spelled out as clearly as our Founding Fathers meant for it to be.<\/p>\n<p>And yet, despite that, it&rsquo;s hard to go any significant length of time without at least one loudmouth Democrat <a href=\"https:\/\/www.westernjournal.com\/nra-buries-lyin-adam-schiff-democrats-roll-partial-gun-ban-bill\/\" target=\"_blank\" rel=\"noopener\">clamoring for that right to be infringed upon<\/a>, all in the name of some nebulous sense of &ldquo;safety&rdquo; that seems especially elusive <a href=\"https:\/\/www.westernjournal.com\/mom-forced-leave-nyc-highlights-folly-dem-gun-grabbing\/\" target=\"_blank\" rel=\"noopener\">in the bluest areas<\/a>.<\/p>\n<p>It&rsquo;s <a href=\"https:\/\/www.westernjournal.com\/go-parkland-victims-father-unloads-dem-gun-grabbers-viral-post\/\" target=\"_blank\" rel=\"noopener\">as nauseating<\/a> as it is expected at this point, but at least Democrats are &mdash; \t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>Given all that, perhaps you could charitably describe Democratic gun-grabbers as &ldquo;misguided,&rdquo; more than malicious.<\/p>\n<p>(This writer <a href=\"https:\/\/www.westernjournal.com\/democrats-introduce-legislation-restricts-number-guns-person-can-buy\/\" target=\"_blank\" rel=\"noopener\">certainly wouldn&rsquo;t<\/a>, but you <em>could<\/em>.)<\/p>\n<p>The foreign government of Mexico deserves no such benefit of the doubt on this matter when they&rsquo;re coming after the Second Amendment.<\/p>\n<p>And the Supreme Court of the United States hammered that point home Thursday, <a href=\"https:\/\/www.nytimes.com\/2025\/06\/05\/us\/politics\/supreme-court-mexico-gunmakers.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to the New York Times.<\/p>\n<p>SCOTUS unanimously rejected a lawsuit presented by the Mexican government (<em>Smith &amp; Wesson Brands v. Estados Unidos Mexicanos<\/em>) that sought to pin the blame of its country&rsquo;s horrific gun violence on multiple gun manufacturers, including Smith &amp; Wesson.<\/p>\n<p>&ldquo;Mexico had claimed that the gun industry&rsquo;s production and sale of arms in the United States helped fuel and supply drug cartels, harming the Mexican government,&rdquo; the Times reported. &ldquo;Mexican government lawyers also claimed the companies were aware that some of their guns were illegally trafficked, and that the country should therefore be allowed to sue under an exception in the law.&rdquo;<\/p>\n<p>Evidently, not a single justice agreed with that.<\/p>\n<p>The unanimous <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-1141_lkgn.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a>, written by Justice Elena Kagan, referred to The Protection of Lawful Commerce in Arms Act (<a href=\"https:\/\/www.congress.gov\/bill\/109th-congress\/senate-bill\/397\/text\" target=\"_blank\" rel=\"noopener\">PLCAA<\/a>), a law enacted in 2005 that effectively protects gun manufacturers from being found liable in crimes committed with their wares.<\/p>\n<p>&ldquo;But PLCAA&rsquo;s general bar on these suits has an exception, usually called the predicate exception, relevant here,&rdquo; Kagan wrote. &ldquo;That exception applies to lawsuits in which the defendant manufacturer or seller &lsquo;knowingly violated a State or Federal statute applicable to the sale or marketing&rsquo; of firearms, and the &lsquo;violation was a proximate cause of the harm for which relief is sought.<\/p>\n<p>&ldquo;The predicate violation PLCAA demands may come from aiding and abetting someone else&rsquo;s firearms offense.&rdquo;<\/p>\n<p>The decision continued: &ldquo;Here, the Government of Mexico sued seven American gun manufacturers, alleging that the companies aided and abetted unlawful gun<br \/> sales that routed firearms to Mexican drug cartels. The basic theory of its suit is that the defendants failed to exercise &lsquo;reasonable care&rsquo;&nbsp;to prevent trafficking of their guns into Mexico, and so are responsible for the harms arising there from the weapons&rsquo; misuse.<\/p>\n<p>&ldquo;That theory implicates PLCAA&rsquo;s general prohibition, so the complaint tries to plead its way into the predicate exception.&rdquo;<\/p>\n<p>The conclusion: &ldquo;Because Mexico&rsquo;s complaint does not plausibly allege that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-dismisses-mexico-suit-against-u-s-gun-manufacturers\/\" title=\"SCOTUS Dismisses Mexico Suit Against U.S. Gun Manufacturers\">defendant gun manufacturers aided<\/a> and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >abetted gun dealers&#038;rsquo<\/a>; unlawful sales of firearms to Mexican traffickers, PLCAA bars the lawsuit.&rdquo;<\/p>\n<p>Oh, well. The Mexican government does not deserve such leniency when it comes to attacking the Second Amendment. Recently, the U.S. Supreme Court unanimously dismissed a lawsuit from Mexico (Smith &amp; Wesson Brands v. Estados Unidos Mexicanos) that sought to hold several gun manufacturers accountable for its severe gun violence issues. According to reports from The New York Times, Mexico claimed that U.S.-based gun production and sales contributed to arming drug cartels and harming its government.<\/p>\n<p>Mexican lawyers argued that these companies knew their firearms were being trafficked illegally and thus should be liable under an exception in existing law. However, none of the justices supported this view.<\/p>\n<p>The unanimous ruling by Justice Elena Kagan referenced The Protection of Lawful Commerce in Arms Act (PLCAA), which protects gun manufacturers from liability related to crimes committed with their products unless they knowingly violated laws regarding firearm sales or marketing leading directly to harm.<\/p>\n<p>Kagan explained that Mexico&#8217;s lawsuit alleged American manufacturers aided illegal arms sales fueling drug cartel violence but failed to demonstrate any plausible violation warranting legal action under PLCAA&#8217;s exceptions.<\/p>\n<p>Ultimately concluding that Mexico&#8217;s claims did not convincingly show culpability on part of these manufacturers for illegal trafficking into Mexico effectively barred their lawsuit under PLCAA guidelines-a fitting end for what was deemed an absurd case.<\/p>\n<p>This situation raises concerns about how such lawsuits could undermine lawful gun ownership if they proliferated unchecked-who would manufacture guns if every incident led to massive lawsuits?
