Backs Teacher Ousted for Rejecting Trans Policies\">lower court&#8217;<\/a>s ruling, wich had blocked the Department of homeland Security from revoking TPS. The Trump administration contended that the previous Biden administration&#8217;s extension of TPS for Venezuelans-issued just before Trump took office-was unwarranted adn that the matter should be fully reassessed. The National TPS Alliance, representing those affected, sued the administration, alleging the termination was based on race. The Supreme Court&#8217;s ruling now opens the door for possible deportations of TPS holders, which has raised concerns about potential disruptions in their lives and financial implications for the economy. Only Justice Ketanji Brown Jackson dissented. TPS permits migrants to work and live in the country if their native country is deemed unsafe. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-367482580\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The Supreme Court&rsquo;s decision could mean some 350,000 Venezuelans can be deported. <\/p>\n<p>As reported by The Federalist&rsquo;s <a href=\"https:\/\/thefederalist.com\/2025\/05\/14\/here-are-16-of-the-most-egregious-injunctions-barring-the-trump-administration-from-doing-its-job\/\" target=\"_blank\" rel=\"noreferrer noopener\">Breccan Thies<\/a>, three days before President Trump took office, then DHS Secretary Alejandro Mayorkas extended the TPS designation for Venezuelans living in the country. The <a href=\"https:\/\/www.courthousenews.com\/supreme-court-nixes-protective-status-for-venezuelan-migrants\/\" target=\"_blank\" rel=\"noreferrer noopener\">extension<\/a> was for 18 months. Noem then &ldquo;vacated the <a href=\"https:\/\/www.uscis.gov\/humanitarian\/temporary-protected-status\/temporary-protected-status-designated-country-venezuela\" target=\"_blank\" rel=\"noreferrer noopener\">extension<\/a> and subsequently <a href=\"https:\/\/iptp-production.s3.amazonaws.com\/media\/documents\/2025-02294.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">terminated<\/a> TPS for Venezuelans who had registered for it in 2023,&rdquo; Thies reported.<\/p>\n<p>In response &ldquo;National TPS Alliance, an organization representing those with TPS, and a group of Venezuelans turned around and sued the Trump administration.&rdquo; The suit alleged the termination of TPS was race-based &mdash; without considering that the United States has the right to decide which foreigners are admitted into the United States.<\/p>\n<p>The Trump administration argued in a subsequent <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.444868\/gov.uscourts.cand.444868.122.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">motion<\/a> that Mayorkas &ldquo;failed, among other things, to evaluate the key statutory question: whether permitting Venezuelan and Haitian nationals to remain temporarily in the United States is &lsquo;contrary to the national interest.&rsquo;&rdquo;<\/p>\n<p>An Obama-appointed judge issued a nationwide injunction, and the Ninth Circuit rejected an <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.444868\/gov.uscourts.cand.444868.94.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">appeal<\/a> by the Trump administration. While the protections were &ldquo;set to expire on April 7,&rdquo; the judge, as described by the <a href=\"https:\/\/apnews.com\/article\/supreme-court-venezuelans-deportation-trump-5589f17e0ecd5d33bfb220e15720f88d?taid=682b60f482851900015e84bd&amp;utm_campaign=TrueAnthem&amp;utm_medium=AP&amp;utm_source=Twitter\" target=\"_blank\" rel=\"noreferrer noopener\">Associated Press<\/a>, found that &ldquo;the expiration threatened to severely disrupt the lives of hundreds of thousands of people and could cost billions in lost economic activity.&rdquo;<\/p>\n<p>The Trump administration contended that the ruling from the lower court amounted to judicial overreach, an issue that has plagued Trump&rsquo;s first few months in office.<\/p>\n<p>On Thursday, however, Supreme Court Justice Clarence Thomas&rsquo; questions hinted that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-still-discriminating-against-white-farmers-even-after-courts-ruled-it-was-unconstitutional\/\" title=\"Biden ... Still Discriminating Against White Farmers Even After ...s Ruled It Was Unconstitutional\">nationwide injunctions<\/a> are constitutional. During oral arguments over the issue of nationwide injunctions on Trump&rsquo;s birthright citizenship order, Thomas asked U.S. Solicitor General John Sauer about the history of these injunctions. (The injunctions, as <a href=\"https:\/\/thefederalist.com\/2025\/05\/15\/justice-thomas-exposes-the-absurdity-of-nationwide-injunctions-with-one-simple-question\/\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by The Federalist&rsquo;s Shawn Fleetwood, &ldquo;seek to prohibit the federal government from implementing a certain law or policy against all applicable persons, regardless of whether those individuals are parties to the case before the court.&rdquo;)<\/p>\n<p>&ldquo;Thomas asked Sauer &hellip; about the history of nationwide injunctions,&rdquo; Fleetwood wrote. Sauer then cited Thomas&rsquo; 2018 concurring opinion in <em>Trump v. Hawaii<\/em> in which Thomas noted <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-sets-stage-for-crackdown-on-nationwide-injunctions-washington-examiner\/\" title=\"Supreme ... sets stage for crackdown on ... - Washington Examiner\">nationwide injunctions &#038;ldquo<\/a>;did not emerge until a century and a half after the founding.&rdquo; Thomas also argued in the 2018 opinion that nationwide injunctions &ldquo;appear to be inconsistent with longstanding limits on equitable relief and the power of Article III courts.&rdquo;<\/p>\n<p>&ldquo;So we survived until the 1960s without universal injunctions?&rdquo; Thomas asked. <\/p>\n<p>&ldquo;That&rsquo;s exactly correct,&rdquo; Sauer replied, noting the use of these injunctions &ldquo;exploded in 2007.&rdquo;<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Brianna Lyman is an elections correspondent at The Federalist.
