hidden in corners that I think a lot of states don&rsquo;t even know about &mdash; that unconstitutionally discriminates against religious organizations and religious conduct,&rdquo; said Notre Dame law professor Nicole Garnett, one of the project&rsquo;s lead architects.<\/p>\n<p>Developed by the Epic Coalition in partnership with Notre Dame Law School&rsquo;s Lindsay and Matt Moroun Religious Liberty Clinic and the Orthodox Union&rsquo;s Teach Coalition, the tool is designed to spotlight laws that violate the First Amendment under recent Supreme Court rulings.<\/p>\n<p>&ldquo;This law tends to have been adopted in a previous era, when there was more constitutional suspicion toward religious conduct,&rdquo; Garnett told the <em>Washington Examiner<\/em>. <\/p>\n<p>&ldquo;It reflects an outdated understanding of the First Amendment that views religion with hostility,&rdquo; she added.<\/p>\n<p>Garnett said the goal of the database is to shine &ldquo;light in these dark corners&rdquo; of state policy. &ldquo;This is all really bad. This is all unconstitutional. And you should stop it now,&rdquo; she said. &ldquo;Hopefully, the people in charge of these laws will fix them &mdash; either through legislation, executive orders, or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/three-virginia-universities-end-vaccine-mandate-after-ags-legal-opinion\/\" title=\"Three Virginia Universities End Vaccine Mandate After AG\u2019s Legal Opinion\">attorney general opinions<\/a>.&rdquo;<\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">The Supreme Court, not to mention the country, has long struggled with the First Amendment, which simultaneously prohibits Congress from establishing an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ohio-mother-receives-more-than-150k-for-home-after-leaving-kids-in-motel-room-to-go-to-work\/\" title=\"Ohio mother receives more than 0K for home after leaving kids in motel room to go to work\">official state religion<\/a> while protecting its &ldquo;free exercise.&rdquo; (AP File) | Evan Vucci<\/figcaption><\/figure>\n<p>The project draws its legal foundation from what Garnett calls the &ldquo;trinity&rdquo; of religious liberty precedents at the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>:&nbsp;<em><a href=\"https:\/\/www.washingtonexaminer.com\/news\/1193320\/supreme-court-blocking-church-daycare-from-state-funding-unconstitutional\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Trinity Lutheran v. Comer<\/a><\/em>&nbsp;(2017),&nbsp;<em><a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/2274003\/the-supreme-court-will-hear-landmark-school-choice-case-next-session\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Espinoza v. Montana<\/a><\/em>&nbsp;(2020), and&nbsp;<em><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2882669\/supreme-court-scores-a-win-for-education-and-liberty\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Carson v. Makin<\/a><\/em>&nbsp;(2022). But while those rulings struck down blanket bans on religious groups accessing public benefits, the real-world application of the precedents remains patchy.<\/p>\n<p>&ldquo;There&rsquo;s a whole bunch of bad law still on the books that a lot of states don&rsquo;t even know about,&rdquo; Garnett said. &ldquo;Some of the stuff is so glaring that I can imagine advocates challenging them in court and succeeding.&rdquo;<\/p>\n<figure class=\"wp-block-image size-full\"><figcaption class=\"wp-element-caption\">A screenshot from Religious Equality&rsquo;s database focused on statutes in California.<\/figcaption><\/figure>\n<p>Examples of highlighted laws from the <a href=\"https:\/\/religiousequality.net\/map\/\" target=\"_blank\" rel=\"noopener\" title=\"\">tracker<\/a> include:<\/p>\n<p>&bull;&nbsp;<strong>California<\/strong>&nbsp;allows school districts to contract with hospitals for special education services but not with religious hospitals.<\/p>\n<p>&bull;&nbsp;<strong>Georgia<\/strong>&nbsp;bars faith-based nonprofit groups from receiving donations through the state employee giving program unless they separate religious and secular operations.<\/p>\n<p>&bull;&nbsp;<strong>Oklahoma:<\/strong>&nbsp;excludes public funds for arts or recreation programs that serve or support a religious denomination or sect.<\/p>\n<p>&bull;&nbsp;<strong>Arkansas<\/strong>&nbsp;offers grants for small museums but not for projects with a religious purpose or message.<\/p>\n<p>&bull;&nbsp;<strong>Massachusetts<\/strong>&nbsp;allows surplus military food to be donated to charitable institutions but not to religious organizations.<\/p>\n<p>Garnett emphasized that while litigation is one possible path, &ldquo;I would rather have legal reform than lawsuits.&rdquo; She also noted the significance of the coalition behind the tracker, which includes Catholic and Jewish organizations working together to document what they view as systemic bias.<\/p>\n<p>&ldquo;This is just states &mdash; and a few local provisions,&rdquo; she said. &ldquo;But we haven&rsquo;t even gotten to the federal level yet. There are hundreds and hundreds of violations in federal law as well.&rdquo;<\/p>\n<p>The launch of the tracker comes as <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/oklahoma\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Oklahoma<\/a> emerges as a flashpoint in the broader religious freedom debate. <\/p>\n<p>On Monday, Gov. Kevin Stitt (R-OK)&nbsp;<a href=\"https:\/\/www.news9.com\/story\/67eb14d208d1dfb5efbf8054\/oklahoma-religious-liberty-executive-order-governor-stitt\" target=\"_blank\" rel=\"noreferrer noopener\">issued an executive order<\/a>&nbsp;instructing all state agencies to identify and eliminate rules that discriminate against religious organizations. The order followed a 2023 amendment to Oklahoma&rsquo;s Religious Freedom Act and was issued just weeks before the Supreme Court is set to hear arguments in the case involving&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3300379\/supreme-court-fate-publicly-funded-catholic-charter-school\/\" target=\"_blank\" rel=\"noreferrer noopener\">St. Isidore of Seville Catholic Virtual School<\/a>, the first <a href=\"https:\/\/amzn.to\/3YuVZYV\">proposed state-funded religious charter school<\/a> in the country.<\/p>\n<p>The Sooner State is at a crossroads in its conservative leadership, as Republican Attorney General Gentner Drummond, who is running to replace Stitt in 2026, has vehemently challenged calls to allow public-funded religious charter schools.<\/p>\n<p>&ldquo;Gov.
