The decision aims to balance the safety of staff, inmates, and the public amidst an ongoing crisis in staffing levels. Inmates eligible for early release must be within 15 to 110 days of their approved release date and have a residential address, even though those convicted of sex offenses or violent felonies will not qualify. Martuscello’s memorandum follows the recent firing of 2,000 correctional officers by Governor Kathy Hochul amid protests against rising assaults on staff, which many attributed to recent legislative changes impacting the disciplinary powers of guards.
