The Centers for Medicare &#038; Medicaid Services (CMS) announced this change, stating it does not align with the current administration&#8217;s policies and aims to clarify any confusion created by the Biden administration. The Emergency Medical Treatment and Labor Act (EMTALA), originally enacted in 1986, requires hospitals to provide emergency care but does not override state laws that govern abortion procedures unless there is a direct conflict.<\/p>\n<p>Following the Supreme Court&#8217;s 2022 ruling in *Dobbs v. Jackson*,the Biden administration had expanded EMTALA to include abortion services,which led to legal conflicts with states like Idaho that have pro-life protections. The Trump administration&#8217;s Department of Justice had already dropped the legal challenges to Idaho&#8217;s laws prior to this reversal of guidance. Pro-life advocates and medical professionals have welcomed this change, viewing it as a victory for women and unborn children, emphasizing that existing laws already allow for necessary medical interventions during pregnancy emergencies.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Trump administration officially rescinded Biden administration-era guidance that attempted to force hospitals to perform abortions in violation of pro-life states&rsquo; protections this week because it does &ldquo;not reflect the policy of this Administration.&rdquo;<\/p>\n<p>The Centers for Medicare &amp; Medicaid Services <a href=\"https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-emergency-medical-treatment-and-labor-act-emtala\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> on Tuesday that it will do away with former Health and Human Services Secretary Xavier Becerra&rsquo;s <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/emergency-medical-care-letter-to-health-care-providers.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">demands<\/a> that hospitals perform abortions as &ldquo;stabilizing&rdquo; procedures, even if <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admins-new-hhs-guidance-shoehorns-unfettered-abortion-into-existing-law\/\" title=\"Biden Admin\u2019s New HHS ... Shoehorns Unfettered Abortion Into Existing Law\">state law prohibits abortion<\/a> except in cases of rape, incest, or to save the life of a woman. <\/p>\n<p>&ldquo;CMS will continue to enforce EMTALA, which protects all individuals who present to a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >hospital emergency department seeking examination<\/a> or treatment, including for identified emergency medical conditions that place the health of a pregnant woman or her unborn child in serious jeopardy,&rdquo; the <a href=\"https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-emergency-medical-treatment-and-labor-act-emtala\" target=\"_blank\" rel=\"noreferrer noopener\">statement declares<\/a>.<\/p>\n<p>CMS also promised to &ldquo;rectify any perceived legal confusion and instability created by the former administration&rsquo;s actions.&rdquo;<\/p>\n<p>The Ronald Reagan administration enacted the Emergency Medical Treatment and Labor Act (EMTALA) in 1986 to stop hospitals from turning away patients based on their inability to pay the expenses. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-doj-ends-biden-era-lawfare-targeting-idaho-pro-life-law\/\" title=\"Trump DOJ Ends Biden-Era Lawfare Targeting Idaho Pro-... Law\">law requires adequate treatment<\/a> for an&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/1395dd\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;unborn child&rdquo;<\/a>&nbsp;but also explicitly does &ldquo;not preempt any State or local law requirement, except to the extent that the requirement&nbsp;directly&nbsp;conflicts with&rdquo; EMTALA.<\/p>\n<p>Shortly after the Supreme Court&rsquo;s 2022&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-07-13\/pdf\/2022-15138.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Dobbs v. Jackson<\/em>&nbsp;ruling<\/a>, however, the CMS, at the behest of an&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-07-13\/pdf\/2022-15138.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>, expanded EMTALA to include abortion as a&nbsp;routine &ldquo;irrespective of any state laws or mandates that apply to specific procedures.&rdquo; <\/p>\n<p>The Democrat regime then weaponized its redefinition of the law&nbsp;<a href=\"https:\/\/thefederalist.com\/2022\/08\/04\/killing-babies-isnt-stabilizing-treatment-but-the-lying-biden-administration-already-knows-that\/\" target=\"_blank\" rel=\"noreferrer noopener\">against<\/a>&nbsp;Idaho for prohibiting abortion except in cases of rape or incest, or if a physician deems it necessary to save the mother&rsquo;s life.<\/p>\n<p>The Biden administration&rsquo;s attack on the pro-life law made it all the way to the Supreme Court, which ruled <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-726_6jgm.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">6-3<\/a>&nbsp;in 2024 to toss the case back to the&nbsp;<a href=\"https:\/\/www.law.com\/nationallawjournal\/2023\/04\/13\/how-liberal-is-the-9th-circuit-new-study-takes-deep-dive\/#:~:text=For%20decades%2C%20the%20U.S.%20Court,extremely%20liberal%20federal%20appellate%20court.\" target=\"_blank\" rel=\"noreferrer noopener\">leftist<\/a>&nbsp;San Francisco-based 9th Circuit Court of Appeals.<\/p>\n<p>The Trump administration&rsquo;s Department of Justice, however, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.idd.50547\/gov.uscourts.idd.50547.182.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">formally dropped<\/a> the Biden administration&rsquo;s EMTALA attack on Idaho less than three months before CMS repealed the guidance.<\/p>\n<p>Pro-life organizations and doctors celebrated the end of the Biden-era expansions as a win for women and babies.<\/p>\n<p>&ldquo;As a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/opinion-listen-to-more-than-one-professional-opinion\/\" title=\"Opinion: Listen To More Than One \u2018Professional\u2019 Opinion\">board-certified ob-gyn<\/a> for over 30 years, the administration&rsquo;s change in stance is welcome news for both of my patients&mdash;a pregnant woman and her unborn child&mdash;whose lives are both prioritized by EMTALA. This coercive effort by the prior administration to subvert existing laws to promote abortion was never necessary, as EMTALA has never been confusing for me or my obstetric peers,&rdquo; Dr. Ingrid Skop, vice president and director of medical affairs at Charlotte Lozier Institute, wrote. &ldquo;Every <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-rejects-democrats-attempt-to-gut-state-pro-life-laws\/\" title=\"Senate Rejects Democrats\u2019 Attempt To Gut ... Pro-...
