Taking &lsquo;all available steps to facilitate&rsquo; the return of Abrego Garcia is thus best read as taking all available steps to remove any domestic obstacles that would otherwise impede the alien&rsquo;s ability to return here. Indeed, no other reading of &lsquo;facilitate&rsquo; is tenable&mdash;or constitutional&mdash;here,&rdquo; government attorneys <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.65.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">wrote<\/a>.<\/p>\n<p>Abrego Garcia, a Salvadoran national with a valid U.S. work permit since 2019, was deported in March from&nbsp;<a href=\"http:\/\/washingtonexaminer.com\/tag\/maryland\" target=\"_blank\" rel=\"noreferrer noopener\">Maryland<\/a>&nbsp;as part of a larger group of alleged Tren de Aragua gang members. Although an immigration judge had issued a stay of removal for the deportee, which the Justice Department has acknowledged, the government has argued that Abrego Garcia had MS-13 gang ties and that any prospects of his return are now in El Salvador&rsquo;s hands.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">Last week, the Supreme Court <\/span>declined to overturn&nbsp;a lower court order from U.S. District Judge Paula Xinis, who, on April 4, instructed the government to bring him back to the U.S. But the <a href=\"https:\/\/amzn.to\/3YuVZYV\">high court order&#038;rsquo<\/a>;s careful wording has been subject to varied interpretations, including a line in which the majority said Xinis must clarify part of her original order that directed the government to &ldquo;effectuate&rdquo; the return.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">President&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\">Donald Trump<\/a>&lsquo;s deputy ch<\/span>ief of staff, Stephen Miller, spoke to Fox News on Monday, saying&nbsp;the administration viewed the Supreme Court&rsquo;s order as a win despite legal experts describing it as ambiguous and possibly subject to further review.<\/p>\n<p>&ldquo;We won the Supreme Court case. Clearly, 9-0,&rdquo; Miller said. &ldquo;A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wow-georgia-judge-who-also-is-stacy-abrams-sister-blocks-elections-officials-from-challenging-voters-who-live-outside-of-registered-district\/\" title=\"WOW! That would be kidnapping&hellip; an invasion of El Salvador&rsquo;s sovereignty.&rdquo;<\/p>\n<p>&ldquo;So [Trump] appealed to the Supreme Court, and it said&mdash;clearly&mdash;no district court can compel the president to exercise his Article II foreign powers,&rdquo; Miller added.<\/p>\n<p>Abrego Garcia remains in a Salvadoran terrorism confinement center. The State Department said Saturday he is <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3378821\/state-department-confirms-abrego-garcia-alive-secure-el-salvador-prison\/\" target=\"_blank\" rel=\"noopener\" title=\"\">&ldquo;alive and secure,&rdquo;<\/a> responding to Judge Xinis&rsquo;s demand for daily updates.<\/p>\n<p><strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3378068\/doj-judge-supreme-court-abrego-garcia\/\" target=\"_blank\" rel=\"noopener\" title=\"DOJ AND JUDGE CLASH OVER SUPREME COURT ORDER IN ABREGO GARCIA CASE\">DOJ AND JUDGE CLASH OVER SUPREME COURT ORDER IN ABREGO GARCIA CASE<\/a><\/span><\/strong><\/p>\n<p>His lawyers are urging the court to compel the administration to ensure his &ldquo;safe passage&rdquo; on a return flight and asked why Trump administration officials shouldn&rsquo;t be held in contempt.<\/p>\n<p>Trump is <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3378885\/el-salvador-president-nayib-bukele-arrives-dc-trump-visit\/\" target=\"_blank\" rel=\"noopener\" title=\"\">expected to meet<\/a> El Salvador&rsquo;s President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/nayib-bukele\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nayib Bukele<\/a> at the White House on Monday, though it&rsquo;s unclear whether Abrego Garcia&rsquo;s case will be raised.
