The March order had been justified by the Trump management citing the Civil Service Reform Act of 1978 and national security. Following the issuance of the order, lawsuits were filed against it. Circuit ruled 2-1 in favor of staying the lower court&rsquo;s ruling. The Friday decision allows the order to be unfrozen, but it noted that the government said it would not terminate any collective-bargaining agreements until after lawsuits surrounding the legality of the order have been resolved.<\/p>\n<p>&ldquo;The Union asserts that without a preliminary injunction it will lose bargaining power and suffer reputational harm that will deter present and future membership,&rdquo; the majority opinion <a href=\"https:\/\/media.cadc.uscourts.gov\/orders\/docs\/2025\/05\/25-5157LDSN2.pdf\" target=\"_blank\" rel=\"noopener\" title=\"said\">said<\/a>.<\/p>\n<p>&ldquo;But those harms are speculative because they would materialize only after an agency terminates a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mlb-cancels-opening-day-first-two-regular-season-series-after-mlbpa-rejects-final-proposal\/\" title=\"MLB Cancels Opening Day, First Two Regular Season Series After MLBPA Rejects \u2018Final Proposal\u2019\">collective-bargaining agreement<\/a>, and the Government directed agencies to refrain from terminating collective-bargaining agreements or decertifying bargaining units until after the litigation concludes,&rdquo; the Friday ruling continued.<\/p>\n<p>The court&rsquo;s opinion did not address the merits of the argument, but only found that the lower district court erred by giving an injunction when there was no evidence of irreparable harm to the union.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3414307\/supreme-court-pauses-deportations-alien-enemies-act-texas\/\" target=\"_blank\" rel=\"noopener\" title=\"SUPREME COURT PAUSES DEPORTATIONS UNDER ALIEN ENEMIES ACT IN TEXAS\">SUPREME COURT PAUSES DEPORTATIONS UNDER ALIEN ENEMIES ACT IN TEXAS<\/a><\/strong><\/p>\n<p>&ldquo;Because the district court&rsquo;s preliminary injunction is likely to be vacated for lack of irreparable harm, we need not address the Government&rsquo;s arguments regarding the Union&rsquo;s likelihood of success on the merits,&rdquo; the opinion said.<\/p>\n<p>The order on collective bargaining is the latest to go through legal challenges, as the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >president faces intense legal scrutiny<\/a> for most of his executive actions.
