The interim U.S. attorney for New Jersey, Alina Habba, announced that McIver has been charged under Title 18, United States Code, Section 111(a)(1) for her actions during the incident on May 9, wich involved a confrontation with ICE agents. McIver&#8217;s attorney criticized the charges as inappropriate, arguing that her actions were part of her responsibilities as a member of Congress to oversee conditions at the detention center.<\/p>\n<p>In the aftermath of the protest, which included other lawmakers demanding access to the facility, a scuffle ensued, leading to charges against mciver but the dismissal of trespassing charges against Newark&#8217;s mayor, Ras Baraka. Federal officials emphasized that assaults on law enforcement would not be tolerated, asserting the seriousness of the situation. McIver, who recently assumed office, called the charges politically motivated. As a member of Congress, she has the right and responsibility to see how ICE is treating detainees.&rdquo;<\/p>\n<h2>&lsquo;You Will be Prosecuted&rsquo;<\/h2>\n<p>Federal authorities say McIver, who <a href=\"https:\/\/mciver.house.gov\/about\/meet-lamonica\" target=\"_blank\" rel=\"noreferrer noopener\">boasts<\/a> of being the first black woman to represent her district and the youngest to be elected to the House from New Jersey, did not have the right to allegedly attack ICE agents in the May 9 fracas. McIver denies the allegations.&nbsp;<\/p>\n<p>&ldquo;That conduct cannot be overlooked by the chief <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/d-c-mayor-congress-must-open-a-probe-into-security-failures-at-u-s-capitol\/\" title=\"D.C. ...: Congress must open a probe into security failures at U.S. Capitol\">federal law enforcement<\/a> official in the State of New Jersey, and it is my Constitutional obligation to ensure that our federal law enforcement is protected when executing their duties,&rdquo; Habba said in the statement.&nbsp;<\/p>\n<p>The congresswoman, who was <a href=\"https:\/\/newjerseymonitor.com\/briefs\/lamonica-mciver-sworn-in-to-congress-replacing-the-late-donald-payne-jr\/\" target=\"_blank\" rel=\"noreferrer noopener\">elected in September<\/a> to fill out the term of Rep. This Administration will always protect those who work tirelessly to keep America safe. <a href=\"https:\/\/t.co\/v8bMYwtY7i\">https:\/\/t.co\/v8bMYwtY7i<\/a><\/p>\n<p>&mdash; Todd Blanche (@DAGToddBlanche) <a href=\"https:\/\/twitter.com\/DAGToddBlanche\/status\/1924618793294209336?ref_src=twsrc%5Etfw\">May 20, 2025<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Prosecutors <a href=\"https:\/\/www.foxnews.com\/politics\/federal-charges-filed-against-dem-congresswoman-following-confrontation-ice-facility\" target=\"_blank\" rel=\"noreferrer noopener\">told <\/a>Fox News that McIver faces several felony charges, and must soon turn herself in to law enforcement authorities.&nbsp;<\/p>\n<p>Habba said she has given &ldquo;McIver every opportunity to come to a resolution&rdquo; without the step of bringing criminal charges, but the representative &ldquo;has unfortunately declined.&rdquo;&nbsp;<\/p>\n<p>She noted that after &ldquo;extensive consideration,&rdquo; her office agreed to drop the trespass charges against the mayor &ldquo;for the sake of moving forward.&rdquo; The prosecutor said she has invited Baraka to tour the detention facility, adding that &ldquo;the government has nothing to hide.&rdquo;&nbsp;<\/p>\n<h2>Mostly &lsquo;Peaceful&rsquo;<\/h2>\n<p>On May 9, McIver joined fellow New Jersey Dem Reps. Bonnie Watson Coleman and Rob Menendez in their protest\/fact-finding mission. They invited Baraka, who had previously been denied entrance, to come with them. They loudly demanded federal officials let them into the detention facility so they could inspect conditions, the lawmakers claimed. The politicians were the center of an organized demonstration. They were ultimately granted entry.&nbsp;<\/p>\n<p>As Newsweek <a href=\"https:\/\/www.newsweek.com\/alina-habba-weighs-charging-lamonica-mciver-newark-ice-2074417\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, a &ldquo;scuffle soon broke out between <a href=\"https:\/\/www.newsweek.com\/topic\/ice\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Immigration and Customs Enforcement (ICE<\/a>) agents, protesters at the entrance and the four Democrats. Baraka was subsequently arrested and taken into custody by ICE.&rdquo;&nbsp;<\/p>\n<p>McIver claims that she and her colleagues sought a &ldquo;peaceful and short&rdquo; visit, despite their very public attempts to gin up outrage over the Trump administration&rsquo;s attempts to enforce U.S. immigration law. They have <a href=\"https:\/\/watsoncoleman.house.gov\/newsroom\/press-releases\/reps-watson-coleman-menendez-mciver-lead-bicameral-charge-against-expansion-of-private-ice-detention-in-new-jersey\" target=\"_blank\" rel=\"noreferrer noopener\">accused<\/a> the administration of &ldquo;lean[ing] into chaos, confusion, and cruelty.&nbsp;<\/p>\n<p>McIver isn&rsquo;t the first leftist public official charged with interfering with federal law enforcement of immigration laws. <a href=\"https:\/\/thefederalist.com\/2025\/05\/15\/delusional-leftists-compare-judge-indicted-for-helping-illegal-evade-arrest-to-harriet-tubman\/\" target=\"_blank\" rel=\"noreferrer noopener\">Last week<\/a>, Milwaukee County Circuit Court <a href=\"https:\/\/thefederalist.com\/2025\/04\/28\/milwaukee-judge-charged-with-putting-herself-above-the-law-by-rejecting-rule-of-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">Judge Hannah Dugan<\/a> was indicted by a federal grand jury after the Department of Justice accused her of knowingly concealing an illegal alien from arrest and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/indicted-judge-is-no-hero-and-certainly-no-harriet-tubman\/\" title=\"Indicted Judge Is No Hero, And Certainly No Harriet Tubman\">obstructing federal law enforcement proceedings<\/a>. Dugan, who pleaded not guilty, allegedly helped <a href=\"http:\/\/Eduardo%20Flores-Ruiz\" target=\"_blank\" rel=\"noreferrer noopener\">Eduardo Flores-Ruiz<\/a> briefly escape arrest via an exit not accessible to the general public. Eduardo Flores-Ruiz, a Mexican national who had previously been deported, was in court and scheduled to appear before Dugan to face charges of battery in the beating of two people at a Milwaukee residence, according to the <a href=\"https:\/\/www.courtlistener.com\/docket\/69943125\/1\/united-states-v-dugan\/\" target=\"_blank\" rel=\"noreferrer noopener\">criminal complaint.<\/a>&nbsp;<\/p>\n<p>About the same time Dugan was being arrested, former New Mexico Magistrate Judge Jose Luis &ldquo;Joel&rdquo; Cano was <a href=\"https:\/\/apnews.com\/article\/new-mexico-judge-arrested-venezuelan-gang-gun-360d4ec8ba6676fbf33abcb606c3f104\" target=\"_blank\" rel=\"noreferrer noopener\">apprehended<\/a> in an evidence tampering case. He allegedly assisted an illegal immigrant suspected of being a member of a notorious Venezuelan gang.&nbsp;<\/p>\n<p>&ldquo;No one is above the law &mdash; politicians or otherwise,&rdquo; Habba said in the statement on the charges being filed against the New Jersey congresswoman. &ldquo;It is the job of this office to uphold justice impartially, regardless of who you are.
