Teh tariffs, introduced on April 2, were intended to counter countries that restrict U.S. products and included a universal 10% tariff. Several plaintiffs challenged the tariffs, arguing that the International Emergency Economic Powers act (IEEPA), which Trump cited, does not authorize such measures. They also claimed the ongoing U.S.trade deficit did not constitute an emergency.

The U.S. Court of International Trade sided with the plaintiffs, stating that tariff powers are allocated to Congress and that the IEEPA does not grant the President unbounded authority. Consequently, the court vacated the tariffs and issued a permanent injunction against them. The Trump governance has since appealed, and the Federal Circuit Court has paused the lower court’s ruling, allowing the tariffs to remain in effect while the appeal is considered. The administration has until June 9 to submit its legal brief, with some legal representatives expressing confidence that the eventual ruling will favor the plaintiffs due to the significant harm inflicted by the tariffs on businesses.

A federal appeals court placed a temporary stay Thursday on a lower trade court’s ruling from the previous day that had found that President Donald Trump exceeded his authority by imposing sweeping tariffs last month.

On what he billed as Liberation Day on April 2, Trump announced a universal 10 percent tariff and higher reciprocal tariffs for those countries his administration identified as being particularly egregious in blocking U.S. products from their markets.

The Associated Press reported that there were at least seven plaintiffs who challenged the levies in court.

They argued that the 1977 International Emergency Economic Powers Act that Trump relied on did not authorize the president to impose tariffs.

Further, even if it did, the plaintiffs contended that the record trade deficit of $1.2 trillion in 2024 did not constitute an emergency, pointing out the U.S. has had a trade imbalance for the last 49 years.

if ( getCookie( "ff_subbed" ) ) { document.getElementById("stnvideo").remove() } else { document.addEventListener("DOMContentLoaded", function() { function loadScript(src) { const script=document.createElement("script"); On April 2, which he referred to as “Liberation Day,” Trump declared a universal 10 percent tariff along with increased reciprocal tariffs for countries deemed particularly obstructive to U.S. products. The Associated Press reported that at least seven plaintiffs contested these tariffs in court, arguing that the 1977 International Emergency Economic Powers Act (IEEPA) did not grant the president the power to impose such tariffs. They also claimed that the record trade deficit of $1.2 trillion in 2024 did not represent an emergency, highlighting that the U.S. has experienced a trade imbalance for nearly five decades.

On Wednesday, a three-judge panel from the U.S. Court of International Trade in New York ruled against Trump, stating, “The court does not interpret IEEPA as granting such unlimited authority and nullifies the challenged tariffs.” The judges emphasized that due to constitutional provisions assigning tariff powers to Congress, they do not view IEEPA as delegating unrestricted tariff authority to the President.
