The hearing was primarily focused on the Department of Homeland Security’s fiscal year 2026 budget. During the exchange, Hassan asked Noem for a definition of habeas corpus, leading to a debate about the legal protections it offers against unlawful detention. Noem asserted that the president has the constitutional authority to suspend habeas corpus, to which Hassan countered that this has only ever been done with Congressional approval, referencing Abraham lincoln’s historic actions during the Civil War. This discussion resurfaced due to comments from White House officials implying that suspending habeas corpus might be considered for detaining illegal immigrants. The dialog highlights the tension between immigration policy and constitutional rights within the current political climate.

Democratic Sen. This humorous blunder occurred as the committee was meant to review the Department of Homeland Security’s budget for fiscal year 2026. Instead of focusing on the budget, Hassan questioned Noem about legal definitions, asking her what habeas corpus is. Noem responded by stating that it is a constitutional right allowing the president to remove individuals from the country. Hassan quickly corrected her, explaining that habeas corpus requires the government to provide a public justification for detaining individuals and emphasized its importance in distinguishing free societies from oppressive regimes. She pressed Noem on whether she supports this fundamental protection, to which Noem affirmed her support but noted that the president has constitutional authority regarding its suspension. Hassan interrupted again, asserting that such suspensions have historically required congressional approval and referenced Abraham Lincoln’s actions during the Civil War as an example. The discussion gained relevance due to comments from White House deputy chief of staff Stephen Miller about potentially suspending habeas corpus in response to illegal immigration at the border.
