Within just hours, like clockwork, a far-left district judge blocked DHS&rsquo;s action.<\/p>\n<p>U.S. District Court Judge Allison D. Burroughs, an appointee of former President Barack Obama serving in Massachusetts, wrote in a <a href=\"https:\/\/www.courtlistener.com\/docket\/70349156\/11\/president-and-fellows-of-harvard-college-v-united-states-department-of\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-page motion<\/a> granting a temporary restraining order that Harvard &ldquo;will sustain immediate and irreparable injury before there is an opportunity to hear from all parties.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-2048717933\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Burroughs set a hearing for May 29 to consider <a href=\"https:\/\/thefederalist.com\/2025\/05\/22\/dhs-revokes-harvards-ability-to-enroll-foreign-students\/\" target=\"_blank\" rel=\"noreferrer noopener\">DHS&rsquo;s revocation<\/a> of its Student and Exchange Visitor Program (SEVP) certification. DHS not only withdrew Harvard&rsquo;s authorization to enroll new foreign students but also indicated that foreign students who are currently enrolled (more than 27 percent of its current student population) will need to transfer schools or lose their legal status in the United States.<\/p>\n<p>DHS Secretary Kristi Noem said, &ldquo;It is a privilege, not a right, for universities to enroll foreign students and benefit from their higher tuition payments to help pad their multibillion-dollar endowments.&rdquo;<\/p>\n<p>Harvard immediately filed suit, and school President Alan Garber <a href=\"https:\/\/www.harvard.edu\/president\/news\/2025\/supporting-our-international-students-and-scholars\/\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> DHS&rsquo;s move part of a &ldquo;series of government actions to retaliate against Harvard for our refusal to surrender our academic independence and to submit to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-judge-grants-gop-lawmaker-standing-to-sue-biden-administration-over-unrwa-funding-washington-examiner\/\" title=\"Texas judge ... GOP lawmaker standing to sue Biden administration over UNRWA funding - Washington Examiner\">federal government&#038;rsquo<\/a>;s illegal assertion of control over our curriculum, our faculty, and our student body.&rdquo; Harvard has 6,793 foreign students, and the school <a href=\"https:\/\/x.com\/Harvard\/status\/1925894571222827394\" target=\"_blank\" rel=\"noreferrer noopener\">claims<\/a> that without those students, &ldquo;Harvard is not Harvard.&rdquo; <\/p>\n<p>DHS said that the decision to stop Harvard&rsquo;s foreign student program was made after Noem asked the school to provide &ldquo;information about the criminality and misconduct of foreign students on its campus,&rdquo; which Harvard has &ldquo;brazenly refused to provide,&rdquo; <a href=\"https:\/\/www.dhs.gov\/news\/2025\/05\/22\/harvard-university-loses-student-and-exchange-visitor-program-certification-pro\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to DHS. Garber claims to have complied.<\/p>\n<p>The Trump administration has been highly critical of Harvard&rsquo;s inability to respond to race discrimination, assaults, diversity, equity, and inclusion (DEI) ideology, and a <a href=\"https:\/\/www.dhs.gov\/news\/2025\/05\/22\/harvard-university-loses-student-and-exchange-visitor-program-certification-pro\" target=\"_blank\" rel=\"noreferrer noopener\">host of other issues<\/a> for some time.<\/p>\n<p>The school had been rejecting compliance with the federal government, claiming it would not &ldquo;relinquish its constitutional rights&rdquo; and would <a href=\"https:\/\/www.harvard.edu\/president\/news\/2025\/the-promise-of-american-higher-education\/\" target=\"_blank\" rel=\"noreferrer noopener\">maintain<\/a> &ldquo;freedom of thought.&rdquo; The Department of Education <a href=\"https:\/\/dailycaller.com\/2025\/04\/15\/harvard-immediately-faces-billions-in-losses-after-refusing-trump-administrations-demands-to-address-antisemitism\/\" target=\"_blank\" rel=\"noreferrer noopener\">revoked<\/a> over $2 billion in grants from the school, and weeks later Education Secretary Linda McMahon <a href=\"https:\/\/thefederalist.com\/2025\/05\/07\/linda-mcmahon-tells-harvard-to-stop-seeking-grant-funding-none-will-be-provided\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the institution not to seek federal grant money, as &ldquo;none will be provided.&rdquo;<\/p>\n<p>McMahon cited even more issues with the school and its failing academic offerings in her letter to Harvard, and the university has also been in the Trump administration&rsquo;s crosshairs for failing to report foreign funding as required by law.<\/p>\n<p>According to an Open the Books <a href=\"https:\/\/openthebooks.substack.com\/p\/56eda56e-a91e-4e84-a772-800806eb03ad?postPreview=paid&amp;updated=2025-04-23T14%3A21%3A07.124Z&amp;audience=everyone&amp;free_preview=false&amp;freemail=true\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> from April,  the school had received $1.1 billion from sources outside the United States since 2017, and the Department of Education <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-initiates-records-request-harvard-university-after-discovering-inaccurate-foreign-financial-disclosures\" target=\"_blank\" rel=\"noreferrer noopener\">initiated<\/a> a records request from the school &ldquo;after <a href=\"https:\/\/amzn.to\/3YuVZYV\" >discovering inaccurate foreign financial disclosures<\/a>.&rdquo;<\/p>\n<p>&ldquo;As a recipient of federal funding, Harvard University must be transparent about its relations with foreign sources and governments. Unfortunately, our review indicated that Harvard has not been fully transparent or complete in its disclosures, which is both unacceptable and unlawful,&rdquo; McMahon said in a press release.&nbsp;&ldquo;This records request is the Trump Administration&rsquo;s first step to ensure Harvard is not being manipulated by, or doing the bidding of, foreign entities, which include actors who are hostile to the interests of the United States and American students.
