Michael Haas has stepped in as acting clerk following Witzel-Behl&#8217;s resignation as the city searches for a permanent replacement.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>With her office facing an unprecedented <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">state investigation<\/a> over uncounted ballots in November&rsquo;s election, <a href=\"https:\/\/www.cityofmadison.com\/clerk\/contact\" target=\"_blank\" rel=\"noreferrer noopener\">Madison City Clerk Maribeth Witzel-Behl<\/a> is stepping down from the leadership post she&rsquo;s held for nearly 20 years.&nbsp;<\/p>\n<p>A city official tells The Federalist the controversial clerk was not forced to resign, but a Wisconsin elections official believes otherwise.&nbsp;<\/p>\n<p>Witzel-Behl had been on paid administrative leave following revelations that elections officials in Wisconsin&rsquo;s leftist capital city had failed to count 193 absentee ballots cast in November&rsquo;s presidential contest. Even the Wisconsin Elections Commission&rsquo;s Democrat chairwoman described the &ldquo;oversight&rdquo; as <a href=\"https:\/\/wiseye.org\/2025\/01\/02\/wisconsin-elections-commission-special-meeting-35\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;egregious.&rdquo;<\/a>&nbsp;<\/p>\n<p>At a <a href=\"https:\/\/wiseye.org\/2025\/01\/02\/wisconsin-elections-commission-special-meeting-35\/\" target=\"_blank\" rel=\"noreferrer noopener\">special meeting<\/a> in early January, the WEC unanimously <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> (6-0) to open the investigation, bypassing the common practice of waiting for an outside complaint.&nbsp;<\/p>\n<p>&ldquo;I felt it was important that the commission act promptly and also that we use the powers that we have to get out the information we want,&rdquo; Commission Chairwoman Ann Jacobs, a highly partisan Democrat, <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> at the meeting.&nbsp;<\/p>\n<p>In March, the commission took the further step of ordering depositions of Witzel-Behl and other Madison election officials. They want to know why it took more than a month-and-a-half for the scores of uncounted ballots to be brought to the WEC&rsquo;s attention.<\/p>\n<p>Last month, Madison&rsquo;s Human Resources Department opened an internal investigation on Witzel-Behl&rsquo;s performance record, and far-left Madison <a href=\"https:\/\/www.cityofmadison.com\/mayor\" target=\"_blank\" rel=\"noreferrer noopener\">Mayor Satya Rhodes-Conway<\/a> put the clerk on administrative leave.&nbsp;<\/p>\n<p>&ldquo;Given the nature of the issues being investigated, we felt this was a necessary step to maintain public confidence in the operations of our Clerk&rsquo;s office,&rdquo; the mayor <a href=\"https:\/\/www.cityofmadison.com\/news\/2025-03-12\/announcement-regarding-clerks-office\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> at the time.&nbsp;<\/p>\n<p>City spokesman Dylan Brogan told The Federalist the internal investigation was suspended upon the clerk&rsquo;s resignation. He said <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/19\/ii\/356\" target=\"_blank\" rel=\"noreferrer noopener\">state law<\/a> prevents the release of the probe&rsquo;s report until Witzel-Behl has an opportunity to review the findings. Brogan said the report could be released by the end of the month. &nbsp;<\/p>\n<h2>&lsquo;Significantly Undermined Our Confidence&rsquo;<\/h2>\n<p>With pressure on multiple fronts, including a <a href=\"https:\/\/thefederalist.com\/2025\/03\/08\/leftist-lawfare-firm-sues-democrat-run-wisconsin-city-for-disenfranchising-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> filed against the city by a Madison-based lawfare firm seeking class-action status and $175,000 in damages for each plaintiff, the writing may have been on the wall for the embattled city official. <a href=\"https:\/\/elections.wi.gov\/about-wec\/members-and-administrator\" target=\"_blank\" rel=\"noreferrer noopener\">Bob Spindell<\/a>, one of three Republican-appointed members on the six-member Wisconsin Elections Commission, believes Witzel-Behl was forced out.&nbsp;<\/p>\n<p>&ldquo;Or she got to the point where she thought this stuff is not worth it anymore. Being a clerk, it&rsquo;s not easy,&rdquo; Spindell told The Federalist in an interview Tuesday.&nbsp;<\/p>\n<p>In her brief resignation letter, submitted to Rhodes-Conway on April 5, Witzel-Behl wrote only that it &ldquo;has been a pleasure to serve the City for 20 years.