This decision temporarily pauses a previous ruling from Wake County Superior Court that blocked the law. The appeals court’s unanimous ruling enables Boliek to appoint members to the elections board, which is typically composed of five members from both the ruling and minority parties. Boliek has already made three appointments, ensuring that three members are from the Republican Party.

Governor Josh Stein,a democrat, criticized this ruling and plans to appeal to the state Supreme Court, claiming it undermines democracy and law. He expressed concerns that the ruling is part of a partisan strategy to influence the outcomes of pending elections, especially regarding the Supreme Court race where a Republican candidate has contested the eligibility of manny ballots. Stein argues that changing the rules after an election is over poses a threat to democratic processes.

North Carolina appeals court allows law stripping governor of elections board appointments

The North Carolina Court of Appeals paved the way for a law removing appointment power to the state elections board from Gov.
