Planned Parenthood South Atlantic<\/em>, SCOTUS is slated to weigh whether South Carolina is within its rights to find Planned Parenthood ineligible for Medicaid funding due to its <a href=\"https:\/\/lozierinstitute.org\/fact-sheet-planned-parenthoods-2022-23-annual-report\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion obsession<\/a>. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1852841438\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>At South Carolina Gov. Henry McMaster&rsquo;s direction, the state<a href=\"https:\/\/thefederalist.com\/2025\/03\/31\/scotus-could-stop-medicaid-dollars-from-funding-planned-parenthood\/\" target=\"_blank\" rel=\"noreferrer noopener\"> sought to redirect Medicaid funds <\/a>that would normally end up in Planned Parenthood&rsquo;s pockets to facilities focused on better, more comprehensive healthcare instead of ending lives. Planned Parenthood strongly opposed this obstacle to the flow of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/study-taxpayer-funded-abortion-seekers-are-often-repeat-customers\/\" title=\"Study: Taxpayer...Funded ... Seekers Are Often Repeat Customers\">federal tax dollars<\/a>, which no doubt help <a href=\"https:\/\/thefederalist.com\/2025\/03\/11\/congress-has-a-chance-to-defund-planned-parenthood-heres-why-the-gop-should-take-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">sustain its existence<\/a>, and sued to stop it.<\/p>\n<p>According to South Carolina&rsquo;s legal representation John Bursch, senior counsel and vice president of appellate advocacy at Alliance Defending Freedom, South Carolina &ldquo;should be free&rdquo; to honor the <a href=\"https:\/\/www.kofc.org\/en\/resources\/communications\/polls\/2023-kofc-marist-poll-cross-tabs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">majority of Americans&rsquo; opposition to taxpayer-funded abortions<\/a> and be selective with which providers get Americans&rsquo; <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/government-unions-have-been-stealing-money-for-years-now-scotus-has-the-chance-to-intervene\/\" title=\"Government Unions Have Been Stealing Money For Years \u2014 Now, SCOTUS Has The Chance To Intervene\">hard-earned dollars<\/a>.<\/p>\n<p>&ldquo;Taxpayer dollars should never be used to fund facilities that profit off abortion and distribute dangerous gender-transition drugs to minors,&rdquo; Bursch <a href=\"https:\/\/adfmedia.org\/case\/medina-v-planned-parenthood-south-atlantic\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in a statement before arguments began. &ldquo;State officials should be free to determine that Planned Parenthood&mdash;a <a href=\"https:\/\/amzn.to\/3YuVZYV\">multi-billion-dollar activist organization&#038;mdash<\/a>;is not a real healthcare provider and is not qualified to receive taxpayer funding through Medicaid.&rdquo; <\/p>\n<p>Three of the Democrat-nominated justices including Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, tried to turn the rights conversation on its head and argue that abortion businesses like Planned Parenthood are more than entitled to funding if a Medicaid beneficiary chooses the abortion giant as her provider.<\/p>\n<p>Nicole Saharsky, the counsel representing Planned Parenthood South Atlantic, also tried to argue that the &ldquo;individual dignity and individual economy&rdquo; her client touts for Medicaid recipients is supposed to give them &ldquo;the same thing people with private insurance enjoy.&rdquo;<\/p>\n<p>As Bursch noted, however, much like a private insurance company determines which doctors are within the network, the Palmetto State should have the authority to disqualify abortion giant Planned Parenthood as a covered option for Medicaid patients.<\/p>\n<p>There are plenty of good reasons states might defund Planned Parenthood. In addition to ending unborn lives or&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/03\/24\/malpractice-lawsuit-woman-hospitalized-after-abortionist-left-baby-body-parts-in-her-abdomen\/\" target=\"_blank\" rel=\"noreferrer noopener\">botching their attempts to<\/a>&nbsp;do so, the biggest abortion business in the country has a history of&nbsp;<a href=\"https:\/\/thefederalist.com\/2016\/06\/24\/new-evidence-planned-parenthood-broke-federal-law-lied-to-women\/\" target=\"_blank\" rel=\"noreferrer noopener\">allegedly flouting federal law<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/lozierinstitute.org\/wp-content\/uploads\/2017\/01\/plannedparenthood-profit-no-matter-what.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wasting tax dollars<\/a>,&nbsp;<a href=\"https:\/\/www.heritage.org\/gender\/commentary\/dont-defend-planned-parenthoods-gender-affirming-care-defund-it\" target=\"_blank\" rel=\"noreferrer noopener\">dispensing castrating drugs<\/a>&nbsp;to confused minors, reportedly&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/11\/22\/report-planned-parenthood-caught-selling-viable-fetuses-to-university-of-california-san-diego\/\" target=\"_blank\" rel=\"noreferrer noopener\">trafficking baby<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2020\/04\/15\/new-unsealed-documents-show-planned-parenthood-profited-from-aborted-baby-body-parts\/\" target=\"_blank\" rel=\"noreferrer noopener\">body parts,<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2022\/07\/20\/want-to-know-who-is-really-empowered-by-abortion-sex-traffickers-and-abusers\/\" target=\"_blank\" rel=\"noreferrer noopener\">enabling abusers<\/a>,&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/florida-investigation-of-planned-parenthood-clinics-finds-deficiencies-1438817376\">allegedly performing unlicensed<\/a>&nbsp;<a href=\"https:\/\/www.lifenews.com\/2016\/01\/29\/planned-parenthood-breaks-state-law-to-open-unlicensed-abortion-clinic-in-kentucky\/\">procedures<\/a>&nbsp;and violating&nbsp;<a href=\"https:\/\/6abc.com\/archive\/9059172\/\" target=\"_blank\" rel=\"noreferrer noopener\">health<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/02\/15\/us\/planned-parenthood-clinics.html\" target=\"_blank\" rel=\"noreferrer noopener\">safety standards<\/a>,&nbsp;<a href=\"https:\/\/www.stlpr.org\/politics-issues\/2018-02-23\/protest-buffer-zone-at-st-louis-planned-parenthood-narrowly-earns-first-round-approval#stream\/0\" target=\"_blank\" rel=\"noreferrer noopener\">opposing free speech<\/a>, and conducting procedures that have resulted in&nbsp;<a href=\"https:\/\/www.lifenews.com\/2012\/10\/09\/deaths-at-planned-parenthood-show-no-concern-for-women\/\">mothers&rsquo; deaths<\/a>.<\/p>\n<p>South Carolina&rsquo;s case for denying Planned Parenthood taxpayer funding found support among the <a href=\"https:\/\/adfmedia.org\/press-release\/us-govt-18-states-rally-support-south-carolina-diverting-medicaid-funds-planned\/\" target=\"_blank\" rel=\"noreferrer noopener\">18 states<\/a>, the federal government, several members of Congress, practicing South Carolina medical practitioners, and pro-life activists who all&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23-1275.html\" target=\"_blank\" rel=\"noreferrer noopener\">submitted friend-of-the-court briefs<\/a>.<\/p>\n<p>&ldquo;Congress didn&rsquo;t intend to allow Medicaid recipients to drag states into federal court to challenge those decisions&mdash;nor did Congress intend for federal courts to second-guess states&rsquo; decisions about which providers are qualified to receive Medicaid funding,&rdquo; Bursch concluded in a statement. &ldquo;We are urging the Supreme Court to restore the ability of states to steward limited public resources to best serve their citizens.&rdquo;<\/p>\n<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
