In a 6-3 decision, the Court stayed an injunction issued by a Biden-appointed judge aimed at blocking this policy, which requires migrants to be held in U.S. custody if their deportations involve countries not specifically named in their removal orders. The temporary stay will remain in effect while the appeal is considered by the U.S. Court of Appeals for the First Circuit. As <a href=\"https:\/\/www.foxnews.com\/politics\/supreme-court-rules-trumps-third-country-deportations-south-sudan-other\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> by Fox News, the order, which was issued by Biden-appointed District Court Judge Brian Murphy, directed the Trump administration&nbsp;&ldquo;to keep in U.S. custody&nbsp;all migrants slated for deportation to a country not &lsquo;explicitly&rsquo; named in their removal orders &ndash; known as a third-country deportation.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-770216054\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>According to Friday&rsquo;s order, the temporary stay on the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >lower court injunction<\/a> will remain in place &ldquo;pending the disposition of the appeal in the United States Court of Appeals for the First Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought.&rdquo; The stay will terminate if a potential petition from the government to SCOTUS is denied by the high court or if SCOTUS agrees to consider the matter and hands down a judgement in the case.<\/p>\n<p>Associate Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson would not have granted the administration&rsquo;s request to temporarily pause Murphy&rsquo;s order. The Court&rsquo;s majority did not provide an explanation for its decision.<\/p>\n<p>In her dissenting opinion, in which Kagan and Jackson joined, Sotomayor claimed the Trump administration did not &ldquo;proceed with caution&rdquo; in the matter and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-pentagon-delayed-guard-deployment-on-jan-6\/\" title=\"Exclusive: Pentagon Delayed Guard Deployment On Jan. 6\">accused federal officials<\/a> of &ldquo;violati[ng] &hellip; a court order&rdquo; when they purportedly &ldquo;deported six more [illegal aliens] to South Sudan, a nation the State Department considers too unsafe for all but its most critical personnel.&rdquo; She further chastised her colleagues in the majority for their decision to grant the administration&rsquo;s application.<\/p>\n<p>&ldquo;Apparently, the Court finds the idea that thousands will suffer violence in farflung locales more palatable than the remote possibility that a District Court exceeded its remedial powers when it ordered the Government to provide notice and process to which the plaintiffs are constitutionally and statutorily entitled,&rdquo; Sotomayor wrote. &ldquo;That use of discretion is as incomprehensible as it is inexcusable.
