This new legal approach allows them to seek broad relief for a specific class of individuals affected by the executive order terminating birthright citizenship. Advocates argue that without such a suit, many children of undocumented immigrants would be denied their constitutional rights. While the original criticism of the Supreme Court’s decision highlighted concerns over potential inconsistencies in legal interpretations across various jurisdictions, the advocates remain committed to fighting for birthright citizenship protections.

The illegal alien rights groups that sued the Trump administration to block the president’s executive order ending birthright citizenship immediately refiled their suit Friday after the Supreme Court ruled against them, but with one twist.

The refiling of the suit in a Maryland court by CASA Inc., the Asylum Seeker Advocacy Project, and a number of expectant illegal alien mothers came after the Supreme Court ruled that lower-court judges may not impose nationwide injunctions on such matters.

The “new” The new filing in a Maryland court by CASA Inc., the Asylum Seeker Advocacy Project, and several expectant undocumented mothers came after the Supreme Court determined that lower courts cannot issue nationwide injunctions on such issues. Consequently, this “new” lawsuit was submitted as a class action in line with the high court’s ruling, which indicated that class action lawsuits could serve as an alternative legal avenue for broader challenges to an executive order. Essentially, while plaintiffs can no longer seek nationwide injunctions due to the Supreme Court’s decision, they can still effectively challenge a law across the country through a class action suit.

CASA Inc. is now requesting an emergency block on Trump’s policy from a federal judge and has reformulated its broader lawsuit as a class action case. The refiled lawsuit states that without such an injunction, many babies within this group would be denied their constitutional right to U.S. citizenship and all associated rights and privileges.