&rdquo; She wished the mayor, the city clerks office and the city of Madison &ldquo;nothing but the best.&rdquo; She walks away from a <a href=\"https:\/\/pbswisconsin.org\/news-item\/madison-city-clerk-resigns-amid-investigations-over-uncounted-2024-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">$152,300<\/a> annual salary.&nbsp;<\/p>\n<p>Brogan dismissed the idea that Witzel-Behl was asked to resign. The city did not <a href=\"https:\/\/www.cityofmadison.com\/news\/2025-04-14\/announcement-regarding-the-city-of-madison-clerks-office\" target=\"_blank\" rel=\"noreferrer noopener\">announce<\/a> the clerk&rsquo;s resignation until Monday, praising her for her service to the multifaceted office. True to form, Madison&rsquo;s leftist city leaders saluted Witzel-Behl for her commitment to &ldquo;inclusivity and community engagement.&rdquo; The mayor <a href=\"https:\/\/www.cityofmadison.com\/news\/2025-04-14\/announcement-regarding-the-city-of-madison-clerks-office\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Witzel-Behl &ldquo;embodies the motto she brought to the Clerk&rsquo;s Office: &lsquo;We exist to assist.&rsquo;&rdquo;<\/p>\n<p>But Rhodes-Conway clearly was not pleased with the public-relations black eye the liberal city was soon to receive over the uncounted ballots &mdash; and other recent missteps.&nbsp;<\/p>\n<p>&ldquo;I was extremely disturbed to once again have to find out about a significant issue in your office not from you, but from another department,&rdquo; Sam Munger, the mayor&rsquo;s chief of staff, wrote in a Dec. 20 email to Witzel-Behl, according to documents obtained through an open-records request by Madison&rsquo;s Isthmus, a liberal news outlet. &ldquo;Worse yet, apparently you have been aware of this issue since at least Thanksgiving and are only now bringing it to the attention of anyone else in the city.&rdquo;<\/p>\n<p>&ldquo;This incident highlights the ongoing issues with communications from your office and, combined with questionable handling of a number of previous incidents this year, has significantly undermined our confidence in your leadership of the department,&rdquo; Munger added.&nbsp;<\/p>\n<p>Witzel-Behl apologized a few days later, according to the emails obtained by Isthmus. &ldquo;The updates I received from the hourly employees reconciling voter participation did not convey the volume involved here. I learned on Friday that &lsquo;some ballots&rsquo; was 193 ballots. I should have pressed for more details earlier and communicated with all of you weeks ago,&rdquo; the clerk wrote. Witzel-Behl could not be reached for comment Tuesday.&nbsp;<\/p>\n<h2>&lsquo;On Vacation&rsquo;<\/h2>\n<p>Rhodes-Conway, who has <a href=\"https:\/\/thefederalist.com\/2025\/03\/08\/leftist-lawfare-firm-sues-democrat-run-wisconsin-city-for-disenfranchising-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">accused <\/a>Republicans who support election integrity laws of voter suppression tactics, must see the irony of her city clerk&rsquo;s office disenfranchising nearly 200 voters in a high-turnout presidential election.&nbsp;<\/p>\n<p>Late last year, Witzel-Bell acknowledged in a letter that her office failed to communicate the uncounted absentee ballots to the state elections regulator for more than a month after the discovery. Even then, the city clerk&rsquo;s office didn&rsquo;t alert the Wisconsin Elections Commission to the uncounted ballots as much as it requested help with a &ldquo;reconciliation override&rdquo; to enter the <a href=\"https:\/\/www.cityofmadison.com\/news\/2024-12-26\/disclosure-of-unprocessed-absentee-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;unprocessed&rdquo;<\/a> votes into the state&rsquo;s election system, The Federalist <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> at the time. The delayed reporting is especially concerning to the WEC, which continues to investigate. &nbsp;<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Witzel-Behl previously told me she was on vacation for a lot of the time following Election Day in November. Brogan said the city could not comment on whether the time away had anything to do with the communication failures.&nbsp;<\/p>\n<p>&ldquo;I think her sin was going on vacation after the election,&rdquo; Spindell said. The elections commissioner defended the veteran clerk, saying he believes the &ldquo;mistake&rdquo; could have happened to anyone.&nbsp;<\/p>\n<p>But 2024 was a rough year for the Madison City Clerk&rsquo;s office.