When he attempted to cover part of the message with tape, he was again told to remove the shirt. They emphasized that the First Amendment protects speech based on its content, and Morrison should not have been censored for holding a controversial view. As long as there are schools in America where students are encouraged to&hellip; <a href=\"https:\/\/t.co\/qozVBsgWMt\">pic.twitter.com\/qozVBsgWMt<\/a><\/p>\n<p>&mdash; Kristen Waggoner (@KristenWaggoner) <a href=\"https:\/\/twitter.com\/KristenWaggoner\/status\/1927396177516933447?\">May 27, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Both the federal district court and the First Circuit Court of Appeals <a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/2024-06\/LM-v-Town-of-Middleborough-2024-06-09-Appellate-Ruling.pdf\" target=\"_blank\" rel=\"noopener\">ruled against<\/a> Morrison in a suit he brought against Middleborough, in which he argued his <a href=\"https:\/\/www.westernjournal.com\/watch-jasmine-crockett-shows-doesnt-understand-first-amendment-hearing-meltdown\/\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a> right to free speech was being denied.<\/p>\n<p>The appeals court concluded the school&rsquo;s action was justified in upholding its dress code and no-bullying policy.<\/p>\n<p>&ldquo;We see no reason to substitute our judgment for Middleborough&rsquo;s with respect to its application of its Dress Code here,&rdquo; the First Circuit held.<\/p>\n<p>&ldquo;We conclude the record supports as reasonable an assessment that the message in this school context would so negatively affect the psychology of young students with the demeaned gender identities that it would &lsquo;poison the educational atmosphere&rsquo; &hellip; [and lead to] substantial disruption.&rdquo;<\/p>\n<p>In Alito&rsquo;s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-410_o75p.pdf#page=2\" target=\"_blank\" rel=\"noopener\">dissent<\/a> to the Supreme Court&rsquo;s denial of review, which was joined by <a href=\"https:\/\/www.westernjournal.com\/clarence-thomas-makes-point-day-supreme-court-hears-arguments-birthright-citizenship-case\/\" target=\"_blank\" rel=\"noopener\">Thomas<\/a>, the justice wrote, &ldquo;This case presents an issue of great importance for our Nation&rsquo;s youth: whether public schools may suppress student speech either because it expresses a viewpoint that the school disfavors or because of vague concerns about the likely effect of the speech on the school atmosphere or on students who find the speech offensive.<\/p>\n<p>&ldquo;In this case, a middle school permitted and indeed <a href=\"https:\/\/amzn.to\/3YuVZYV\" >encouraged student expression endorsing<\/a> the view that there are many genders. But when [Morrison], a seventh grader, wore a T-shirt that said &lsquo;There Are Only Two Genders,&rsquo; he was barred from attending class.&rdquo;<\/p>\n<p>Alito argued, quoting court precedent, &ldquo;&lsquo;[A]bove all else, the First Amendment means that government has no power to restrict expression because of its message, its ideas, its subject matter, or its content.&rsquo; Otherwise, the government could purge entire topics from the public discourse.
