Wade\">Roe v. Wade<\/a><\/em>  in 2022. An 1849 prohibition on abortion immediately took effect after <em>Roe<\/em> was overturned, outlawing abortion in any circumstance except to save the mother&rsquo;s life.<\/p>\n<p>The political outcry about the 1849 law dominated the April 2023 judicial election, contributing to the victory of liberal judge Janet Protasiewicz.&nbsp;<\/p>\n<p>In December 2023, a Dane County Circuit Judge, Diane Schlipper, ruled that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/an-infamous-florida-man-is-in-biden-dojs-crosshairs\/\" title=\"An Infamous Florida Man Is in Biden DOJ\u2019s Crosshairs\">19th-century statute<\/a> only applied to feticide, meaning the killing of an unborn child without the consent of the mother. Currently, abortion is legal in Wisconsin until 20 weeks gestation, about the time of fetal viability outside the mother&rsquo;s womb.&nbsp;<\/p>\n<p>The state Supreme Court heard <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3225692\/wisconsin-supreme-court-hears-oral-arguments-1849-abortion-ban-validity\/\" target=\"_blank\" rel=\"noopener\" title=\"oral arguments\">oral arguments<\/a> in November on the appeal against the district court&rsquo;s ruling. (AP Photo\/Harm Venhuizen, File)<\/figcaption><\/figure>\n<p>For this year&rsquo;s judicial election, Crawford has voiced concerns about how Schimel&rsquo;s prior support for the 1849 law could influence the court should it be tipped to a conservative majority.<\/p>\n<p>In 2012, Schimel <a href=\"https:\/\/wisdems.org\/wisdems-news\/reminder-schimel-worked-to-overturn-reproductive-freedom-and-supports-enforcing-1849-criminal-abortion-ban\/#:~:text=In%202012%2C%20Schimel%20signed%20onto%2C%20and%20supported%2C,incest%2C%20or%20the%20health%20of%20the%20woman.\" target=\"_blank\" rel=\"noopener\" title=\"\">signed<\/a> a Wisconsin Right to Life legal brief advocating upholding the 1849 law in case&nbsp;<em>Roe<\/em>&nbsp;was overturned, which came to fruition 10 years later.<\/p>\n<p>The Republican candidate has <a href=\"https:\/\/archive.is\/bxKCD\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> on the campaign trail that he does not see a fundamental right to abortion in the Wisconsin state constitution, but he would respect the will of the people should they appoint him to the bench.&nbsp;<\/p>\n<p>It&rsquo;s not clear how much the abortion issue will weigh on voter&rsquo;s minds on Tuesday.&nbsp;<\/p>\n<p>During the 2024 general election, abortion did not play as significant of a<a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/3192841\/abortion-wont-be-the-winning-issue-2024\/\" target=\"_blank\" rel=\"noopener\" title=\" role \"> role <\/a>in voter turnout as Democrats anticipated, despite it being the first presidential race since <em>Roe<\/em> was overturned. Exit polling data found that voters across the country, including in Wisconsin, thought that immigration and economic troubles were more important than abortion.<\/p>\n<p>Several other issues, including voter identification laws, labor disputes, and House of Representatives congressional redistricting, could overshadow abortion as a motivating factor for voters.&nbsp;<\/p>\n<p>Crawford has signaled that she would be open to ordering redrawing of district lines should the court hold a liberal majority.
