This ruling followed the arrest of a Haitian national accused of illegal voting and past convictions related to narcotics and weapons. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-judge-bans-thin-blue-line-clothing-for-court-employees\/\" title=\"Maryland Judge Bans \u2018Thin Blue Line\u2019 Clothing For Court Employees\">judge cited concerns<\/a> over the potential disenfranchisement of citizens if proof of citizenship became necessary, despite acknowledging that current voter registration relies on an honor system. Critics argue that this system is inadequate in preventing noncitizen voting,highlighting the need for legislative reforms like the Safeguard American Voter Eligibility (SAVE) Act,which aims to amend voter registration laws to include citizenship proof. return false;\" title=\"Printer Friendly, PDF &amp; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>An unelected inferior court judge claimed it&rsquo;s too risky to ask voters to prove they&rsquo;re citizens in order to register to vote, days after Immigration and Customs Enforcement (ICE) arrested a Haitian national for allegedly illegally voting.<\/p>\n<p>According to a <a href=\"https:\/\/x.com\/ICEgov\/status\/1933525263469383776\" target=\"_blank\" rel=\"noreferrer noopener\">post on X<\/a>, on Wednesday &ldquo;HSI Miami arrested a Haitian national charged with unlawful voting and casting a false ballot.&rdquo; The alien &ldquo;had previously been convicted of narcotics trafficking and weapons violation and sentenced to 10 years imprisonment,&rdquo; according to HSI Miami.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-311312223\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>While noncitizen voting is illegal, the current law is largely toothless. That&rsquo;s why President Donald Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/preserving-and-protecting-the-integrity-of-american-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> in March to secure elections. One provision of the executive order would require documentary proof of citizenship in order to register to vote.<\/p>\n<p>But on Friday, District Judge Denise Casper, an Obama appointee, <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2025\/04\/107-2025-06-13-Order-granting-preliminary-injunction.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that while &ldquo;there is no dispute (nor could there be) that U.S. citizenship is required to vote in federal elections,&rdquo; &ldquo;the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal voter registration forms require attestation<\/a> of citizenship.&rdquo;<\/p>\n<p>But that&rsquo;s the problem,<em> <\/em>that&rsquo;s<em> all <\/em>the form requires<em>. <\/em><\/p>\n<p>All a prospective voter has to do is check a small square box on the federal voter registration form attesting under penalty of perjury that he is telling the truth about his citizenship status. It&rsquo;s the honor system. Trump&rsquo;s order would require voters to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuit-both-the-how-and-the-what-of-democrat-election-chiefs-rulebook-violate-arizona-law\/\" title=\"Lawsuit: Democrat Election Chief&#039;s Rulebook Violates Arizona Law\">provide documentary proof<\/a> of citizenship to register.<\/p>\n<p>The system is vulnerable &mdash; as evidenced by the arrest of the Haitian national &mdash; yet Casper ruled that there is &ldquo;substantial risk&rdquo; that &ldquo;citizens will be disenfranchised&rdquo; by having to prove they are citizens in order to register to vote.<\/p>\n<p>&ldquo;The States have also credibly attested that the challenged requirements could create chaos and confusion that could result in voters losing trust in the election process,&rdquo; Casper ruled, clearly disregarding the fact that the current honor system does result in voters losing trust in the security of elections.<\/p>\n<p>But Casper&rsquo;s ruling only underscores the need for the Safeguard American Voter Eligibility (SAVE) Act. Shortly before her ruling, a Haitian national became the latest individual in a <a href=\"https:\/\/thefederalist.com\/2025\/05\/01\/noncitizen-voting-and-voter-fraud-schemes-doj-investigates-voting-crimes-across-multiple-states-and-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">string<\/a> of examples of noncitizens voting &mdash; all made possible by a vulnerable system. But that&rsquo;s precisely why the House <a href=\"https:\/\/thefederalist.com\/2025\/04\/10\/208-democrats-vote-against-legislation-to-keep-noncitizens-out-of-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a> the <a href=\"https:\/\/thefederalist.com\/2025\/04\/09\/5-common-lies-about-the-save-act-and-how-to-refute-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">SAVE Act<\/a> in April, which would amend the 1993 National Voter Registration Act to make documentary proof of citizenship a requirement to register to vote, as The Federalist previously reported. That means the proof of citizenship provision in Trump&rsquo;s executive order wouldn&rsquo;t even be necessary.<\/p>\n<p>Even if Casper&rsquo;s ruling survives an appeal, Congress has the authority to fix the problem by amending the National Voter Registration Act to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mike-kelly-same-people-criticizing-trump-peddled-russia-collusion-hoax\/\" title=\"Mike Kelly: Same People Criticizing Trump Peddled Russia Collusion Hoax\">protect election integrity<\/a> at the federal level.
