U.S. Magistrate Judge Barbara Holmes stated that the Department of Justice failed to prove that Abrego poses a significant danger to the community or is unlikely to appear for his trial. The ruling allows for conditions of release to ensure community safety and Abrego&#8217;s appearance in court. The Trump administration previously sought to keep him detained, alleging risks of flight and witness tampering. Abrego was wrongfully deported by the Trump administration in March and later returned to the U.S. in June to face charges related to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/abrego-garcia-pleads-not-guilty-to-human-smuggling-charges-washington-examiner\/\" title=\"... pleads not guilty to ... - Washington Examiner\">trafficking illegal migrants<\/a>. Abrego has pleaded not guilty to these charges. Max Miller &#8216;run off the road&#8217; by person with Palestinian flag<\/a><\/li>\n<li><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3449014\/judge-orders-release-of-mahmoud-khalil-ice-facility\/\">Judge orders release of Mahmoud Khalil from ICE facility<\/a><\/li>\n<\/ul>\n<\/div>\n<div class=\"article-paywall\">\n<p>&ldquo;Rather, the Court finds that it can impose conditions of release to reasonably assure the safety of others and the community and Abrego&rsquo;s appearance,&rdquo; the ruling said.<\/p>\n<p>Holmes added that a separate hearing will be scheduled to specify what those conditions for Abrego Garcia&rsquo;s release ultimately are, as he awaits trial for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/syrian-men-among-human-smugglers-apprehended-through-operation-lone-star\/\" title=\"Syrian men caught as human smugglers in Operation Lone Star\">federal human smuggling charges<\/a>.<\/p>\n<p>The ruling is a blow to the Trump DOJ, which <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3435710\/trump-doj-detained-kilmar-abrego-garcia-trial-pending\/\" target=\"_blank\" rel=\"noopener\" title=\"sought\">sought<\/a> to keep Abrego Garcia behind bars until the trial, arguing there is &ldquo;serious risk&rdquo; that the&nbsp;Salvadoran&nbsp;national will flee the country, obstruct justice, or endanger witnesses.<\/p>\n<p>Abrego Garcia <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3441213\/abrego-garcia-pleads-not-guilty-to-human-smuggling-charges\/\" target=\"_blank\" rel=\"noopener\" title=\"faces\">faces<\/a> two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jury-in-gov-whitmer-kidnapping-case-deadlocked-on-some-counts\/\" title=\"Jury in Gov. He pleaded not guilty to those charges just over a week ago.<\/p>\n<p><strong><a href=\"http:\/\/washingtonexaminer.com\" target=\"_blank\" rel=\"noopener\" title=\"\"><\/a><\/strong><\/p>\n<p>The Trump administration deported Abrego Garcia without a hearing in March to El Salvador&rsquo;s notorious megaprison, the Terrorism Confinement Center.