<\/p>\n<h2>&lsquo;Legally Dubious Election Practices&rsquo;<\/h2>\n<p>In <a href=\"https:\/\/thefederalist.com\/2024\/09\/26\/wisconsin-congressman-wants-answers-on-madisons-2200-duplicate-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">September,<\/a> Witzel-Behl had to send out apology letters after more than 2,200 voters in the leftist enclave received <a href=\"https:\/\/thefederalist.com\/2024\/09\/26\/wisconsin-congressman-wants-answers-on-madisons-2200-duplicate-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">duplicate absentee ballots.<\/a> City officials <a href=\"https:\/\/www.cityofmadison.com\/news\/2024-09-23\/madison-clerks-office-correcting-duplicate-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> the &ldquo;data processing error&rdquo; affected an isolated number of voters and was quickly remedied, but the <a href=\"https:\/\/amzn.to\/3YuVZYV\">glitch understandably raised election integrity concerns<\/a> in the closing months of the 2024 presidential election cycle.&nbsp;<\/p>\n<p>Madison&rsquo;s history of suspect election practices &mdash; from its involvement in the <a href=\"https:\/\/thefederalist.com\/2021\/10\/14\/zuckerbucks-101-how-a-media-mogul-took-over-the-2020-election-and-why-gop-leaders-must-never-let-it-happen-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zuckbucks scandal<\/a> to a <a href=\"https:\/\/thefederalist.com\/2024\/04\/11\/exclusive-8-ways-to-ensure-all-legitimate-votes-get-counted-but-no-others\/\" target=\"_blank\" rel=\"noreferrer noopener\">massive ballot harvesting operation<\/a> during Covid &mdash; raised more alarms in a critical battleground state.&nbsp;<\/p>\n<p>&ldquo;Given the history of controversial and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wi-congressman-wants-answers-on-2200-duplicate-ballots\/\" title=\"WI Congressman Wants Answers On 2,200 Duplicate ...\">legally dubious election practices carried<\/a> out by Madison officials in the past &mdash; and your own personal history as an operative for the left-wing, &lsquo;Zuckerbucks&rsquo; financed Center for Tech and Civic Life &mdash; I don&rsquo;t have to tell you how important it is for the city to provide full transparency regarding how an &lsquo;error&rsquo; of this magnitude was allowed to happen at such a pivotal time,&rdquo; Rep. Tom Tiffany, Wisconsin&rsquo;s 7th Congressional District representative, wrote in a <a href=\"https:\/\/tiffany.house.gov\/sites\/evo-subsites\/tiffany.house.gov\/files\/evo-media-document\/Madison_Clerk_Duplicate_Ballots.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> to the city clerk. &nbsp;<\/p>\n<p>Witzel-Behl was a <a href=\"https:\/\/thefederalist.com\/2024\/10\/07\/emails-zuckbucks-group-coached-madison-clerk-on-combating-election-misinformation\/\" target=\"_blank\" rel=\"noreferrer noopener\">driving force<\/a> behind <a href=\"https:\/\/www.influencewatch.org\/non-profit\/center-for-tech-and-civic-life\/\" target=\"_blank\" rel=\"noreferrer noopener\">CTCL<\/a>&lsquo;s <a href=\"https:\/\/www.influencewatch.org\/person\/maribeth-witzel-behl\/\" target=\"_blank\" rel=\"noreferrer noopener\">partnership<\/a> with the city of Madison, one of the so-called &ldquo;<a href=\"https:\/\/thefederalist.com\/2024\/04\/05\/in-opposite-day-logic-usa-today-breathlessly-defends-zuckerbucks\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wisconsin 5<\/a>&rdquo; cities that received millions of dollars in Facbook founder Mark Zuckerberg-funded private grants in the 2020 elections. She served as a member of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-clerks-office-sent-out-2200-duplicate-ballots\/\" title=\"Wisconsin ...&#039;s ... Sent Out 2,200 Duplicate ...\">left-wing organization&#038;rsquo<\/a>;s advisory committee, according to nonprofit tracker <a href=\"https:\/\/www.influencewatch.org\/person\/maribeth-witzel-behl\/\" target=\"_blank\" rel=\"noreferrer noopener\">InfluenceWatch.<\/a>&nbsp;<\/p>\n<p>Madison City Attorney <a href=\"https:\/\/www.cityofmadison.com\/attorney\/about\/bio.cfm\" target=\"_blank\" rel=\"noreferrer noopener\">Michael Haas<\/a> will continue to serve as acting clerk while Witzel-Behl&rsquo;s permanent replacement is sought, <a href=\"https:\/\/www.cityofmadison.com\/news\/2025-04-14\/announcement-regarding-the-city-of-madison-clerks-office\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> the city. Haas previously served as <a href=\"https:\/\/www.wpr.org\/politics\/despite-gop-warning-elections-commission-stands-michael-haas-administrator\" target=\"_blank\" rel=\"noreferrer noopener\">administrator<\/a> of the Wisconsin Elections Commission.
