This decision came in response to a challenge from Planned Parenthood, which claimed that the law&#8217;s language was ambiguous and allowed for abortions until nine weeks. Thus, it seems unlikely that abortion providers at Planned Parenthood have been left to &lsquo;guess as to its meaning,&rsquo;&rdquo; the judges said in their<a href=\"https:\/\/www.sccourts.org\/media\/opinions\/HTMLFiles\/SC\/28280.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\"> opinion<\/a>.<\/p>\n<p>The law does not state the exact point in pregnancy when the ban can begin to be enforced, but it says abortions are prohibited after a heartbeat is detected. Exceptions to the law include rape or incest during the first 12 weeks of pregnancy, medical emergencies, and fatal fetal anomalies.<\/p>\n<p>The ban can be enforced &ldquo;after an ultrasound can <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/obama-appointed-judge-issues-order-blocking-texas-law-that-protects-unborn-babies\/\" title=\"Obama-Ap...ed Judge Issues Order Blocking Texas Law That Protects Unborn Babies\">detect cardiac activity<\/a> or the steady and repetitive rhythmic contraction of the fetal heart within the gestational sac,&rdquo; according to the law.<\/p>\n<p>Planned Parenthood argued that because the heart is not fully developed at that point, the ban should not take effect until the ninth week due to the language about the &ldquo;repetitive rhythmic contraction of the fetal heart.&rdquo;<\/p>\n<p>However, in addition to pointing to<a href=\"https:\/\/aboutblaw.com\/8eC\" target=\"_blank\" rel=\"noopener\" title=\"\"> evidence<\/a> that Planned Parenthood previously believed the ban could take effect at six weeks, the South Carolina Supreme Court said everyone in the state legislature who has debated, backed, or criticized the law interpreted it to prohibit abortions around the six-week mark.&nbsp;<\/p>\n<p>&ldquo;We could find not one instance during the entire 2023 legislative session in which anyone connected in any way to the General Assembly framed the Act as banning abortion after approximately nine weeks,&rdquo; Associate Justice John Few said.<\/p>\n<p>Gov.
