United States\">Rush v. United States<\/a><\/em>, a case targeting the&nbsp;National Firearms Act&nbsp;of 1934. Rush, who pleaded guilty to possessing an unregistered short-barreled AR-15 and was sentenced to 30 months behind bars. <\/p>\n<p>A federal appeals court upheld his conviction, citing the Supreme Court&rsquo;s precedent dating back to a 1939 decision. Judge Joshua Kolar <a href=\"https:\/\/www.mrcolionnoir.com\/federal-appeals-court-second-amendment-does-not-protect-short-barreled-rifles\/?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\" title=\"wrote for the panel\">wrote for the panel<\/a> that the history and tradition of the nation&rsquo;s gun laws supported their conclusion.<\/p>\n<p>&ldquo;We decline to make a step one finding that short-barreled rifles are &lsquo;arms&rsquo; protected by the Second Amendment&rsquo;s text&mdash;at least not on this occasion under the theories presented by Rush,&rdquo; Kolar wrote. &ldquo;The record does not show such firearms are commonly used by ordinary, law-abiding citizens for a lawful purpose like self-defense.&rdquo;<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3414469\/supreme-court-top-cases-2024-2025-term\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>TOP CASES THE SUPREME COURT WILL DECIDE AT THE END OF THIS TERM<\/strong><\/a><\/p>\n<p>But the NRA argues the lower court misread&nbsp;<em><em>United States v. Miller<\/em><\/em>, the 1939 case, and ignored newer precedents that instructed lower courts to follow a history and tradition test for gun control laws. According to the group, short-barreled rifles are widely owned for lawful purposes and therefore deserve protection under the&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/second-amendment\" target=\"_blank\" rel=\"noopener\" title=\"\">Second Amendment<\/a>, as clarified by&nbsp;<em>District of Columbia v. Heller<\/em>&nbsp;and&nbsp;<em><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2570086\/starting-pistol-tidal-wave-of-gun-laws-struck-down-a-year-after-supreme-court-bruen-ruling-2\/\" target=\"_blank\" rel=\"noopener\" title=\"New York State Rifle &amp; Pistol Ass&rsquo;n v. Bruen\">New York State Rifle &amp; Pistol Association v. (AP Photo\/Charles Krupa)<\/figcaption><\/figure>\n<\/div>\n<p>&ldquo;The National Firearms Act imposes burdens on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a> that have no grounding in the text, history, or tradition of the Second Amendment,&rdquo; said Doug Hamlin, NRA executive vice president and CEO. &ldquo;We&rsquo;re hopeful that the Supreme Court will use this opportunity to reaffirm that right.&rdquo;<\/p>\n<p>The petition also highlights a broader legal clash in the federal courts over how to handle bans and restrictions on commonly owned firearms, including AR-15s and standard-capacity magazines. The NRA says that the conflict requires resolution from the Supreme Court.<\/p>\n<p>Gun rights advocates are closely watching how this case could force the Supreme Court to reconcile its landmark&nbsp;<em>Bruen<\/em> ruling with its earlier decision in&nbsp;<em>Miller<\/em>. That 1939 case upheld federal restrictions on certain firearms such as machine guns and sawed-off shotguns, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congressman-jamie-raskin-wants-to-tax-your-guns-if-he-cant-ban-them\/\" title=\"Congressman Jamie Raskin Wants To ... Your Guns If He Can\u2019t Ban Them\">including short-barreled rifles<\/a>, setting a precedent that not all weapons are covered by the Second Amendment. But under the&nbsp;<em>Bruen<\/em>&nbsp;framework, which is focused on historical tradition, that precedent may now be vulnerable. Just this week, the high court <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3428683\/clarence-thomas-blasts-supreme-court-declining-ar-15-ban-case-maryland\/\" target=\"_blank\" rel=\"noopener\" title=\"\">declined to hear<\/a> a challenge to&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/maryland\" target=\"_blank\" rel=\"noopener\" title=\"\">Maryland<\/a>&rsquo;s AR-15 ban &mdash; but several justices signaled they are ready to confront the issue soon. Justice Brett Kavanaugh called Maryland&rsquo;s law &ldquo;questionable&rdquo; and predicted the Supreme Court &ldquo;presumably will address the AR-15 issue soon, in the next Term or two.&rdquo;<\/p>\n<p>In the same decision, Justices <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/clarence-thomas\/\" target=\"_blank\" rel=\"noreferrer noopener\">Clarence Thomas<\/a>, Samuel Alito, and Neil Gorsuch said they would have taken the case immediately.<\/p>\n<p>&ldquo;The NRA is proud to stand at the forefront of this fight to restore our freedoms and ensure that peaceable citizens are not treated like criminals for owning commonly used firearms,&rdquo; said NRA-ILA Executive Director John Commerford.<\/p>\n<p>If granted,&nbsp;<em>Rush v.
