The decision overturned a prior ruling from the 4th Circuit, which had sided with Planned parenthood, asserting that South Carolina violated residents&#8217; civil rights by excluding the institution from Medicaid funding. <\/p>\n<p>The state&#8217;s governor, Henry McMaster, argued that funds should be redirected to healthcare facilities offering more comprehensive services, rather than abortion-related services. The high court&#8217;s majority opinion, written by Justice Neil Gorsuch, concluded that the law cited by Planned Parenthood does not grant individual rights necessary for the organization to challenge the state&#8217;s funding decisions. <\/p>\n<p>Justices Ketanji Brown Jackson, Sonia Sotomayor, and Elena Kagan dissented, arguing that the statute implied the existence of such rights. The case will return to lower courts for further proceedings, but for now, South Carolina can pursue its aim of cutting off federal funds to Planned Parenthood.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court rejected a challenge from Planned Parenthood to a South Carolina executive order that redirected federal funding from the abortion giant. The 6-3 decision along ideological lines effectively paves the way for pro-life states to protect their taxpayers from bankrolling abortion facilities.<\/p>\n<p>The high bench&rsquo;s<em> Medina v. Planned Parenthood South Atlantic <\/em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-1275_e2pg.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> ultimately reversed a decision from the 4th Circuit, which agreed with a district court that South Carolina violated state residents&rsquo; civil rights by excluding Planned Parenthood from a list of healthcare providers.<\/p>\n<p>At South Carolina Gov. Henry McMaster&rsquo;s direction, the Palmetto State<a href=\"https:\/\/thefederalist.com\/2025\/03\/31\/scotus-could-stop-medicaid-dollars-from-funding-planned-parenthood\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;sought to redirect Medicaid funds<\/a> that would normally end up in Planned Parenthood&rsquo;s pockets to the <a href=\"https:\/\/thefederalist.com\/2025\/05\/07\/report-health-centers-that-care-for-women-outnumber-planned-parenthood-by-15-to-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">plethora of facilities<\/a> focused on more comprehensive healthcare than ending life in the womb.<\/p>\n<p>The nation&rsquo;s largest abortion business sued in an attempt to save <a href=\"https:\/\/thefederalist.com\/2025\/03\/11\/congress-has-a-chance-to-defund-planned-parenthood-heres-why-the-gop-should-take-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">its flow of federal tax dollars<\/a>, which no doubt contributes to Planned Parenthood&rsquo;s quest to end unborn lives,&nbsp;<a href=\"https:\/\/www.heritage.org\/gender\/commentary\/dont-defend-planned-parenthoods-gender-affirming-care-defund-it\" target=\"_blank\" rel=\"noreferrer noopener\">dispense castrating drugs<\/a>&nbsp;to kids, reportedly&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/11\/22\/report-planned-parenthood-caught-selling-viable-fetuses-to-university-of-california-san-diego\/\" target=\"_blank\" rel=\"noreferrer noopener\">traffic baby<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2020\/04\/15\/new-unsealed-documents-show-planned-parenthood-profited-from-aborted-baby-body-parts\/\" target=\"_blank\" rel=\"noreferrer noopener\">body parts,<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2022\/07\/20\/want-to-know-who-is-really-empowered-by-abortion-sex-traffickers-and-abusers\/\" target=\"_blank\" rel=\"noreferrer noopener\">enable abusers<\/a>,&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/florida-investigation-of-planned-parenthood-clinics-finds-deficiencies-1438817376\" target=\"_blank\" rel=\"noreferrer noopener\">allegedly perform unlicensed<\/a>&nbsp;<a href=\"https:\/\/www.lifenews.com\/2016\/01\/29\/planned-parenthood-breaks-state-law-to-open-unlicensed-abortion-clinic-in-kentucky\/\" target=\"_blank\" rel=\"noreferrer noopener\">procedures,<\/a> violate&nbsp;<a href=\"https:\/\/6abc.com\/archive\/9059172\/\" target=\"_blank\" rel=\"noreferrer noopener\">health<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/02\/15\/us\/planned-parenthood-clinics.html\" target=\"_blank\" rel=\"noreferrer noopener\">safety standards<\/a>,&nbsp;<a href=\"https:\/\/www.stlpr.org\/politics-issues\/2018-02-23\/protest-buffer-zone-at-st-louis-planned-parenthood-narrowly-earns-first-round-approval#stream\/0\" target=\"_blank\" rel=\"noreferrer noopener\">oppose free speech<\/a>, and risk&nbsp;<a href=\"https:\/\/www.lifenews.com\/2012\/10\/09\/deaths-at-planned-parenthood-show-no-concern-for-women\/\" target=\"_blank\" rel=\"noreferrer noopener\">mothers&rsquo; lives in the process<\/a>.