The irony is rich, as could be the payout for four plaintiffs in the <a href=\"https:\/\/www.lawforward.org\/wp-content\/uploads\/2025\/03\/City-Notice-of-Claim-w-Appx-Exhs-Redacted_Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">class-action lawsuit<\/a> filed by Madison law firm <a href=\"https:\/\/www.influencewatch.org\/non-profit\/law-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">Law Forward<\/a>.&nbsp;<\/p>\n<p>Madison election officials, &ldquo;irrevocably deprived the Voters of their right to vote in the November 2024 general election,&rdquo; the complaint, filed this week in Dane County Circuit Court, asserts.&nbsp;<\/p>\n<p>The plaintiffs &mdash; thus far &mdash; are listed as Madison residents Precious Ayodabo, Jenna Ehab Innab, Amira Sophie Edes Pierotti, and Miriam Yui-Lam Sham. They each are seeking $175,000 in damages, alleging they were disenfranchised in a leftist city whose leaders have long railed against election-integrity efforts they say disenfranchise minorities.&nbsp;<\/p>\n<h2>&lsquo;Serious Oversight&rsquo;<\/h2>\n<p>As The Federalist <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> in January, the Wisconsin Elections Commission (WEC) opened an investigation into the Madison City Clerk&rsquo;s office after allegations that local elections officials failed to count 193 absentee ballots from three wards cast in the Nov. 5 general election. The commission voted unanimously to open the investigation, citing the <a href=\"https:\/\/thefederalist.com\/2025\/01\/06\/wisconsin-capital-city-under-investigation-over-failure-to-count-nearly-200-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;serious oversight.&rdquo;<\/a>&nbsp;<\/p>\n<p>In a letter from <a href=\"https:\/\/www.cityofmadison.com\/clerk\/contact\" target=\"_blank\" rel=\"noreferrer noopener\">Madison City Clerk Maribeth Witzel-Behl<\/a> to the commission, she says she failed to communicate the problem until more than a month after the Madison election office discovered a first batch of uncounted votes. Even then, Witzel-Behl merely requested help with a <a href=\"https:\/\/www.cityofmadison.com\/clerk\/documents\/election\/Memo%20to%20WEC%2020241220.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;reconciliation override&rdquo;<\/a> to enter the <a href=\"https:\/\/www.cityofmadison.com\/news\/2024-12-26\/disclosure-of-unprocessed-absentee-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;unprocessed&rdquo;<\/a> votes into the state&rsquo;s election system.&nbsp;&nbsp;<\/p>\n<p>The city of Madison insisted in a <a href=\"https:\/\/www.cityofmadison.com\/news\/2024-12-26\/disclosure-of-unprocessed-absentee-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a> they were informing the public of the misstep &ldquo;In the interest of full transparency&rdquo; &mdash; but not until Dec. 26. The city also said it would send out an apology letter to the voters in the three affected wards.&nbsp;<\/p>\n<p>&ldquo;[Y]our absentee ballot was not counted at the polls on November 5. This was due to an error made by our office; your certificate envelope was complete, and your ballot should have been processed,&rdquo; Witzel-Behl acknowledged in the <a href=\"https:\/\/www.lawforward.org\/wp-content\/uploads\/2025\/03\/City-Notice-of-Claim-w-Appx-Exhs-Redacted_Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>. The clerk claimed the uncounted ballots &ldquo;would not have changed the results of any race or referendum.&rdquo;<\/p>\n<h2>&lsquo;Price to Pay&rsquo;<\/h2>\n<p>An apology isn&rsquo;t going to cut it, Law Forward asserts in the class-action lawsuit.&nbsp;<\/p>\n<p>&ldquo;Respondents are liable for this deprivation. Our Supreme Court has held, in the voting context, that &lsquo;a ministerial officer is liable for a wrong done by him acting in his official character, though without malice,&rsquo;&rdquo; the lawsuit states.&nbsp;<\/p>\n<p>Speaking to reporters, Law Forward co-founder <a href=\"https:\/\/www.influencewatch.org\/non-profit\/law-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jeff Mandell <\/a>described the lawsuit as a &ldquo;necessary and important defense of the right to vote in Wisconsin.&rdquo;&nbsp;<\/p>\n<p>&ldquo;Our message today should resonate with anyone who seeks to disrupt Wisconsin&rsquo;s votes, absentee ballots or otherwise,&rdquo; Law Forward attorney Scott Thompson <a href=\"https:\/\/www.wpr.org\/news\/class-action-lawsuit-madison-193-uncounted-november-ballots-election\" target=\"_blank\" rel=\"noreferrer noopener\">said,<\/a> as reported by Wisconsin Public Radio. &ldquo;If anyone takes steps to violate a Wisconsinites&rsquo; [sic] right to vote, there is a price to pay.&rdquo;<\/p>\n<p>Of course, there&rsquo;s the potential for some cold, hard cash to be made from the taxpayers of Madison. The hefty $175,000 individual damages amount is, under state law, in excess of the <a href=\"https:\/\/www.lwm-info.org\/637\/Liability\" target=\"_blank\" rel=\"noreferrer noopener\">$50,000 maximum<\/a> award for actions against municipalities, but the leftist law firm shrugged off the cap as <a href=\"https:\/\/www.wpr.org\/news\/class-action-lawsuit-madison-193-uncounted-november-ballots-election\" target=\"_blank\" rel=\"noreferrer noopener\">unconstitutional.