debate that the government doesn&rsquo;t care about the people.<\/p>\n<p>Additionally, only 64% of Generation Z Republicans claim they are &ldquo;extremely&rdquo; or &ldquo;very proud&rdquo; to be American.<\/p>\n<p>However, among political <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/independents\/\" target=\"_blank\" rel=\"noopener\" title=\"independents\">independents<\/a>, 57% view Musk unfavorably, and only 29% view him favorably, significantly lower than Trump&rsquo;s ratings, according to a<a href=\"https:\/\/poll.qu.edu\/poll-release?releaseid=3924\" target=\"_blank\" rel=\"noopener\" title=\" Quinnipiac University poll\"> Quinnipiac University poll<\/a> of registered voters conducted last month.<\/p>\n<p>Independents have been elected to <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Congress\/?gad_source=1&amp;gad_campaignid=22705961921&amp;gbraid=0AAAAAD8dCuwSOMK1tmWSxwUUffFV1jqhZ&amp;gclid=CjwKCAjwsZPDBhBWEiwADuO6yzIYmpshWqtQvcR-LZACBkePTwj__0iTSQduo2LY0lggWJ6Y9CpMChoCtGsQAvD_BwE\" target=\"_blank\" rel=\"noopener\" title=\"Congress\">Congress<\/a>, but no third-party candidate has ever been elected president, due to the major parties regularly <a href=\"https:\/\/www.reuters.com\/world\/us\/how-us-states-make-it-tough-third-parties-elections-2024-01-18\/\" target=\"_blank\" rel=\"noopener\" title=\"changing state laws\">changing state laws<\/a> or taking other steps to prevent third parties from receiving a spot on the ballot.<\/p>\n<h2 class=\"wp-block-heading\">How would Musk navigate state laws and national rules?<\/h2>\n<p>Major third parties, such as the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/green-party\/\" target=\"_blank\" rel=\"noopener\" title=\"Green Party \">Green Party <\/a>or the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/libertarian-party\/\" target=\"_blank\" rel=\"noopener\" title=\"Libertarian Party\">Libertarian Party<\/a>, were founded decades ago yet still face state-by-state pushback for ballot access and party recognition.<\/p>\n<p>Each state has different legal rules for recognizing which political parties can appear on the ballot. According to Kappel, those hurdles &ldquo;range from high to extraordinarily difficult to overcome.&rdquo; In rare cases, a developing political party may need to receive a certain number of signatures and then win a significant percentage of the vote across election cycles to appear on the ballot.<\/p>\n<p>In the 2020 election, rapper <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1283795\/kanye-west-says-hes-running-for-president\/\" target=\"_blank\" rel=\"noopener\" title=\"Kanye West ran for President\">Kanye West ran for president<\/a> and attempted to affiliate himself with a third party, the &ldquo;Birthday Party.&rdquo; He also received<a href=\"https:\/\/www.forbes.com\/sites\/randalllane\/2020\/07\/08\/kanye-west-says-hes-done-with-trump-opens-up-about-white-house-bid-damaging-biden-and-everything-in-between\/\" target=\"_blank\" rel=\"noopener\" title=\" guidance from Musk\"> guidance from Musk<\/a>. Despite his name recognition and penchant for making headlines, West only appeared on ballots in 12 states. States with different laws ruled that he could not appear on their ballots, leading him to receive only <a href=\"https:\/\/ballotpedia.org\/Ye_(Kanye_West)\" target=\"_blank\" rel=\"noopener\" title=\"67,906 votes\">67,906 votes<\/a>, not even making a percentage of the total votes cast in 2020.<\/p>\n<p>In other states, like <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/california\/\" target=\"_blank\" rel=\"noopener\" title=\"California\">California<\/a>, a new political party needs to sign up 0.33% of state voters, about 75,000 people, as registered members, or submit 1.1 million signatures from voters. Afterward, the party would need to maintain a .33% registration threshold, or win at least 2% of the statewide race.<\/p>\n<p>To gain national recognition, a state-level political party would need to seek an advisory opinion from the FEC, and Musk would most likely face intense criticism from the Democratic and Republican parties, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/we-the-people-stays-on-north-carolina-ballot-after-injunction-denied-washington-examiner\/\" title=\"We The People stays on North Carolina ... after injunction denied - Washington Examiner\">including legal challenges<\/a> over signatures in each state. CAN HE DO THAT?<\/strong><\/a><\/p>\n<p id=\"anchor-b1c960\">Third parties that have succeeded in reaching their goals usually disappear within 10 years, according to Tamas.<\/p>\n<p id=\"anchor-3d96cb\">&ldquo;What you&rsquo;re doing as a third party is you&rsquo;re supposed to be causing pain,&rdquo; he said. &ldquo;You&rsquo;re supposed to hurt them and hurt them by causing them to lose seats or lose elections, and then, once they lose, the hope is they co-opt whatever the third party is selling.
