He criticized the court for issuing this order before the U.S. 5th Circuit Court of Appeals had reached a decision on the matter. Alito, joined by Justice Clarence Thomas, expressed concern that the Supreme Court acted too quickly and without sufficient evidence regarding the imminent danger faced by the detainees, as claimed by their attorneys.<\/p>\n<p>In his dissent, Alito pointed out that the court typically does not issue emergency stays until lower courts have made a determination, unless unusual circumstances warrant it.He also cited issues with the claim that the detainees were facing urgent removal without solid support for that assertion. alito criticized the court&#8217;s decision to grant <a href=\"https:\/\/amzn.to\/3YuVZYV\">class-wide relief<\/a>, which he argued had not been certified by the district court.<\/p>\n<p>The Supreme Court had previously ruled that the Trump administration had the authority to deport detainees under the Alien Enemies Act, but stated that such detainees were entitled to notice and a chance to challenge their deportations. This Court, however, refused to wait,&rdquo; Alito wrote in his <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a1007_22p3.pdf\" target=\"_blank\" rel=\"noopener\">5-page dissent<\/a>.<\/p>\n<p>He pointed out that under the SCOTUS&rsquo;s rules, the justices are not to consider an emergency stay until the lower court has decided on the matter &ldquo;except in the most extraordinary circumstances.&rdquo;<\/p>\n<p>Alito recounted that the <a href=\"https:\/\/www.westernjournal.com\/trump-emergency-request-works-supreme-court-schedules-rare-hearing\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> issued its order based on the claims of the Venezuelans&rsquo; attorneys from the <a href=\"https:\/\/www.nytimes.com\/2025\/04\/20\/us\/politics\/alito-supreme-court-dissent-alien-enemies-act.html\" target=\"_blank\" rel=\"noopener\">American Civil Liberties Union<\/a> alone that their clients were &ldquo;in imminent danger of removal,&rdquo; but &ldquo;provided little concrete support for that allegation.&rdquo;<\/p>\n<p>Alito also highlighted that SCOTUS granted a class-wide relief, despite the district court not certifying the plaintiffs represent an entire class of people, nor that those seeking habeas relief (i.e., an opportunity to challenge their custody in court) can even do so as a class.<\/p>\n<p>&ldquo;In sum, literally in the middle of the night, the Court issued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order,&rdquo; Alito wrote.<\/p>\n<p>&ldquo;I refused to join the Court&rsquo;s order because we had no good reason to think that, under the circumstances, issuing an order at midnight was necessary or appropriate,&rdquo; he added.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Justice Alito&rsquo;s dissent is &#128293; <a href=\"https:\/\/t.co\/1MqHYhPea9\">pic.twitter.com\/1MqHYhPea9<\/a><\/p>\n<p>&mdash; Mike Lee (@BasedMikeLee) <a href=\"https:\/\/twitter.com\/BasedMikeLee\/status\/1913961915279425857?\">April 20, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&ldquo;Both the Executive and the Judiciary have an obligation to follow the law. The Executive must proceed under the terms of our order in Trump v. J. G. G., 604 U. S. ___ (2025) (per curiam), and this Court should follow established procedures,&rdquo; Alito concluded.<\/p>\n<p>Earlier this month, in a 5-4 ruling, the Supreme Court <a href=\"https:\/\/www.westernjournal.com\/trump-admin-scores-second-scotus-win-allowing-move-forward-deportations\/\" target=\"_blank\" rel=\"noopener\">held<\/a> that the Trump administration had the authority to deport detainees under the Alien Enemies Act.<\/p>\n<p>But the court said &ldquo;that the detainees subject to removal orders under the AEA are entitled to notice and an opportunity to challenge their removal. The only question is which court will resolve that challenge.&rdquo;<\/p>\n<p>Conservative Justice <a href=\"https:\/\/www.westernjournal.com\/roberts-coney-barrett-defect-force-trump-admin-spend-money-us-doesnt\/\" target=\"_blank\" rel=\"noopener\">Amy Coney Barrett<\/a> sided with the liberal wing of the court, opposing the ruling.<\/p>\n<p>In Saturday&rsquo;s order, Chief Justice John Roberts, Justice Brett Kavanaugh, along with Barrett and the liberal justices, all supported blocking the deportations, at least temporarily.<\/p>\n<p><a href=\"https:\/\/www.scotusblog.com\/2025\/04\/justices-temporarily-bar-government-from-removing-venezuelan-men-under-alien-enemies-act\/\" target=\"_blank\" rel=\"noopener\">SCOTUS Blog<\/a> reported that Trump Solicitor &nbsp;D.