<\/a> &nbsp;<\/p>\n<h2>Fighting Voter Suppression&nbsp;<\/h2>\n<p>The Madison-based Law Forward firm was &ldquo;founded in 2020 by lawyers who have worked for Democratic interests in Wisconsin for many years,&rdquo; charity and activist tracker InfluenceWatch <a href=\"https:\/\/www.influencewatch.org\/non-profit\/law-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>.&nbsp;<\/p>\n<p>Law Forward&nbsp; <a href=\"https:\/\/www.lawforward.org\/about-us\/\" target=\"_blank\" rel=\"noreferrer noopener\">bills itself<\/a> as a protector of democracy, committed to &ldquo;fair, transparent, and representative government; where Wisconsinites can participate in free, fair elections where their vote counts.&rdquo; The group&rsquo;s record shows a commitment to Democrat Party causes, including its lead role in a <a href=\"https:\/\/thefederalist.com\/2024\/06\/05\/wisconsin-ag-files-phony-fake-elector-charges-anyway-after-admitting-gop-plan-was-legal\/\" target=\"_blank\" rel=\"noreferrer noopener\">legally shaky lawsuit<\/a> against Wisconsin&rsquo;s <a href=\"https:\/\/thefederalist.com\/2024\/11\/04\/left-wing-groups-are-fighting-to-kill-wisconsins-citizen-only-voting-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">alternate electors <\/a>for President Donald Trump in 2020. <\/p>\n<p>The <a href=\"https:\/\/www.lawforward.org\/trump-signals-battle-to-come-on-voting-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump-antagonistic firm<\/a> has fought election integrity measures, including Wisconsin constitutional amendments specifying that <a href=\"https:\/\/apnews.com\/article\/wisconsin-noncitizen-voting-constitutional-amendment-1e37322c2fd781c078ccf30e095cbcb3\" target=\"_blank\" rel=\"noreferrer noopener\">only U.S. citizens may vote<\/a> in state elections and <a href=\"https:\/\/www.lawforward.org\/mountains-and-molehills\/\" target=\"_blank\" rel=\"noreferrer noopener\">ending private funding <\/a><a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/voters-prohibit-zuckbucks-style-private-funding-and-staff-from-wisconsin-elections\/\">(Zuckbucks<\/a>) in election administration. The leftist attorneys have declared legal war on Wisconsin&rsquo;s Republican-controlled legislature, <a href=\"https:\/\/amzn.to\/3YuVZYV\">claiming laws strengthening election security disenfranchise voters<\/a>.&nbsp;<\/p>\n<p>&ldquo;Wisconsin&rsquo;s ruthless legislative leadership has undertaken a systematic effort to undercut democratic norms and to disenfranchise voters,&rdquo; Mandell said in a 2020 <a href=\"https:\/\/www.lawforward.org\/wp-content\/uploads\/2022\/09\/press-release-law-forward-launches-10.22.20.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a> proclaiming Wisconsin progressives&rsquo; efforts to &ldquo;Reverse Assaults on Democracy through the Courts.&rdquo;&nbsp;<\/p>\n<p>Madison Mayor <a href=\"https:\/\/www.cityofmadison.com\/mayor\" target=\"_blank\" rel=\"noreferrer noopener\">Satya Rhodes-Conway<\/a> has also attacked Republican-led election reform policies, haughtily boasting that her city is a citadel of democracy, a protecter of voting rights.&nbsp;<\/p>\n<p>&ldquo;This is such a critical time in our country,&rdquo; the leftist said in a 2022 press conference promoting voting rights legislation, as <a href=\"https:\/\/wisconsinexaminer.com\/2022\/01\/18\/madison-mayor-pushes-for-voting-rights-legislation-calls-out-wisconsin-republicans-in-online-event\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> by the leftist Wisconsin Examiner. &ldquo;And it really is incumbent on all of us to understand what&rsquo;s going on and to protect our democracy against the attacks that are coming towards it. Here in Madison, Wis., it has been incessant. We&rsquo;ve certainly been <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/black-panther-ii-wont-move-production-out-of-georgia\/\" title=\"\u2018Black Panther II\u2019 Won\u2019t Move Production Out Of Georgia\">fighting voter suppression<\/a> and attacks on democracy for years. But in the past year, it has reached a new level, I think, that is unprecedented.&rdquo;<\/p>\n<p>It turns out the self-righteous city &ldquo;fighting voter suppression&rdquo; admits to suppressing the votes of nearly 200 residents. Now, Madison faces a lawsuit for shoddy election administration.&nbsp;<\/p>\n<p>At a meeting Friday, the Wisconsin Elections Commission ordered staff to continue the investigation and <a href=\"https:\/\/www.channel3000.com\/news\/wec-moves-to-continue-investigation-into-uncounted-madison-ballots\/article_9cf05b82-fb7f-11ef-a4ed-f76fec2be62d.html\" target=\"_blank\" rel=\"noreferrer noopener\">depose<\/a> Madison elections officials to find just where things went wrong. Bob Spindell, one of three Republicans on the six-member commission, told The Federalist officials still have several unanswered questions despite <a href=\"https:\/\/www.lawforward.org\/wp-content\/uploads\/2025\/03\/City-Notice-of-Claim-w-Appx-Exhs-Redacted_Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of pages of communications<\/a> and other records retrieved from the city in WEC&rsquo;s investigation.&nbsp;<\/p>\n<p>Spindell said he doesn&rsquo;t think the clerk and her team did anything &ldquo;nefarious&rdquo; in overlooking the ballots, but the fact remains that 193 voters&rsquo; ballots didn&rsquo;t count in a presidential election.&nbsp;<\/p>\n<p>&ldquo;The thing that concerns me is that when this was brought to the attention of the clerk, I don&rsquo;t know what happened.
