CASA concerns whether federal district courts have the power to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >impose nationwide injunctions blocking presidential decisions<\/a>.<\/p>\n<p>On his first day in office in January, Trump <a href=\"https:\/\/www.westernjournal.com\/trump-emergency-request-works-supreme-court-schedules-rare-hearing\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> an executive order interpreting the language of the 14th Amendment, which states only those born to parents &ldquo;subject to the jurisdiction&rdquo; of the United States are citizens.<\/p>\n<p>The impact would be that when children are born to people who are not legal residents, the children are not U.S. citizens.<\/p>\n<p>Several lawsuits were filed around the country seeking to block the implementation of Trump&rsquo;s order. And in fact, those were very limited, very rare, even in the 1960s,&rdquo; Sauer responded. &ldquo;It really exploded in 2007.&rdquo;<\/p>\n<p>Court watchers do not have a good sense of how the justices will ultimately rule on the matter following Thursday&rsquo;s oral arguments.<\/p>\n<p>Amy Howe wrote for <a href=\"https:\/\/www.scotusblog.com\/2025\/05\/no-clear-decision-emerges-from-arguments-on-judges-power-to-block-trumps-birthright-citizenship-order\/\" target=\"_blank\" rel=\"noopener\">SCOTUSBlog<\/a> that the high court was &ldquo;divided over whether a federal judge has the power to block President Donald Trump&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lefty-journos-melt-down-over-trumps-2nd-inauguration\/\" title=\"Lefty Journos Melt Down Over ...&#039;s 2nd Inauguration\">executive order ending birthright citizenship<\/a> while the case moves through the lower courts.&rdquo;<\/p>\n<p><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/15\/supreme-court-oral-arguments-birthright-citizenship-live-updates\/83628869007\/\" target=\"_blank\" rel=\"noopener\">USA Today<\/a> reported that several of the justices appeared to be probing Sauer, looking to find a good alternative to the nationwide <a href=\"https:\/\/www.westernjournal.com\/bill-barr-used-one-figure-prove-nationwide-injunctions-problem\/\" target=\"_blank\" rel=\"noopener\">injunction<\/a>.<\/p>\n<p>The lawyer offered one alternative, in many cases, would be a class action lawsuit under current federal court rules. Once a judge establishes a class of people impacted by an executive order, then any person in the class can benefit from the ultimate decision in the case.<\/p>\n<p>Something clearly has to give. A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-supreme-court-to-decide-on-hearing-suit-declaring-all-male-draft-discriminatory\/\" title=\"Report: Supreme Court to Decide on Hearing Suit Declaring All-Male Draft Discriminatory\">federal district court judge<\/a> should not have more power than the president to decide national policy.<\/p>\n<p>Only the Supreme Court has national jurisdiction to decide if a president&rsquo;s policy runs afoul of federal law or the Constitution.
