After an initial setback in court, a U.S. Court of Appeals has temporarily paused a ruling that aimed to block the tariffs, allowing the 10% blanket tariff to remain in effect. This followed a decision by a U.S.District Court in California to dismiss a challenge to the tariffs from the state, citing lack of jurisdiction and favoring a transfer of the case to the Court of International Trade (CIT).<\/p>\n<p>In response to these legal developments, California officials have indicated plans to appeal the dismissal. Simultaneously occurring, Trump is preparing for an appeal regarding the legality of his tariffs, with a panel of judges hearing the case, all of whom were appointed by him. However, Judge Scott Corley went further and dismissed the case entirely because California officials opposed the case being transferred to the New York-based court.<\/p>\n<p>&ldquo;Because this lawsuit arises out of <a href=\"https:\/\/amzn.to\/3YuVZYV\" >executive orders imposing tariffs<\/a>, and because those executive orders are &lsquo;provisions of law for all purposes,&rsquo; this action arises out of laws providing for tariffs and this Court is divested of jurisdiction. Because California requests dismissal rather than transfer to the CIT, transfer is not in the interest of justice,&rdquo; Scott Corley wrote in the order, arguing the case falls in the CIT&rsquo;s &ldquo;exclusive jurisdiction.&rdquo;<\/p>\n<p>The decision allows California to appeal the order to the U.S. Court of Appeals for the Ninth Circuit, a typically left-leaning appeals court. State officials quickly filed a notice that they intend to appeal the decision to that court.<\/p>\n<p>Trump also received a stroke of luck regarding the three<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-dismisses-224-million-talc-verdict-against-johnson-johnson\/\" title=\"... dismisses 4M talc verdict against J&amp;J.\">-judge appeals court panel<\/a> that will hear his challenge to the D.C. district court&rsquo;s ruling that his tariffs are unlawful. Judges Gregory Katsas, Neomi Rao, and Justin Walker, the three judges who have been <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.42107\/gov.uscourts.cadc.42107.01208744761.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"presented the emergency appeal\">presented with the emergency appeal<\/a> of the decision, are all Trump-appointed.<\/p>\n<p>The U.S. Court of Appeals for the D.C. Circuit has requested the companies suing the Trump administration reply to the appeal by Wednesday at 5 p.m., while the Trump administration will have until Friday at 5 p.m. to respond to that filing. The lower court&rsquo;s stay of the preliminary injunction is slated to expire next Thursday.<\/p>\n<p>While the Trump tariff legal cases play out in lower federal courts, the dispute over whether Trump&rsquo;s tariffs are legal is likely to reach the Supreme Court.
