Last year, he argued, and won, Trump&rsquo;s claim to presidential immunity in a historic case stemming from the former president&rsquo;s alleged role in the Jan. 6 Capitol riot. Harris has served as acting solicitor general in Sauer&rsquo;s place, guiding the administration&rsquo;s litigation strategy while his confirmation was pending.<\/p>\n<p>Now Sauer is expected to oversee several major cases this term, including challenges to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3348712\/supreme-court-trump-request-pause-birthright-citizenship-order\/\" target=\"_blank\" rel=\"noopener\" title=\"\">birthright citizenship<\/a> and fast-track deportation authority, as well as legal questions over defunding federal grants and <a href=\"https:\/\/amzn.to\/3YuVZYV\">removing civil service protections<\/a> for thousands of government workers. While the solicitor general traditionally argues the most consequential cases, deputies under Sauer may also take the lead in oral arguments depending on the issue.<\/p>\n<p>Legal experts say the timing of Sauer&rsquo;s confirmation, just ahead of April&rsquo;s argument calendar, places him squarely in the spotlight for some of the administration&rsquo;s most consequential legal battles.<\/p>\n<p>Though not listed on the briefs, Sauer also raised eyebrows for filing two high court requests on Trump&rsquo;s behalf before his confirmation. He <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-656\/336151\/20241227163400981_2024-12-27%20-%20TikTok%20v.%20Garland%20-%20Amicus%20Brief%20of%20President%20Donald%20J.%20Trump.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">urged<\/a> the justices to pause a law that could ban TikTok and to <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A666\/336760\/20250107212856360_2025-01-07%20-%20Trump%20v.%20New%20York%20-%20Supreme%20Court%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">halt Trump&rsquo;s sentencing<\/a> in the New York hush money case.<\/p>\n<p>At his confirmation hearing, Sauer cited fidelity to the Constitution and praised Scalia as a guiding influence.
