Ducks Emergency Appeal in Tennessee Abortion Case\">federal appellate court<\/a> declares a lawsuit contesting the Naval Academy&#8217;s previous affirmative action policies as moot. This action follows a directive signed by Defense Secretary Pete Hegseth, which prohibits military schools from considering race or sex during the admissions process. The joint filing seeks to dismiss SFFA&#8217;s appeal regarding a lower court&#8217;s decision that previously rejected their challenge based on the changes in admissions policy. The administration now affirms that the Naval Academy no longer incorporates race or ethnicity in it&#8217;s admissions criteria, nor does it aim to mirror the racial demographics of the Navy or Marine Corps. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/05\/12\/hegseth-orders-return-to-merit-based-admissions-policies-at-military-academies\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Defense Secretary Pete Hegseth signed a memo last month ordering the secretaries of the military to certify within 30 days that these schools &ldquo;[o]ffer admission based exclusively on merit,&rdquo; building upon a directive he issued in late January.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1791359617\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Citing the administration&rsquo;s policy change, the DOJ and SFFA requested<strong> <\/strong>the 4th Circuit Court of Appeals to dismiss SFFA&rsquo;s appeal of a lower court decision <a href=\"https:\/\/edition.cnn.com\/2024\/12\/06\/politics\/naval-academy-race-admissions\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">rejecting<\/a> their Biden-era challenge as moot. The parties further asked the appellate court to &ldquo;vacate the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-hands-texas-a-major-border-win-over-the-biden-administration\/\" title=\"Federal Appeals Court Hands Texas a Major Border Win Over the Biden ...\">district court&#038;rsquo<\/a>;s opinion and judgment, and remand with instructions to dismiss the case without prejudice.&rdquo;<\/p>\n<p>&ldquo;For the reasons set forth below, after conferring, the parties now agree that this case is moot,&rdquo; the filing reads.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/04\/09\/how-dei-left-service-academies-in-a-state-of-decay-and-how-trump-can-fix-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">How DEI Left Service Academies In A &lsquo;State Of Decay,&rsquo; And How Trump Can Fix It<\/a>]<\/strong><\/p>\n<p>The government party specifically went on to acknowledge that the Naval Academy &ldquo;changed its admissions policy so that race and ethnicity are no longer considered in any way at any point.&rdquo; It further argued that the school &ldquo;maintains no race- or ethnicity-based objective or goal, including any attempt to make the racial composition of the Academy&rsquo;s classes approximate the racial composition of the Navy or Marine Corps, those branches&rsquo; overall officer corps, or the U.S. population.&rdquo;<\/p>\n<p>In a statement to The Federalist, SFFA President Edward Blum said the joint filing &ldquo;is of enormous significance for our nation&rsquo;s military readiness.&rdquo; He also expressed hope that &ldquo;the U.S. Military and Air Force Academies will pursue the same legal outcome,&rdquo; seemingly referencing the SFFA&rsquo;s Biden-era <a href=\"https:\/\/studentsforfairadmissions.org\/students-for-fair-admissions-files-lawsuit-challenging-racial-and-ethnic-admissions-policies-at-west-point\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a> <a href=\"https:\/\/www.insidehighered.com\/news\/quick-takes\/2024\/12\/12\/anti-affirmative-action-group-sues-air-force-academy\" target=\"_blank\" rel=\"noreferrer noopener\">challenging<\/a> those academies&rsquo; past affirmative action policies. <\/p>\n<p>&ldquo;We applaud this extraordinary accomplishment by the President and the Department of Defense which restores the colorblind legal covenant that binds together our military institutions,&rdquo; Blum said. <\/p>\n<p>SFFA is the group that challenged the use of affirmative action in U.S. college admissions standards all the way to the Supreme Court several years ago. In a <a href=\"https:\/\/thefederalist.com\/2023\/06\/29\/scotus-rules-race-based-college-admissions-violate-the-14th-amendment-ending-affirmative-action\/\" target=\"_blank\" rel=\"noreferrer noopener\">6-3 ruling<\/a>, the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >high court effectively nullified universities&#038;rsquo<\/a>; use of such policies, declaring that to do so violates Americans&rsquo; 14th Amendment rights. <\/p>\n<p>That ruling did not pertain to U.S. military academies, however. <\/p>\n<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
