The ban was implemented after the AP refused to change its style guide to refer to the Gulf of Mexico as the &#8220;Gulf of America,&#8221; a name Trump had instituted. The appellate court stated that these restricted spaces are not public forums protected by the First Amendment, and thus the White House has the discretion to decide which journalists may enter based on their viewpoints. The initial ruling by a lower court had sided with the AP, claiming the ban violated constitutional rights. the ruling reads. &ldquo;The White House therefore retains discretion to determine, including on the basis of viewpoint, which journalists will be admitted.&rdquo;<\/p>\n<p>&ldquo;Moreover, without a stay, the government will suffer irreparable harm because the injunction impinges on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-taking-regeneron-drug-remdesivir-therapy-for-coronavirus-diagnosis-ex-wh-doctor-explains\/\" title=\"... taking Regeneron drug, Remdesivir ther...y for coronavirus diagnosis: ex-WH doctor explains\">president&#038;rsquo<\/a>;s independence and control over this private workspaces,&rdquo; the ruling concludes.<\/p>\n<p>The ruling comes after the <em>AP<\/em> challenged the Trump administration on the ban, citing the First Amendment. A lower court <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3374430\/judge-orders-white-house-restore-associated-press-access\/\" target=\"_blank\" rel=\"noopener\" title=\"\">previously sided<\/a> with the <em>AP<\/em> in saying the ban violated the Constitution.<\/p>\n<p>&ldquo;About two months ago, President Donald Trump renamed the Gulf of Mexico the Gulf of America,&rdquo; District Judge Trevor McFadden said. &ldquo;The&nbsp;<em>Associated Press<\/em>&nbsp;did not follow suit. For that editorial choice, the White House sharply curtailed the&nbsp;<em>AP<\/em>&rsquo;s access to coveted, tightly controlled media events with the president.&rdquo;<\/p>\n<p>&ldquo;The&nbsp;<em>AP<\/em>&nbsp;now sues the White House chief of staff, her communications deputy, and the press secretary,&rdquo; the Trump appointee continued, &ldquo;seeking a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >preliminary injunction enjoining<\/a> the Government from excluding it because of its viewpoint. Today, the court grants that relief.&rdquo;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/3324882\/white-house-name-games-associated-press\/\" target=\"_blank\" rel=\"noopener\" title=\"\">THE WHITE HOUSE PLAYS NAME GAMES WITH THE ASSOCIATED PRESS<\/a><\/strong><\/p>\n<p>&ldquo;We are gratified by the court&rsquo;s decision,&rdquo; <em>AP<\/em> spokeswoman Lauren Easton said after the original decision. &ldquo;Today&rsquo;s ruling affirms the fundamental right of the press and public to speak freely without government retaliation.
