ICE operations based on a detainer, which he called &ldquo;simply an unconstitutional *request* from ICE.&rdquo; Detainers are documents ICE files with police agencies to prevent <a href=\"https:\/\/www.westernjournal.com\/rancher-dealt-devastating-impact-illegal-immigration-sends-message-kamala-ahead-border-visit\/\" target=\"_blank\" rel=\"noopener\">illegal immigrants<\/a> from being released anywhere except to ICE&rsquo;s custody.<\/p>\n<p>Marx claimed <a href=\"https:\/\/www.westernjournal.com\/numbers-dont-lie-one-simple-stat-shows-just-effective-trumps-illegal-immigration-crackdown\/\" target=\"_blank\" rel=\"noopener\">his goal<\/a> was &ldquo;to make certain your rights are not being abused.&rdquo;<\/p>\n<p>&ldquo;If their actions or paperwork are not within <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-s-supreme-court-to-hear-challenge-on-homelessness-ordinance-ban\/\" title=\"U.S. Supreme Court to review homelessness ordinance ban\">constitutional parameters<\/a>, then we will make every effort to block, interfere and interrupt their actions from moving forward,&rdquo; \t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>&ldquo;Simply put, they are not sure they are detaining the right person and need more time to figure it out,&rdquo; he continued, claiming that &ldquo;these detainers are violations of our 4th Amendment protection against warrantless search, seizure and arrest, and our 6th Amendment right to due process.&rdquo;<\/p>\n<p>Marx said his &ldquo;long-time stance on not recognizing detainers&rdquo; and involvement with immigration enforcement is based on &ldquo;<a href=\"https:\/\/amzn.to\/3YuVZYV\">constitutional standards &#038;hellip<\/a>; not opinions, politics or emotions.&rdquo;<\/p>\n<p>Iowa Republican Gov. Kim Reynolds, noting that Marx had publicly vowed to violate the state law that requires cooperation with <a href=\"https:\/\/www.westernjournal.com\/ice-nabs-prominent-illegal-immigration-activist-flouted-law-years-finally-got\/\" target=\"_blank\" rel=\"noopener\">immigration authorities<\/a>, referred the case to Bird&rsquo;s office, which first tried to get a retraction from Marx. When that did not happen, Bird&rsquo;s office filed a lawsuit against Marx, which would strip his county of all state funding for breaking the law.<\/p>\n<p>The <a href=\"https:\/\/www.iowaattorneygeneral.gov\/media\/cms\/03_F9E7C887169CA.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> noted that what Marx said and what he does are very different things. Marx has complied with every detainer filed with his office since November 26, 2018, the lawsuit said, noting that a letter sent to the state said Marx supports ICE.<\/p>\n<p>But the <a href=\"https:\/\/www.westernjournal.com\/knew-exactly-trump-wants-iowa-pollster-investigated-huge-election-miss\/\" target=\"_blank\" rel=\"noopener\">state<\/a> wrote that &ldquo;by stating wrong facts about following State and federal law and misleadingly posting about complying with 21 ICE encounters, the Sheriff intentionally posted <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trumps-executive-order-on-foreign-interference-in-elections-comes-due-today-things-are-going-to-get-real-real-soon\/\" title=\"President Trump\u2019s Executive Order On Foreign Interference in Elections Comes Due Today \u2013 Things Are Going to Get Real \u2013 Real Soon\">false information<\/a>. That false information had the effect of discouraging violation enforcement in violation of the law.&rdquo;<\/p>\n<p>At the time of the lawsuit being filed, the post was still up on Facebook. But even after it was taken down, the sheriff and the state were at odds.<\/p>\n<p>Bird&rsquo;s office sent Marx language to post, which included the phrase, &ldquo;It was wrong. It made many incorrect statements regarding my Office&rsquo;s policies on ICE detainers,&rdquo; according to <a href=\"https:\/\/www.kcci.com\/article\/report-winneshiek-sheriff-dan-marx-ice-detainer-post\/64303350\" target=\"_blank\" rel=\"noopener\">KCCI-TV<\/a>.<\/p>\n<p>The new post did not use those words.<\/p>\n<p>&ldquo;The language of the post proposed by the Attorney General was not acceptable to the County.
