Women and racial minorities may receive a higher guarantee &mdash; as much as 95% of the outstanding principal &mdash; due to&nbsp;<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title7-section2008b&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"noreferrer noopener\">persisting DEI policies<\/a>, while white males may only get a guarantee of 90% of a loan&rsquo;s value under&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/03\/09\/2022-04858\/farm-loan-programs-direct-and-guaranteed-loan-changes-certified-mediation-program-and-guaranteed#:~:text=95%20Percent%20Guarantee,applicant%20or%20farmer.%E2%80%9D\" target=\"_blank\" rel=\"noreferrer noopener\">the standard plan<\/a>. A <a href=\"https:\/\/amzn.to\/3YuVZYV\" >lower guarantee means higher interest rates<\/a> and loan costs and lower overall loan amounts, WILL explains.<\/p>\n<p>Faust, a double amputee who milks 70 Holstein cows and farms 200 acres to feed his livestock, refinanced his dairy farm in August 2024 using the USDA&rsquo;s guaranteed loan program to obtain an $890,000 loan. He paid the required 1.5% of the loan cost, amounting to $12,015, but he was only granted a 90% guarantee, according to WILL.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3428233\/minority-farmers-disproportionately-subsidized-biden-usda-loans\/\" target=\"_blank\" rel=\"noopener\" title=\"\">MINORITY FARMERS DISPROPORTIONATELY SUBSIDIZED BY BIDEN-ERA USDA LOANS, DATA SHOW<\/a><\/strong><\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.fsa.usda.gov\/resources\/programs\/dairy-margin-coverage-program-dmc\" target=\"_blank\" rel=\"noreferrer noopener\">Dairy Margin Coverage (DMC) Program<\/a>, which is designed to protect dairy farms from fluctuations in milk prices,&nbsp;pays producers when the margin between the price of milk and the average feed cost falls below a certain coverage level. To participate in the program, USDA requires enrollees to pay an annual $100 administrative fee. However, all so-called <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:7%20section:9054%20edition:prelim)\" target=\"_blank\" rel=\"noopener\" title=\"\">&ldquo;socially disadvantaged farmers&rdquo;<\/a> are exempt from paying this fee, WILL says, yet the USDA charges white male farmers. USDA regulations&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-7\/part-1430\/section-1430.402#p-1430.402(Socially%20disadvantaged%20farmer%20or%20rancher)\" target=\"_blank\" rel=\"noreferrer noopener\">currently define<\/a>&nbsp;the &ldquo;socially disadvantaged&rdquo; to mean ethnic minorities and female farmers.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.nrcs.usda.gov\/programs-initiatives\/eqip-environmental-quality-incentives\" target=\"_blank\" rel=\"noreferrer noopener\">Environmental Quality Incentives Program<\/a> (EQIP), which incentivizes farmers to participate in conservation efforts, may award&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/16\/3839aa-2#:~:text=(4)Increased,otherwise%20applicable%20rate.\" target=\"_blank\" rel=\"noreferrer noopener\">up to 90% of project costs<\/a>&nbsp;associated with planning, design, materials, equipment, installation, labor, management, maintenance, and training to&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-7\/subtitle-B\/chapter-XIV\/subchapter-B\/part-1466\/subpart-A\/section-1466.3#:~:text=or%20State%20government.-,Socially%20disadvantaged%20farmer%20or%20rancher,in%20the%20business%20entity%20must%20be%20held%20by%20socially%20disadvantaged%20individuals.,-Soil%20remediation\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;socially disadvantaged farmers.&rdquo;<\/a><\/p>\n<p>White males, meanwhile, are only entitled to a 75% reimbursement rate, WILL says, including Faust, who has entered a contract with an engineering firm to install a manure storage system on his farm. Faust intends to apply for financial assistance from EQIP, according to WILL, but is not eligible for the same amount of aid as <a href=\"https:\/\/www.ecfr.gov\/current\/title-7\/subtitle-B\/chapter-XIV\/subchapter-B\/part-1466\/subpart-A\/section-1466.3#:~:text=or%20State%20government.-,Socially%20disadvantaged%20farmer%20or%20rancher,in%20the%20business%20entity%20must%20be%20held%20by%20socially%20disadvantaged%20individuals.,-Soil%20remediation\" target=\"_blank\" rel=\"noopener\" title=\"\">&ldquo;group[s] whose members have been subjected to racial or ethnic prejudices.&rdquo;<\/a><\/p>\n<p>In <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2025\/04\/Faust-Letter-FINAL-2.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">an April letter<\/a> threatening litigation, WILL had warned Rollins about the lingering racial and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/usda-accused-of-still-discriminating-against-white-farmers\/\" title=\"... accused of still discriminating against ...\">sex-specific preferences found<\/a> within these three USDA programs, giving her 60 days to make reforms. A month later, in support of WILL&rsquo;s demands, all five Republican members of Wisconsin&rsquo;s congressional delegation wrote <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2025\/05\/WI-Del-letter-on-Discrimination-in-USDA-Programs.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">a letter<\/a> calling on the USDA to investigate and end the racially discriminatory practices.<\/p>\n<p>&ldquo;We&rsquo;ve been patient, but equality cannot wait,&rdquo; WILL deputy legal counsel Dan Lennington said in <a href=\"https:\/\/will-law.org\/will-sues-trump-administration-over-discriminatory-usda-farmer-program\/\" target=\"_blank\" rel=\"noopener\" title=\"\">an announcement<\/a> of this week&rsquo;s legal action following &ldquo;no meaningful response&rdquo; from Rollins.