The lawsuit, backed by the ACLU, had claimed that DHS unlawfully deported the U.S. citizen. However, DHS clarified that the mother, who was illegally in the U.S., made the decision to take her child with her when she was removed from the country.DHS stated that the mother, Jenny Carolina Lopez-Villela, had illegally entered the U.S. multiple times and had a final order of removal issued in March 2020.<\/p>\n<p>Lopez-Villela&#8217;s attorney indicated that the family decided to withdraw the suit to consider their options and prioritize their children&#8217;s safety and well-being following their experiences. Their mothers, who are illegally in this country, were deported. The children went with their mothers. Those children are U.S. citizens. They can come back into the United States, if there&rsquo;s their father or someone here who wants to assume them,&rdquo; he added.<\/p>\n<p>&ldquo;You guys make it sound like ICE agents kicked down the door and grabbed the two-year-old and threw him on an airplane. That&rsquo;s misleading. That&rsquo;s just not true.&rdquo;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The headline about three U.S. citizens ages 7, 4, and 2 being deported was very misleading.<\/p>\n<p>It was their mothers, who were in this country illegally, who were deported.
