The injunction had been temporarily put in place by a U.S. District Court judge, appointed by president Bush.<\/p>\n<p>The Court&#8217;s majority held that the lower court had overstepped its authority in <a href=\"https:\/\/amzn.to\/3YuVZYV\" >determining military service eligibility<\/a>, emphasizing deference to the military&#8217;s professional judgments. Justices Sotomayor, Kagan, and Jackson dissented from the decision.<\/p>\n<p>The Trump administration argued that the injunction violated its executive authority, noting that the previously stayed policies regarding transgender individuals in the military had similarities to the current one. This ruling allows the policy to stand unless the Supreme Court decides not to take up the case or issues a further judgment. Associate Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson would have denied the administration&rsquo;s request. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-760321370\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>According to the <a href=\"https:\/\/x.com\/kyledcheney\/status\/1919815679458320553\" target=\"_blank\" rel=\"noreferrer noopener\">one-page order<\/a> released on Tuesday, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-moves-up-deadline-for-supreme-court-briefing-in-pennsylvania-lawsuit-to-flip-the-election\/\" title=\"Justice Alito Moves Up Deadline For Supreme Court Briefing in Pennsylvania Lawsuit to Flip the Election\">lower court&#038;rsquo<\/a>;s injunction is paused while the case is on appeal at the 9th Circuit Court of Appeals. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-overturns-chevron-doctrine-upends-administrative-state\/\" title=\"SCOTUS Overturns Chevron Doctrine, Upends Administrative State\">high court&#038;rsquo<\/a>;s stay will also remain in place should the 9th Circuit rule against the Trump administration and the federal government subsequently ask SCOTUS to review the merits of the case.<\/p>\n<p>The stay will end if SCOTUS declines to take up the case. If the high court agrees to consider it, however, &ldquo;the stay shall terminate upon the sending down of the judgement&rdquo; from the high court.<\/p>\n<p>A week after taking office, President Trump issued an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/prioritizing-military-excellence-and-readiness\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> declaring that the &ldquo;medical, surgical, and mental health constraints on individuals with gender dysphoria&rdquo; is &ldquo;inconsistent&rdquo; with the &ldquo;high standards for troop readiness, lethality, cohesion, honesty, humility, uniformity, and integrity.&rdquo; The directive instructed Defense Secretary Pete Hegseth to update the military&rsquo;s medical standards within 60 days of the order&rsquo;s issuance to reflect the president&rsquo;s guidance, which Hegseth <a href=\"https:\/\/thefederalist.com\/2025\/03\/19\/biden-judge-blocking-the-militarys-trans-policy-donated-thousands-to-democrat-candidates-causes\/\" target=\"_blank\" rel=\"noreferrer noopener\">did in early February<\/a>. <\/p>\n<p>In its <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2025\/04\/24A1030.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency request<\/a> asking SCOTUS to block the lower court&rsquo;s universal injunction, the Trump administration argued that the issuance of the injunction &ldquo;usurp[ed] the Executive Branch&rsquo;s authority to determine who may serve in the Nation&rsquo;s armed forces.&rdquo; It also noted that the lower court did this despite the Supreme Court &ldquo;previously staying injunctions against&rdquo; the first Trump administration&rsquo;s military &ldquo;trans&rdquo; policy, which the agency contended is &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-asks-scotus-to-stay-injunction-on-military-trans-policy\/\" title=\"... Asks SCOTUS To Stay ... On Military &#039;Trans&#039; ...\">materially indistinguishable&#038;rdquo<\/a>; from the one adopted by the Pentagon earlier this year.<\/p>\n<p>&ldquo;The district court&rsquo;s injunction cannot be squared with the substantial deference that the Department&rsquo;s professional military judgments are owed. Nor can the court&rsquo;s injunction be squared with this Court&rsquo;s decisions to stay the injunctions against the [2018] Mattis policy,&rdquo; the application reads. &ldquo;In staying those injunctions, this Court necessarily determined that the government was likely to succeed in defending the Mattis policy on the merits.
