Mike Lee (R-UT) called it baffling, saying, &ldquo;I cannot fathom the justification for a judicial order prohibiting the Border Patrol from arresting illegal aliens without a warrant.&rdquo; <\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Federal judge orders Border Patrol *not* to arrest illegal aliens without a warrant&mdash;even though federal law specifically authorizes them to do so<\/p>\n<p>My fellow Americans, we have a problem <\/p>\n<p>It couldn&rsquo;t be more serious <br \/> <a href=\"https:\/\/t.co\/V57MTUdDeH\">pic.twitter.com\/V57MTUdDeH<\/a> <a href=\"https:\/\/t.co\/t4744jFyj3\">https:\/\/t.co\/t4744jFyj3<\/a><\/p>\n<p>&mdash; Mike Lee (@BasedMikeLee) <a href=\"https:\/\/twitter.com\/BasedMikeLee\/status\/1917608512751874497?ref_src=twsrc%5Etfw\">April 30, 2025<\/a><\/p><\/blockquote>\n<p> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>    <\/p>\n<p>The ruling, however, does not block the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/dhs\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Department of Homeland Security<\/a> from conducting warrantless arrests outright; it seeks to reaffirm existing legal standards that agents must already follow: having &ldquo;reasonable suspicion&rdquo; before stopping an individual and &ldquo;probable cause&rdquo; they may flee before a warrant is obtained.<\/p>\n<p>&ldquo;Border Patrol is enjoined from conducting detentive stops &hellip; unless, pre-stop, the detaining agent has reasonable suspicion that the person &hellip; is a noncitizen who is present &hellip; in violation of U.S. immigration law,&rdquo; Thurston&rsquo;s order states.<\/p>\n<p>The judge, however, did set certain parameters that critics might see as overly burdensome on DHS&rsquo;s obligations, such as requiring documentation of such stops every 60 days.<\/p>\n<figure class=\"wp-block-image size-full\"><\/figure>\n<p>Margot Cleveland, of counsel at the New Civil Liberties Alliance and a senior legal reporter at the <em>Federalist,<\/em> suggested in a post on X that Thurston&rsquo;s order &ldquo;is being misreported.&rdquo;<\/p>\n<p>&ldquo;Lots of screaming is merited by coup by court, but this decision isn&rsquo;t one meriting meltdown,&rdquo; Cleveland <a href=\"https:\/\/x.com\/ProfMJCleveland\/status\/1917693785481339121\" target=\"_blank\" rel=\"noopener\" title=\"\">wrote<\/a>.
