The lawsuit argues that the CVA violates the supremacy clause of the U.S. Constitution by obstructing local law enforcement&#8217;s ability to cooperate wiht federal immigration authorities. The DOJ described the CVA as &#8220;unlawful&#8221; in a recent 36-page statement and urged a federal judge to favor Huntington Beach&#8217;s challenge. The law has been criticized for allegedly forcing Immigration and Customs Enforcement (ICE) to conduct arrests in public areas, possibly jeopardizing public safety. But DOJ lawyers said the federal government has a &ldquo;substantial interest&rdquo; in ensuring federal immigration laws are enforced without obstruction.<\/p>\n<p>Huntington Beach officials passed a resolution declaring the city a &ldquo;non-sanctuary&rdquo; jurisdiction in January before suing California over the CVA in March. America First Legal, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cbs-sued-by-seal-team-writer-who-claims-heterosexual-white-men-need-extra-qualifications\/\" title=\"CBS faces ...suit by &#039;SEAL Team&#039; writer alleging bias against heterosexual, white men\">conservative legal group founded<\/a> by President Donald Trump&rsquo;s deputy chief of staff Stephen Miller, is representing both the city and Bianco.<\/p>\n<p>In a&nbsp;<a href=\"https:\/\/aflegal.org\/department-of-justice-files-brief-supporting-america-first-legals-challenge-to-californias-illegal-sanctuary-laws\/\" target=\"_blank\" rel=\"noopener\" title=\"\">press release<\/a>, AFL said the DOJ&rsquo;s support reinforces its position that the CVA unlawfully discriminates against federal agents and prevents basic cooperation &mdash; including information sharing and ICE detainers.<\/p>\n<p>&ldquo;We are grateful for the federal government&rsquo;s support for America First Legal and the plaintiffs in this case in their fight against California&rsquo;s illegal sanctuary laws,&rdquo; said James Rogers, senior counsel at AFL.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/lawsuits\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;also targets <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/gavin-newsom\" target=\"_blank\" rel=\"noreferrer noopener\">Gov. Gavin Newsom<\/a> (D-CA)&nbsp;and&nbsp;Attorney General Rob Bonta, claiming that California is illegally shielding criminal aliens in violation of both federal law and state penal codes.<\/p>\n<p>California&rsquo;s attorney general&rsquo;s office has moved to dismiss the case, arguing the state has every right to prioritize public safety and community trust over federal immigration priorities.<\/p>\n<p>&ldquo;Instead of focusing on this vital responsibility, Huntington Beach is attempting to relitigate settled law in a misguided attempt to divert its limited resources to federal immigration enforcement,&rdquo; Bonta said earlier this month. A hearing on the motion to dismiss is scheduled for August.<\/p>\n<p><strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3442546\/trump-announces-expansion-ice-raids-sanctuary-cities\/\" target=\"_blank\" rel=\"noopener\" title=\"TRUMP ANNOUNCES EXPANSION OF ICE RAIDS IN SANCTUARY CITIES\">TRUMP ANNOUNCES EXPANSION OF ICE RAIDS IN SANCTUARY CITIES<\/a><\/span><\/strong><\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Trump administration<\/a>&nbsp;has taken similar actions in recent months, filing lawsuits against sanctuary-style policies in&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a>,&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/chicago\" target=\"_blank\" rel=\"noreferrer noopener\">Chicago<\/a>, and&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/denver\" target=\"_blank\" rel=\"noreferrer noopener\">Denver<\/a>.<\/p>\n<p>This move also aligns with a broader pattern of DOJ involvement in lawsuits brought by right-leaning legal groups.
