Republicans seek to ... ... used by ...s DOJ to imprison ...rs, calling it &#039;weaponized&#039;.\">target peaceful <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americans-remember-the-48th-annual-march-for-life\/\" title=\"Americans remember the 48th annual March for Life\">pro-life activists<\/a><\/a>. Despite a majority of the GOP members being pro-life, only a few co-sponsored the legislation as of March. Republican Rep. Chip Roy, who sponsored the bill, previously indicated he might pursue alternative legislative strategies if progress was not made. The committee&#8217;s approval brings the bill closer to a full House vote. <\/p>\n<p>Concerns have been raised that the FACE Act has been used disproportionately against pro-life individuals-over 90% of its prosecutions were against them, particularly for non-violent actions like prayer and evangelizing outside abortion facilities. The push to repeal the law stems from a desire to prevent future administrations from misusing it,as was alleged during Biden&#8217;s presidency. Advocacy groups, including the Thomas more Society, argue that the law enables state attorneys general to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-fbi-has-indicted-22-pro-life-protesters-and-zero-pregnancy-center-firebombers\/\" title=\"The FBI Has Indicted 22 ... Protesters and Zero Pregnancy Center Firebombers\">target pro-life activists<\/a> as well, exemplified by cases in New York.<\/p>\n<p>A coalition of pro-life advocates conveyed their support for the repeal, asserting that it is crucial to safeguard the rights of individuals speaking out for the unborn without facing government retribution. The House Judiciary Committee&#8217;s move is seen as a significant step toward that goal.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Thirteen of the 25 Republicans on the House Judiciary Committee <a href=\"https:\/\/www.youtube.com\/watch?v=LsD-8cANcgA\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> on Tuesday to <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/589\" target=\"_blank\" rel=\"noreferrer noopener\">advance a bill<\/a> that seeks to repeal a law that the Biden administration weaponized to silence and jail peaceful pro-life activists.<\/p>\n<p>Every&nbsp;<a href=\"https:\/\/judiciary.house.gov\/about\/membership\" target=\"_blank\" rel=\"noreferrer noopener\">GOP member of the House Judiciary Committee<\/a>&nbsp;claims to be pro-life in some form or fashion, but as of March, only a handful, most bill&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/589\/cosponsors\" target=\"_blank\" rel=\"noreferrer noopener\">co-sponsors<\/a>, committed publicly to <a href=\"https:\/\/thefederalist.com\/2025\/03\/21\/pro-life-house-republicans-could-repeal-the-face-act-today-but-they-hesitate\/\" target=\"_blank\" rel=\"noreferrer noopener\">support the FACE Act Repeal Act<\/a>. Republican Rep. Chip Roy, who introduced the legislation, previously threatened to &ldquo;file a discharge petition&rdquo; and &ldquo;try to move the bill, irrespective of the normal procedures&rdquo; if the GOP did not act on it soon. <\/p>\n<p>During markup, however, the Republicans on the committee voted to recommend favorably the legislation to the House of Representatives for a chamber-wide vote.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Chairman <a href=\"https:\/\/twitter.com\/Jim_Jordan?ref_src=twsrc%5Etfw\">@Jim_Jordan<\/a> highlights how after the Dobbs leak, pro-abortion activists attacked pregnancy resource centers. But Biden&#8217;s DOJ overwhelmingly used the FACE Act to jail peaceful pro-lifers.<\/p>\n<p>We stand with Chairman Jim Jordan in calling for its repeal. <a href=\"https:\/\/t.co\/ZV5Q1NTMFd\">pic.twitter.com\/ZV5Q1NTMFd<\/a><\/p>\n<\/div>\n<p>&mdash; SBA Pro-Life America (@sbaprolife) <a href=\"https:\/\/twitter.com\/sbaprolife\/status\/1932501638712820096?ref_src=twsrc%5Etfw\">June 10, 2025<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>The Republicans&rsquo;<strong> <\/strong>advancement of the FACE Act Repeal Act pushes Congress one step closer to eradicating a law that, despite former FBI Director Christopher Wray&rsquo;s assertion, targeted people opposed to ending life in the womb more than <a href=\"https:\/\/thefederalist.com\/2025\/01\/21\/republicans-led-by-chip-roy-move-to-repeal-the-act-biden-used-to-jail-peaceful-pro-lifers\/\" target=\"_blank\" rel=\"noreferrer noopener\">90 percent