Teh judge did not grant the temporary restraining order but scheduled a hearing for Thursday to consider the motion. Meanwhile, the Justice Department has been granted time to respond to California&#8217;s request, allowing the continued use of the National Guard and Marines until the hearing takes place. The judge&rsquo;s order set a hearing for 4:30 p.m. Eastern on Thursday in his San Francisco courtroom and issued a schedule for each side to file briefings on their positions to the court.<\/p>\n<p>Breyer gave the Justice Department until 2 p.m. Eastern on Wednesday to file its opposition to the motion and until noon Thursday for the Golden State officials to respond to the DOJ&rsquo;s opposition.<\/p>\n<p>The scheduling order means the Trump administration may continue to use the National Guard and Marines to quell violence, which has emerged in Los Angeles in recent days amid protests against immigration raids, until the hearing.<\/p>\n<p>After <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cops-erect-concrete-barrier-around-home-of-cop-who-shot-daunte-wright-as-protests-turn-violent-for-third-night\/\" title=\"Cops Erect Concrete Barrier Around Home Of Cop Who Shot Daunte Wright As Protests Turn Violent For Third Night\">protests turned violent<\/a> against federal immigration officers conducting raids, Trump&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3435794\/trump-historic-use-title-10-legal-battle\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordered the National Guard to Los Angeles<\/a>&nbsp;over the weekend, the first time it was deployed without a governor&rsquo;s consent since 1965. He&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense\/3435916\/hundreds-marines-deploy-los-angeles-ice-protests\/\" target=\"_blank\" rel=\"noreferrer noopener\">sent Marines to the city on Monday<\/a> for additional support in stopping the violence.<\/p>\n<p>Newsom and Bonta claimed in their request for the temporary restraining order that Trump&rsquo;s actions create &ldquo;imminent harm to State Sovereignty, deprives the State of vital resources, escalates tensions and promotes (rather than quells) civil unrest.&rdquo;<\/p>\n<p>Justice Department officials said in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.450934\/gov.uscourts.cand.450934.12.0_3.pdf\" target=\"_blank\" rel=\"noopener\" title=\"notice\">notice<\/a> to the court filed after state officials asked for the emergency pause that the request from Newsom and Bonta was &ldquo;highly unusual and indeed non-justiciable under constitutional principles.&rdquo;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3437241\/newsom-asks-court-emergency-order-troops-los-angeles\/\" target=\"_blank\" rel=\"noopener\" title=\"NEWSOM ASKS COURT FOR EMERGENCY ORDER TO BLOCK TROOPS IN LA\">NEWSOM ASKS COURT FOR EMERGENCY ORDER TO BLOCK TROOPS IN LA<\/a><\/strong><\/p>\n<p>The request for an order temporarily blocking Trump&rsquo;s usage of troops comes in a lawsuit California filed against the president on Monday, claiming his actions violate the 10th Amendment and federal law.<\/p>\n<p>Trump&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3436924\/trump-insurrection-act-violence-los-angeles-protests\/\" target=\"_blank\" rel=\"noreferrer noopener\">defended his actions<\/a> in the Oval Office earlier Tuesday, saying, &ldquo;If we didn&rsquo;t get involved, right now, Los Angeles would be burning.&rdquo;
