\t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>The Trump administration subsequently fought back by repeatedly arguing that it <a href=\"https:\/\/www.westernjournal.com\/karoline-leavitt-points-problem-judge-orders-return-immigrant-locked-el-salvador-prison\/\" target=\"_blank\" rel=\"noopener\">no longer had jurisdiction<\/a> over Abrego Garcia, as he was in El Salvador.<\/p>\n<p>But then in early June, the administration suddenly <a href=\"https:\/\/www.westernjournal.com\/maryland-man-officially-back-states-just-1-major-catch\/\" target=\"_blank\" rel=\"noopener\">found a way<\/a> to return the &ldquo;Maryland dad&rdquo; to the states to face criminal charges.<\/p>\n<p>This &mdash; his sudden return&ndash; was what triggered the June 11 <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.195.0.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a>.<\/p>\n<p>&ldquo;While the Government was telling this Court one thing and the world something else, it was secretly working to charge Abrego Garcia with two <a href=\"https:\/\/amzn.to\/3YuVZYV\" >felony immigration charges based<\/a> on alleged conduct that occurred years ago,&rdquo; the complaint read.<\/p>\n<p>&ldquo;Although Attorney General Bondi declined, when asked by reporters, to state when the criminal investigation began, public reporting indicates that it started in April &mdash; around the same time that this Court ordered expedited discovery into the Government&rsquo;s apparent defiance of Court orders,&rdquo; the complaint continued.<\/p>\n<p>The premise was that the Trump administration could have returned Abrego Garcia from day one but purposefully refused to, so they could first <a href=\"https:\/\/www.westernjournal.com\/watch-bodycam-maryland-mans-suspected-human-trafficking-stop-finally-released\/\" target=\"_blank\" rel=\"noopener\">build a case<\/a> against him.<\/p>\n<p>&ldquo;The Government&rsquo;s defiance has not been subtle,&rdquo; the attorneys wrote. &ldquo;It has been vocal and sustained and flagrant.&rdquo;<\/p>\n<p>The complaint also included a snippet from a <a href=\"https:\/\/www.nytimes.com\/2025\/05\/21\/us\/politics\/trump-abrego-garcia-el-salvador-deportation.html\" target=\"_blank\" rel=\"noopener\">New York Times<\/a> report published in May.<\/p>\n<blockquote class=\"twitter-tweet\" data-conversation=\"none\">\n<p dir=\"ltr\" lang=\"en\">But the real smoking guns are alleged responses of, for instance, DHS atty Joseph Mazzara, who filed a declaration &amp; was deposed in the case.
