He was arrested in March at his New York City apartment and has been detained without criminal charges. The administration says his activism and public criticism of Israel amid the Gaza war pose a foreign policy threat.<\/p>\n<p>&ldquo;The foreign policy of the United States champions core American interests and American citizens and condoning anti-Semitic conduct and disruptive protests in the United States would severely undermine that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mahmoud-khalils-lawyers-seek-rubio-testimony-to-expand-on-dhs-evidence-washington-examiner\/\" title=\"...\u2019s lawyers seek Rubio testimony to expand on DHS evidence - Washington Examiner\">significant foreign policy objective<\/a>,&rdquo; Rubio <a href=\"https:\/\/theconversation.com\/lawful-permanent-residents-like-mahmoud-khalil-have-a-right-to-freedom-of-speech-but-does-that-protect-them-from-deportation-254042\" target=\"_blank\" rel=\"noopener\" title=\"\">wrote<\/a> in a memorandum last month detailing the administration&rsquo;s basis for deporting Khalil.<\/p>\n<p>Farbiarz&rsquo;s order comes after an immigration judge in Louisiana <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3378399\/judge-rules-trump-administration-deport-mahmoud-khalil\/\" target=\"_blank\" rel=\"noopener\" title=\"\">ruled<\/a> last month that the government could deport Khalil based on Rubio&rsquo;s memo describing Khalil&rsquo;s role in antisemitic protests on U.S. campuses. Farbiaz separately ruled last month that Khalil can still challenge his detention before his court.<\/p>\n<p>Khalil&rsquo;s lawyers argue the case improperly conflates domestic protests with foreign policy concerns and violates his free speech rights.<\/p>\n<p>Despite the rare use of the immigration statute in Khalil&rsquo;s case, one notable use was in 1995 against Mexican official Mario Ruiz Massieu, which Trump&rsquo;s sister, the late U.S. District Judge Maryanne Trump Barry, <a href=\"https:\/\/reason.com\/volokh\/2025\/03\/24\/what-the-honorable-maryann-trump-barry-said-about-the-ability-of-the-secretary-of-state-to-order-the-deportation-of-individuals-lawfully-present-in-the-u-s\/\" target=\"_blank\" rel=\"noopener\" title=\"\">ruled unconstitutional<\/a> in 1996.