&nbsp;&ldquo;While President Trump has been perfectly clear that racial discrimination has no place in his Administration, USDA remains a notable hold out.&rdquo;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/3426279\/usda-still-discriminating-against-white-farmers-watchdog-says\/\" target=\"_blank\" rel=\"noreferrer noopener\">USDA STILL DISCRIMINATING AGAINST WHITE FARMERS, WATCHDOG SAYS<\/a><\/strong><\/p>\n<p>&ldquo;The USDA should honor the President&rsquo;s promise to the American people to end racial discrimination in the federal government,&rdquo; WILL&rsquo;s client, Faust, added. &ldquo;After being ignored by a federal agency that&rsquo;s meant to support agriculture, I hope my lawsuit brings answers, accountability, and results from the USDA.&rdquo;<\/p>\n<p>WILL is seeking a judgment declaring the USDA policies unconstitutional and an injunction blocking their continued implementation.<\/p>\n<p>Rollins had issued&nbsp;<a href=\"https:\/\/www.usda.gov\/directives\/sm-1078-001\" target=\"_blank\" rel=\"noreferrer noopener\">a Day One directive<\/a>&nbsp;rescinding all of her department&rsquo;s DEI programs and announcing that the USDA is instead prioritizing equality, meritocracy, and color-blind policies. Since the start of President Donald Trump&rsquo;s second term, the USDA has been comprehensively reviewing DEI programming in an effort to reverse the &ldquo;woke priorities of the Biden administration,&rdquo; the agency said in&nbsp;<a href=\"https:\/\/www.usda.gov\/about-usda\/news\/press-releases\/2025\/05\/01\/first-100-days-secretary-rollins-puts-farmers-first-reverses-woke-priorities-biden-administration\" target=\"_blank\" rel=\"noreferrer noopener\">a &ldquo;First 100 Days&rdquo; press release<\/a>.<\/p>\n<p>&ldquo;We appreciate the Trump Administration&rsquo;s strong stance against DEI, but Secretary Rollins must take the discrimination at USDA much more seriously,&rdquo; Lennington <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3426279\/usda-still-discriminating-against-white-farmers-watchdog-says\/\" target=\"_blank\" rel=\"noopener\" title=\"\">told<\/a> the <em>Washington Examiner<\/em> prior to the filing in federal court. (AP Photo\/Jacquelyn Martin)<\/figcaption><\/figure>\n<p>In a statement previously shared with the&nbsp;<em>Washington Examiner<\/em>, a USDA spokesperson said, &ldquo;Over the last four years, the Biden administration left USDA in complete disarray and disfunction and that&rsquo;s why farmers were being left behind.&rdquo;<\/p>\n<p>&ldquo;Unlike the Biden Administration, under President Trump, USDA does not discriminate and single out individual farmers based on race, sex, or political orientation,&rdquo; the spokesperson said. &ldquo;Secretary Rollins is working to reorient the department to be more effective at serving the American people and put farmers first.&rdquo;<\/p>\n<p><a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1319#:~:text=(Sec.%201005)%20This%20section%20provides%20funding%20for%20USDA%20to%20pay%20off%20outstanding%20farm%20loan%20debts%20of%20socially%20disadvantaged%20farmers%20and%20ranchers.\" target=\"_blank\" rel=\"noreferrer noopener\">A provision of the American Rescue Plan Act of 2021<\/a>, Biden&rsquo;s signature COVID-19 stimulus legislation, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minority-farmers-disproportionately-subsidized-by-biden-era-usda-loans\/\" title=\"... by ...\">offered loan relief based<\/a> on racial classifications. Farmers and ranchers must be black, Native American, Hispanic, Latino, Asian, an Alaskan native, or Pacific Islander in order to participate,&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20210601020054\/https:\/\/public-inspection.federalregister.gov\/2021-11155.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the stipulations said<\/a>.<\/p>\n<p>In <a href=\"https:\/\/will-law.org\/faust-v-vilsack\/\" target=\"_blank\" rel=\"noopener\" title=\"\">a landmark 2021 racial equality case<\/a>, Faust was the first farmer to <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2021\/06\/REPLY-in-support-of-PI-motion.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">successfully sue<\/a> the Biden administration over the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minority-farmer-loan-forgiveness-program-to-allocate-4b-in-payments-as-part-of-american-rescue-plan\/\" title=\"... ... loan forgiveness ... to allocate B in payments as part of American Rescue Plan\">farmer loan forgiveness program<\/a>, which WILL argued excluded white farmers from accessing billions in relief-related benefits allocated on the basis of race.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/1363847\/judge-halts-minority-only-usda-debt-forgiveness-program\/\" target=\"_blank\" rel=\"noreferrer noopener\">JUDGE HALTS MINORITY-ONLY USDA DEBT FORGIVENESS PROGRAM<\/a><\/strong><\/p>\n<p>Although he won that battle with the Biden administration, WILL says Faust is still subject to a number of prejudiced policies, including the three named in Monday&rsquo;s lawsuit, that continue to discriminate against him and 2 million other white male farmers nationwide.<\/p>\n<p><a href=\"https:\/\/will-law.org\/roadmaptoequality\/\" target=\"_blank\" rel=\"noopener\" title=\"\">WILL&rsquo;s policy tracker<\/a>, which monitors the Trump administration&rsquo;s progress with dismantling DEI programs across the federal government, has identified at least two dozen racially selective initiatives in effect at the USDA.<\/p>\n<p>The USDA was contacted for comment on