of the time<\/a>. Crimes such as assault, threats of injury, disorderly conduct, and trespassing are already barred by states and localities, so it was the FACE Act&rsquo;s existence alone that emboldened the Biden regime to bring&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/07\/24\/christopher-wray-says-fbi-does-not-target-peaceful-pro-lifers-the-stats-prove-otherwise\/\" target=\"_blank\" rel=\"noreferrer noopener\">55<\/a>&nbsp;of its 60 FACE Act<strong>&nbsp;<\/strong>prosecutions against Americans who<a href=\"https:\/\/thefederalist.com\/2024\/06\/19\/yes-bidens-department-of-justice-wants-to-imprison-peaceful-pro-lifers-for-praying\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;prayed, sang, and evangelized<\/a>&nbsp;at abortion facilities.<\/p>\n<p>President Donald Trump&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/01\/24\/trumps-pardon-of-pro-life-prisoners-alone-makes-the-movements-votes-for-him-worth-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">pardoned<\/a>&nbsp;nearly two dozen of the pro-lifers who were targeted by the radical abortion administration that preceded him. Mere days into Trump&rsquo;s second term, U.S. Attorney General Chief of Staff Chad Mizelle also <a href=\"https:\/\/www.justice.gov\/media\/1386461\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">issued a memo<\/a> announcing the Trump administration&rsquo;s commitment to only use the FACE Act in &ldquo;extraordinary circumstances, or in <a href=\"https:\/\/amzn.to\/3YuVZYV\" >cases presenting significant aggravating factors<\/a>.&rdquo;<\/p>\n<p>&ldquo;Cases not presenting significant aggravating factors can adequately be addressed under state or local law. Additionally, until further notice, no new abortion-related FACE Act actions &mdash; criminal or civil &mdash; will be permitted without authorization from the Assistant Attorney General for the Civil Rights Division,&rdquo; the memo concluded.<\/p>\n<p>Thomas More Society Executive Vice President and General Counsel Andrew Bath told The Federalist, however, that the Trump administration&rsquo;s effective &ldquo;deweaponization&rdquo; of the FACE Act &ldquo;doesn&rsquo;t mean there&rsquo;s no good reason to repeal it.&rdquo; <\/p>\n<p>&ldquo;One thing that a lot of people don&rsquo;t realize is that, by its own terms, [the FACE Act] is enforceable by state attorneys general,&rdquo; Bath explained in a phone interview. &ldquo;So I can give you a bunch of reasons to repeal it. Letitia James, Rob Bonta, Kwame Raoul, Keith Ellison, and I can go on.&rdquo;<\/p>\n<p>Already, New York Attorney General Letitia James targeted Red Rose Rescue sidewalk counselors under both the FACE Act and the New York Clinic Access Act, a state-level <a href=\"https:\/\/www.thomasmoresociety.org\/news\/new-york-attorney-general-takes-page-from-biden-doj-playbook-to-favor-abortion\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;equivalent&rdquo;<\/a> to the federal statute. A <a href=\"https:\/\/www.christianpost.com\/news\/pro-life-group-can-protest-near-abortion-clinic-ny-judge.html\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. district court judge<\/a> eventually rejected the attempt to ban the pro-lifers from exercising their First Amendment rights, but his ruling did not necessarily disqualify a future case from arising.<\/p>\n<p>The pro-life movement has <a href=\"https:\/\/thefederalist.com\/2025\/03\/14\/key-pro-life-organizations-demand-republicans-repeal-weaponized-face-act-as-soon-as-possible\/\" target=\"_blank\" rel=\"noreferrer noopener\">repeatedly noted<\/a> that the Republican-controlled Congress&rsquo;s failure to repeal the FACE Act would enable future administrations to replicate the Biden DOJ&rsquo;s abuse of power by charging and imprisoning people who are committed to protecting life beginning at conception.<\/p>\n<p>A coalition of some of the biggest life advocates reaffirmed that position to the House Judiciary Committee in a letter ahead of the markup on Tuesday.<\/p>\n<p>&ldquo;Repealing the FACE Act in its entirety is an excellent step in ensuring that never again will pro-life activists have the FBI knock on their front door simply for standing up for the most vulnerable in society,&rdquo; the <a href=\"https:\/\/twitter.com\/jonah_wendt\/status\/1925182631970267247\" target=\"_blank\" rel=\"noreferrer noopener\">letter stated.<\/a><\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
