Khalil&#8217;s request for release was denied, with the judge stating he could remain in custody unless the Secretary of State, Marco rubio, determines he poses a national security threat. Khalil was detained under a provision of the Immigration and Nationality Act, which permits the deportation of noncitizens if their presence is viewed as potentially harmful to U.S. <a href=\"https:\/\/amzn.to\/3YuVZYV\" >foreign policy<\/a>. Rubio argued that allowing Khalil to stay could create hostility toward Jewish students in the U.S. Earlier in the week, the judge had indicated that the justification for Khalil&#8217;s detention might be unconstitutional. Khalil had previously been arrested for leading protests against Israeli actions in Gaza and had been accused of involvement with Hamas. This provision allows the Secretary of State to deport noncitizens if they determine their presence in the country would result in &ldquo;potentially serious adverse foreign policy consequences for the United States.&rdquo;<\/p>\n<p>&#8203;&#8203;Rubio had said allowing Khalil, who led protests against Israel&rsquo;s war in Gaza, to stay in the U.S. would create a &ldquo;hostile environment for Jewish students in the United States.&rdquo;<\/p>\n<p>Farbiarz <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3439033\/judge-mahmoud-khalil-cant-be-deported-national-security-basis\/\" target=\"_blank\" rel=\"noopener\" title=\"\">ruled earlier this week<\/a> that Rubio&rsquo;s grounds for Khalil&rsquo;s detainment were likely insufficient and unconstitutional. The judge stayed the preliminary injunction until 9:30 a.m. Friday to give the government time to appeal.&nbsp;<\/p>\n<p>Khalil&rsquo;s legal team filed a letter Friday morning requesting the court to order his release.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3404527\/trump-doj-provide-legal-basis-deporting-mahmoud-khalil\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>TRUMP DOJ MUST DEFEND LEGAL BASIS FOR DEPORTING MAHMOUD KHALIL: JUDGE<\/strong><\/a><\/p>\n<p>&ldquo;The Government has not filed a notice of appeal of this Court&rsquo;s Order by the Court-ordered deadline for the preliminary injunction to be in effect,&rdquo; the letter said.<\/p>\n<p>Khalil grew up in a Palestinian refugee camp in Syria and was granted permanent U.S. resident status. In March, he was arrested outside his student housing on Columbia&rsquo;s campus and detained.