<\/p>\n<p>Planned Parenthood&rsquo;s representation tried to claim <a href=\"https:\/\/thefederalist.com\/2025\/04\/02\/u-s-supreme-court-hears-south-carolinas-defense-for-defunding-planned-parenthood\/\" target=\"_blank\" rel=\"noreferrer noopener\">during oral arguments in April<\/a> that Medicaid recipients have the&nbsp;same &ldquo;individual dignity and individual economy&rdquo; as those who are privately insured and can choose who treats them.<\/p>\n<p>South Carolina&rsquo;s legal team, <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23-1275.html\" target=\"_blank\" rel=\"noreferrer noopener\">backed by<\/a>&nbsp;<a href=\"https:\/\/adfmedia.org\/press-release\/us-govt-18-states-rally-support-south-carolina-diverting-medicaid-funds-planned\/\" target=\"_blank\" rel=\"noreferrer noopener\">18 states<\/a>, the federal government, several members of Congress, practicing South Carolina medical practitioners, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americans-remember-the-48th-annual-march-for-life\/\" title=\"Americans remember the 48th annual March for Life\">pro-life activists<\/a>, countered by noting that private insurance companies determine which doctors are within the network. As a result, they argued to the court that South Carolina &ldquo;should be free&rdquo; to honor a&nbsp;<a href=\"https:\/\/www.kofc.org\/en\/resources\/communications\/polls\/2023-kofc-marist-poll-cross-tabs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">majority of Americans&rsquo; opposition to taxpayer-funded abortions<\/a>&nbsp;by choosing which providers get those hard-earned dollars.<\/p>\n<p>Justice Ketanji Brown Jackson, joined by Justices Sonia Sotomayor and Elena Kagan, penned a dissenting opinion claiming the statute in question is&ldquo;compulsory,&rdquo; has &ldquo;individual centric terminology,&rdquo; and uses &ldquo;language classically associated with establishing rights.&rdquo;<\/p>\n<p>Justice Neil Gorsuch argued in the majority opinion, however, that the section Planned Parenthood tried to wield against South Carolina &ldquo;does not clearly and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >unambiguously confer individual rights&#038;rdquo<\/a>; required to sue the state for its use of Medicaid funds.  <\/p>\n<p>He noted that while Congress &ldquo;knows how to give a grantee clear and unambiguous notice that, if it accepts federal funds, it may face private suits asserting an individual right to choose a medical provider,&rdquo; it did not for the particular law Planned Parenthood tried to use against South Carolina.<\/p>\n<p>&ldquo;Deciding whether to permit <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-grants-temporary-restraining-order-partially-blocking-texas-heartbeat-act\/\" title=\"Judge Grants Temporary Restraining Order Partially Blocking Texas Heartbeat Act\">private enforcement<\/a> poses delicate policy questions involving competing costs and benefits &mdash; decisions for elected representatives, not judges,&rdquo; the ruling syllabus stated.<\/p>\n<p>Gorsuch agreed, writing that &ldquo;private enforcement does not always benefit the public&rdquo; because it forces states to &ldquo;divert money and attention away from social services and toward litigation.&rdquo;<\/p>\n<p>&ldquo;And balancing those costs and benefits poses a question of public policy that, under our system of government, only Congress may answer,&rdquo; Gorsuch determined. <\/p>\n<p>SCOTUS&rsquo; conclusion officially sends the case back to the lower courts for further action. In the meantime, South Carolina is free to move forward with plans to make Planned Parenthood <a href=\"https:\/\/x.com\/StudentsforLife\/status\/1938241253381996714\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;go fund themselves&rdquo;<\/a> instead of using Medicaid dollars to fuel its&nbsp;<a href=\"https:\/\/lozierinstitute.org\/fact-sheet-planned-parenthoods-2022-23-annual-report\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion obsession<\/a>.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
