The Court unanimously resolute that Title VII of the Civil Rights Act dose not require individuals from majority groups to meet a heightened standard to prove discrimination. Justice Ketanji Brown Jackson, who wrote the opinion, emphasized that the law protects all individuals regardless of their group status. The controversial &#8220;background circumstances&#8221; doctrine, which required majority-group plaintiffs to show that their employer discriminated against them, was rejected as it doesn&#8217;t align with the statutory text. Thomas highlighted that such judge-made doctrines can create unnecessary complexity and confusion within the legal framework. The plaintiffs must prove this either by providing statistical evidence reflecting a pattern of bias or by finding the minority group at issue &mdash; in this case, someone who identifies as gay or lesbian &mdash; made the hiring decision.<\/p>\n<p>Such was not the case in the employment decision regarding Ames.<\/p>\n<p>Jackson pointed out that the &ldquo;background circumstances&rdquo; doctrine &mdash; which is applied in five circuits, but not seven others &mdash; is not found in the law.<\/p>\n<p>The Supreme Court&rsquo;s case law &ldquo;makes clear that the standard for proving disparate treatment under Title VII does not vary based on whether or not the plaintiff is a member of a majority group. &hellip; The &lsquo;background circumstances&rsquo; rule flouts that basic principle,&rdquo; Jackson wrote.<\/p>\n<p>&ldquo;Congress left no room for courts to impose special requirements on majority-group plaintiffs alone,&rdquo; she added.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/clarence-thomas-makes-point-day-supreme-court-hears-arguments-birthright-citizenship-case\/\" target=\"_blank\" rel=\"noopener\">Thomas<\/a> agreed, joining with Jackson&rsquo;s<a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-1039_c0n2.pdf\" target=\"_blank\" rel=\"noopener\"> opinion<\/a> in full.<\/p>\n<p>&ldquo;I write separately to highlight the problems that arise when <a href=\"https:\/\/amzn.to\/3YuVZYV\" >judges create atextual legal rules<\/a> and frameworks,&rdquo; he explained.<\/p>\n<p>&ldquo;Judge-made doctrines have a tendency to distort the underlying statutory text, impose unnecessary burdens on litigants, and cause confusion for courts.
