Burroughs, appointed by Obama, has a history of litigating cases involving Harvard, including a meaningful 2019 ruling favoring the university regarding discrimination claims against Asian students, which later was overturned by the Supreme Court.<\/p>\n<p>Additionally, she has managed lawsuits challenging the Trump administration&#8217;s immigration policies. In May 2025, she issued a restraining order against a DHS initiative to revoke Harvard&#8217;s ability to enroll foreign students, which DHS cited as necessary due to alleged failures by Harvard in student record-keeping and campus safety concerns.<\/p>\n<p>Burroughs&#8217; decisions are framed by some as part of a broader judicial resistance to the trump administration,with over 200 ongoing lawsuits creating obstacles for trump&#8217;s policy agenda. return false;\" title=\"Printer Friendly, PDF &amp; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>U.S. District Judge Allison Burroughs, who recently blocked the Department of Homeland Security&rsquo;s (DHS) effort to stop Harvard University&rsquo;s enrollment of foreign students, is the same judge who was overturned by the Supreme Court for siding with the school&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ending-affirmative-action-wont-stop-the-university-systems-racist-admissions-practices\/\" title=\"Ending Affirmative Action Won&#039;t Halt Racist Admissions in Universities.\">racist affirmative action policies<\/a>.<\/p>\n<p>Burroughs, an Obama appointee serving in Massachusetts, has <a href=\"https:\/\/api.thecrimson.com\/article\/2025\/4\/23\/allison-burroughs-harvard\/\" target=\"_blank\" rel=\"noreferrer noopener\">litigated<\/a> several cases involving Harvard. In 2019, she ruled in favor of Harvard when they were sued by Students for Fair Admission over discrimination against Asian students. The Supreme Court overturned her decision in 2023, declaring race-based affirmative action unconstitutional under the 14th Amendment.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-685398363\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Burroughs <a href=\"https:\/\/www.thecrimson.com\/article\/2020\/7\/8\/harvard-mit-sue-immigration-authorities\/\" target=\"_blank\" rel=\"noreferrer noopener\">oversaw<\/a> MIT and Harvard&rsquo;s lawsuit against the Trump administration in 2020. The universities sued the DHS and U.S. Immigration and Customs Enforcement (ICE) when they tried to send home international students who were only taking online classes at American universities during the Covid-19 pandemic. ICE later rolled back this policy without a ruling from Burroughs.<\/p>\n<p>Burroughs, at the <a href=\"https:\/\/api.thecrimson.com\/article\/2025\/4\/23\/allison-burroughs-harvard\/\" target=\"_blank\" rel=\"noreferrer noopener\">request<\/a> of Harvard&rsquo;s attorneys, is also overseeing Harvard&rsquo;s lawsuit against the Trump administration for pulling the university&rsquo;s federal funding. On May 23, she <a href=\"https:\/\/thefederalist.com\/2025\/05\/23\/obama-judge-blocks-dhs-from-revoking-harvards-ability-to-enroll-foreign-students\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a temporary restraining order blocking the effort.<\/p>\n<p>Todd Lyons, the acting director of ICE, gave Harvard 30 days to rebut the DHS&rsquo;s alleged grounds for withdrawing certification from the school&rsquo;s Student Exchange and Visitor Program. In a Wednesday letter to the university director of immigration services, Maureen Martin, Lyons <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/2025-05\/Notice%20of%20Intent%20to%20Withdrawal%20-%20Harvard%20University_signed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">cited<\/a> Harvard&rsquo;s failure to comply with DHS student records requests, failure to curtail violence and antisemitism on campus, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chinas-tencent-profited-off-fraudulent-ppp-loans\/\" title=\"Tencent in China profited from fraudulent PPP loans.\">ongoing national security concerns<\/a> as reasons for the withdrawal. Harvard has been a target of the administration for a variety of infractions since Trump&rsquo;s second term began.<\/p>\n<p>But on Thursday, Burroughs nonetheless <a href=\"https:\/\/www.pbs.org\/newshour\/education\/federal-judge-extends-order-blocking-trump-administration-ban-on-foreign-students-at-harvard\" target=\"_blank\" rel=\"noreferrer noopener\">extended<\/a> her block on the DHS&rsquo;s order to stop Harvard University&rsquo;s enrollment of foreign students and said she <a href=\"https:\/\/www.cbsnews.com\/news\/trump-harvard-foreign-students-ban-30-days-to-reply\/\" target=\"_blank\" rel=\"noreferrer noopener\">plans<\/a> to issue a preliminary injunction.<\/p>\n<p>Burroughs continues to be one of many rogue judges trying to foil the Trump administration.<\/p>\n<p>Though the Supreme Court and Congress seem uninterested in intervening, White House Press Secretary Karoline Leavitt <a href=\"https:\/\/thefederalist.com\/2025\/05\/29\/hemingway-presses-white-house-what-are-you-actually-doing-to-stop-ongoing-judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">insisted<\/a> Thursday that the administration is making efforts to &ldquo;tackle these rogue judges and the injunctions and blockades that we have faced.&rdquo; She clarified that, by the president&rsquo;s direction, the administration will comply with court&rsquo;s orders while fighting them.<\/p>\n<p>On Monday, Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/114574185207174304\" target=\"_blank\" rel=\"noreferrer noopener\">promised<\/a> that he would win a fight with the courts and noted Harvard&rsquo;s blatant judge shopping.<\/p>\n<figure class=\"wp-block-image aligncenter size-full\"><figcaption>\n<div class=\"row no-gutters body-xs m-0 text-start\">\n<div class=\"col-12 col-md-4\"><\/div>\n<div class=\"col-12 col-md-8\">\n<div class=\"article-thumbnail-caption d-flex align-items-center justify-content-md-end label-xs mt-15\">         <i class=\"mdi mdi-camera me-10\" aria-hidden=\"true\"><\/i>         <span class=\"visually-hidden\">Image Credit<\/span><a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/114574185207174304\">@realDonaldTrump \/ Truth.<\/a>       <\/div>\n<\/div>\n<\/div>\n<\/figcaption><\/figure>\n<p>Currently, more than 200 lawsuits <a href=\"https:\/\/apnews.com\/projects\/trump-executive-order-lawsuit-tracker\/\" target=\"_blank\" rel=\"noreferrer noopener\">overseen<\/a> by various district court judges stand between Trump and enacting the agenda that the American people voted for.<\/p>\n<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Jacqueline Annis-Levings is a correspondent for the Federalist.
