The ruling has been celebrated by conservatives as a significant victory against what they perceive as judicial overreach in matters involving children’s medical care and gender identity. The dissent by the three liberal justices, who argued that the law does discriminate based on sex and harms transgender youth, underscores the contentious nature of the issue. Supporters of the ruling praised the decision as a step towards protecting children from what they view as harmful medical practices.

When they refuse to engage in judicial activism and instead merely interpret the Constitution, courts tend to get things right.

Thankfully, in this instance the Supreme Court did both.

On Wednesday, SCOTUS ruled 6-3 that a Tennessee ban on transgender procedures for minors, including hormones and puberty blockers, did not violate the Fourteenth Amendment’s Equal Protection Clause, thereby triggering a celebration among conservatives on the social media platform X, one of whom hailed the ruling as “a major victory.”

Chief Justice John Roberts wrote the Opinion of the Court.

“This case carries with it the weight of fierce scientific and policy debates about the safety, efficacy, and propriety of medical treatments in an evolving field. Fortunately, the Supreme Court did just that in this case. On Wednesday, SCOTUS ruled 6-3 that Tennessee’s prohibition on transgender treatments for minors, including hormones and puberty blockers, did not breach the Equal Protection Clause of the Fourteenth Amendment. This decision sparked celebrations among conservatives on social media, with one user calling it “a major victory.” Chief Justice John Roberts authored the Court’s opinion, stating that this case is burdened by intense scientific and policy debates regarding medical treatments in a rapidly changing field. He noted that while these discussions raise valid concerns with significant implications for everyone involved, they do not resolve under the Equal Protection Clause.

Roberts emphasized that judges must exercise restraint and should not impose their own views on legal matters but instead ensure laws comply with constitutional protections. He concluded that since the law does not violate equal protection rights, questions about its policy implications should be left to citizens and their elected officials.

In essence, states have the authority to prohibit child mutilation without judicial interference. Justices Alito, Thomas, Gorsuch, Kavanaugh, and Barrett agreed with this judgment while Justices Sotomayor, Jackson, and Kagan dissented. Sotomayor argued against Tennessee’s law based on claims of sex discrimination and expressed concern over potential harm to transgender children.

The dissent highlights a significant divide between liberal justices who prioritize individual judgments over state decisions versus a conservative majority upholding constitutional principles. Despite dissenting opinions reflecting modern liberalism’s moral decline-where personal beliefs overshadow public will-the 6-3 ruling is celebrated as a victory for conservatives advocating for children’s protection from harmful medical interventions

[33651
36794,32275,35159
post-2448938","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-the-western-journal","tag-legal-ruling","tag-supreme-court","tag-transgender-rights
["GET
